About this file
This document contains questions and answers regarding solicitation N32205-20-R-4052 for a container vessel time charter. The solicitation requires offerors to have an active SECRET facility clearance at time of proposal submission. The vessel must be capable of stowing 1,400 twenty-foot equivalent units (TEUs) in a climate-controlled environment and an additional 1,000 TEUs without climate control. The vessel cannot require drydocking for repair during the firm charter period or option periods. The port of Concord has a maximum air draft restriction of 135 feet. No deviations will be considered for the air draft requirement or drydocking period.

QUESTIONS AND ANSWERS
Solicitation N32205-20-R-4052
Questions and Answers
1) “Is something less than an active facility clearance at the SECRET level, for example, a Limited Facility Clearance, acceptable?”
Answer: No. As stated in Box 75 Part X(y)(1) Critical Submission Data, the offerors must provide “Documentation (e.g., Industrial Security Facilities Database (ISFD), Defense Security Service DSS) letter, etc.) that Offeror has an active facilities clearance of at least a SECRET level.” Further, in Box 75 XI (b)(1) Critical Submission Data, states that “Proposals will first be evaluated on the basic requirement to be considered an offer, and those requirements of Part X of the RFP identified as "Critical Submission Data". Offers that fail to provide acceptable responses to the items listed in Part X as "Critical Submission Data" will not be further evaluated or considered for award. Finally, Part V (a) has been amended to read: Contractor Facility Clearance. The Contractor shall possess a SECRET facility clearance at time of proposal submission (See Part X and Part XI for proposal instructions and award criteria), which shall be incorporated at contract award in the required DD 254 (See Attachment D).”
2) In Clause E19.2, the mission cargo is given as 1400 TEUs. Attachment N gives the mission cargo as 1600 TEUs. Please clarify the correct number.
Answer: The requirement is to stow 1,400 TEU in a climatically controlled environment; 44 of these 1,400 TEU must be stowed on deck. The vessel must be capable of stowing an additional 1,000 TEU; these TEU do not require stowage in a climatically controlled environment. Please see updated Attachment N as part of this Amendment.
3) PWS Section E-3.5.1 states -- “Vessel shall be self-sustaining at all 20-foot container holds used to stow the 1,400 TEU of Mission Cargo identified in Attachment N plus an additional 1,000 TEU.”
Attachment N shows 1600 TEU’s.
Question -- How many TEU’s are required to be stowed in the environmentally spaces? 1400 or 1600?
Answer: The requirement is to stow 1,400 TEU in a climatically controlled environment; 44 of these 1,400 TEU must be stowed on deck. The vessel must be capable of stowing an additional 1,000 TEU; these TEU do not require stowage in a climatically controlled environment. Please see updated Attachment N as part of this Amendment
4) PWS Section E-3.5.5.1 Dry-Docking states -- Upon delivery, the Vessel shall conform to USCG regulations for extended tailshaft examination intervals found in 46 CFR 61.20-21 and for extended dry-dock examination interval found in 46 CFR 91.40-3(d) through (g). In addition, the Vessel shall not require dry-docking for credit during the Charter Period.
Question -- Is the requirement to not require a credit drydocking during the charter period refer to the firm charter period, or the firm period plus all options?
Answer: The requirement is for the vessel to deliver and not need to undergo a credit drydocking during the firm period plus all option periods.
5) PWS Section E-3.5.1 states -- Vessel shall conform to certain classified Vessel requirements contained in Appendix Q.
Question -- Where is Appendix Q?
Answer: There is a classified requirement in conjunction with this RFP that may eliminate offerors. Offerors who are affected will be given the opportunity during discussions to read/address this requirement provided that affected offerors have appropriate security clearances in place. Offerors not affected will not have a need to know about the requirement regardless of appropriate security clearances being in place.
6) Attachment P talks about mission cargo of 1400TEU “identified in Attachment N“, plus another 1000teu. for a total of 2,400teu.
But Attachment N lists 1,600teu, average 19.786 tons of mission cargo.
Can you clarify the apparent discrepancy?
Answer: Pls see responses to Questions 2 and 3 above.
7) Why is the air draft requirement as stated in the RFP? What port is controlling this restriction? Will a ship with an air draft requirement that is slightly higher be considered if it offers the government significant savings?
Answer: Military Ocean Terminal, Concord is the port controlling the 135’ air draft restriction. No, the government will not consider a vessel with a slightly higher air draft
8) Also, please advise if the maximum air draft of 135 ft is a mandatory requirement or if it can be exceeded.
Answer: Please see Government response to Question #7.
9) In Clause E19.2, the mission cargo is given as 1400 TEUs. Attachment N gives the mission cargo as 1600 TEUs. Please clarify the correct number.
Answer: Please see responses to Questions 2 and 3 above.
10) Please confirm that the Performa Charter Party being used is the DRYTIME 2013 (Rev 1(10-13))
Answer: Yes
11) Please confirm that offeror is not required to submit Past Performance Data Sheets (Attachment IX(A)) nor to send Performance Questionnaires (Attachment IX (B)) to MSC or other charterers.
Answer: No. Offerors should follow Box 75 Part X for instructions on submitting proposals.
12) It is unclear whether the contractor is required to submit Past Performance Data Sheets and to send Performance Questionnaires to references.
Please clarify.
Answer: Please see response to Question 11.
