JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL AND OPEN

COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC).

2. Description of the Action Being Approved: This is a justification for work to be provided under Work Items (WIs) 202, 203, 204, 205, 401, 402, 403, 404, 407, 409, 410, 411, 412, 504, 505, 509, 510, 512, 514, 601, 602, 607, 609, 611, 612, 613, 902, 905, 912, and 914 of the Statement of Work (SOW) for the sixty (60) Day Regular Overhaul (ROH) of the USNS JOSHUA HUMPHREYS (T-AO 188) under RFP N3220518R4013. This Justification covers only the portion of the acquisition for which an Original Equipment Manufacturer (OEM) Authorized Facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.

3. Description of Supplies/Services: MSC requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WI 202, 203, 204, 205, 401, 402, 403, 404, 407, 409, 410, 411, 412, 504, 505, 509, 510, 512, 514, 601, 602, 607, 609, 611, 612, 613, 902, 905, 912, and 914. For this sixty (60) Day ROH, the estimated dollar value of the thirty (30) WIs is , which will be funded utilizing FY 19 Operations & Maintenance funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304

(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).

5. Rationale Justifying Use of Cited Authority: The use of required OEM authorized field technical service representatives and OEM parts for highly specialized equipment is necessary for mission essential purposes. The required OEM authorized field technical service representatives and OEM parts maintain mission critical ship equipment and systems, the failure of which could have serious consequences for deployed military forces and the crew on the vessel during deployments. Further, the required OEM authorized field technical service representatives and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the T-AO class of vessels. The required OEM authorized field technical service representatives and OEM parts also maintain all OEM warranties, ensures equipment reliability, crew safety and applicable ABS/USCG certifications.

a. WI 202, Main Engine Fuel Injectors; Overhaul

The OEM for the main engine fuel injection pumps and injectors is MAN. MAN has two (2) OEM licensed/authorized suppliers of approved repair parts and service for their equipment:

Motor Services Hugo Stamp and Fairbanks Morse Engines. Proper refurbishment and maintenance of the Fuel Injectors is critical to the safe operation of the Main Engines onboard USNS JOSHUA HUMPHREYS (T-AO 188). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Main Propulsion Engines as critical equipment. Failure of the Main Propulsion Engines will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Fuel Injectors are critical to the safe operations of the USNS JOSHUA

HUMPHREYS (T-AO 188).

b. WI 203 Main Engine Turbochargers; Overhaul

The OEM for the Main Engine Turbo Chargers is ABB. ABB provides original OEM repair parts and service for their equipment. Proper refurbishment and maintenance of the Turbo Chargers is critical to the safe operation of the main engines onboard USNS JOSHUA HUMPHREYS (T-AO 188). ABB Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the main propulsion engines as critical equipment. Turbo Chargers are an integral part for Main Propulsion Engine. A turbocharger, or colloquially turbo, is a turbine-driven forced induction device that increases an internal combustion engine's efficiency and power output by forcing extra compressed air into the combustion chamber. Failure of the Main Propulsion Engines will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Main Propulsion Engine Turbo Chargers are critical to the safe operations of the USNS JOSHUA HUMPHREYS (T-AO 188).

c. WI 204 Main Engine Over-speeds; Overhaul

The OEM for the Main Engine Over-Speeds is MAN. MAN has two (2) OEM licensed/authorized suppliers of approved repair parts and service for their equipment: Motor Services Hugo Stamp and Fairbanks Morse Engines. Proper refurbishment and maintenance of the Over-Speeds is critical to the safe operation of the Main Engines onboard USNS JOSHUA HUMPHREYS (T-AO 188). as critical equipment. Over-speed is a condition in which an engine is allowed or forced to turn beyond its design limit. The consequences of running an engine too fast vary by engine type and model, and depend upon the duration of the over-speed and the speed that was attained by the engine. Therefore, consequences vary from causing engine damage up to and including destruction of the engine itself. Failure of the Main Engine Over-Speeds will severely impede the ship's ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Over-Speeds are critical to the safe operations of the USNS JOSHUA

d. WI 205 Main Engine Governors and Booster Assembly; Overhaul

The OEM for the Main Engine Governors and Booster assembly is Woodward. The Woodward Speed Governor operates the diesel engine fuel racks to ensure a constant engine speed is maintained at any load. The Governor is a mechanical-hydraulic type Governor and receives its supply of oil from the engine lubricating system Proper refurbishment and maintenance of the Governors and Booster assembly is critical to the safe operation of the main engines onboard USNS JOSHUA HUMPHREYS (T-AO 188). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety as critical equipment. Failure of the Main Propulsion Engines will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Governors and Booster Assembly are critical to the safe operations of the

USNS JOSHUA HUMPHREYS (T-AO 188).

e. WI 401, Radar/ECDIS Maintenance

The OEM for the vessel’s Radar is FURUNO, and the ECDIS is TRANSAS. FURUNO and TRANSAS have numerous authorized vendors to provide service to their equipment. An authorized vendor is required to provide documentation with a certificate of approved training for the FURUNO Radars and TRANSAS units that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The Radar and ECDIS systems are intricate components within the bridge navigation equipment. Failure of the Radar and ECDIS systems will severely impede the ship’s ability to safely navigate and identify other vessel operating in/around the vessel. Proper refurbishment and maintenance of the Radar and ECDIS are critical to the safe navigation and operation of the USNS Joshua Humphreys (T-AO 188).

f. WI 402, Gyro System Maintenance

The OEM for the vessel’s new NAVIGAT Gyro Compass Repeater System is Northrop Grumman Systems Corporation - Sperry Marine Division (NGSC-SMD). NGSC-SMD has numerous authorized vendors to provide service to their equipment. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized

SMS number 10.6-002-01-AO lists the Gyro Compass as critical equipment. Service of the GMDSS must be accomplished by USCG/ABS Approved and OEM trained vendors. Failure of the Gyro Compass or Steering Stand will severely impede the ship’s ability to navigate and maneuver the vessel. The reduction of the ability to navigate and maneuver the vessel will also pose a hazard to the crew and the vessel. Proper replacement and maintenance of the Gyro Compass and Steering Stand are critical to the safe operation of the USNS Joshua Humphreys (T-AO 188).

g. WI 403, Global Marine Distress and Safety System (GMDSS) Safety Radio Certificate

The OEM for the vessel’s GMDSS is FURUNO. FURUNO has numerous authorized vendors to provide service to their equipment. An authorized vendor is required to provide documentation with a certificate of approved training for the FURUNO FS-5000 GMDSS Console unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the Global Marine Distress and Safety System (GMDSS) is required by ABS and USCG. This equipment provides several means of communication and distress signaling including Search and Rescue Transponders (SARTs) and Emergency Position Indicating Radio Beacon (EPIRB). Service of the GMDSS must be accomplished by USCG/ABS approved and OEM trained vendors. Proper refurbishment and maintenance of the GMDSS are critical to the safe navigation and operation of the USNS Joshua Humphreys (T-AO 188).

h. WI 404, Simplified Voice Data Recorder (SVDR) Replacement with JRC-1950

The OEM for the vessel’s new SVDR is Japan Radio Company, Ltd (JRC). JRC has numerous authorized vendors to provide service to their equipment. An authorized vendor is required to provide documentation with a certificate of approved training for the new JRC-JCY-1950 unit that will be installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the SVDR is part of the vessel’s Safety Radio Certificate, as required by ABS. The SVDR is a USCG and ABS required system that is integrated into the Radar and ECDIS systems to records ship movements. Service of the SVDR must be accomplished by USCG/ABS approved and OEM trained vendors. Proper refurbishment and maintenance of the SVDR are critical to the safe navigation and operation of the USNS Joshua Humphreys (T-AO 188).

i. WI 407, UHF SATCOM and LOS Transceiver Groom

The Ultra High Frequency (UHF) Satellite Communication (SATCOM) & Line Of Sight (LOS) Transceiving Equipment identified in this work item is U.S. Navy classified equipment and can only be worked on, and repair parts provided, by U.S. Navy authorized service companies. The following companies are authorized by the U.S. Navy to service this equipment: Mid-Atlantic Engineering and Technical Services (MAETS); Intech Marine Services; and Allied Technology Group (ATG). These companies also have access to repair parts required by this work item. Other representatives may be considered if they provide the MSC Electronic Rep with a signed letter of qualification from the equipment manufacturer or a certificate of training. The UHF SATCOM & LOS Transceiving Equipment is the primary Program of Record system used to transmit / receive / process Radio Frequency communications with the US Navy via secure voice and data transfer over global satellite constellation.

The UHF SATCOM & LOS Transceiving Equipment is used in tandem with OE-82 item 0407.

Proper refurbishment and scheduled maintenance of the Ultra High Frequency (UHF) & Very High Frequency (VHF) Satellite Communication Transceiving Equipment is critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188) and the ability to conduct safe and secure communications with other Naval vessels while underway.

j. WI 409, URT-23(D) URR-2368A HF Set Groom

The High Frequency (HF) Radio Transmitting Equipment identified in this work item is U.S.

Navy classified equipment and can only be worked on, and repair parts provided, by U.S. Navy authorized service companies. The following companies are authorized by the U.S. Navy to service this equipment: Mid-Atlantic Engineering and Technical Services (MAETS); Intech Marine Services; and Allied Technology Group (ATG). These companies also have access to repair parts required by this work item. Other representatives may be considered if they provide the MSC Electronic Rep with a signed letter of qualification and certificate of training. The HF Radio Transmitting Equipment is the Primary Navy Program of Record system used to transmit / receive / process HIGH FREQUENCY (HF) Radio Frequency communications with the US Navy via secure voice and data transfer over extended range terrestrial / atmospheric medium. Proper refurbishment and scheduled maintenance of the HF Radio Transmitting Equipment is critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188) and the ability to conduct safe and secure communications with other Naval vessels while underway.

k. WI 410, Fathometer Dual Transducer Maintenance

The OEM for the vessel’s Fathometer (LAZ5100) is L-3 Marine and Power Systems (L-3M&PS).

L-3 M&PS has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a certificate of approved training for the LAZ5100 unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a products manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The Fathometer is an intricate component, identifying the depth of the water below the ship’s keel. Failure of the Fathometer will severely impede the ships ability to safely navigate approaching channels, and maneuvering in/around ports, increasing the possibility of grounding and degrade mission capabilities. Proper refurbishment and maintenance of the Fathometer is critical to the safe navigation and operations of the USNS JOSHUA

HUMPHREYS (T-AO188).

l. WI 411, Avaya Telephone System Groom

The OEM for the vessel’s telephone system is Avaya International. Avaya has numerous authorized technical representatives and partners to provide services to their equipment. An authorized vendor is required to provide documentation with a certificate of approved training for the Avaya phone system that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the phone system as critical equipment. Failure of the phone system will severely impede the ship’s ability to communicate and complete mission requirements. Proper refurbishment and maintenance of the phone system are critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188).

m. WI 412, Doppler Speed Log Maintenance

The OEM for the vessel’s Doppler Speed Log is Furuno. Vendor is required to provide documentation with a certificate of approved training from Furuno for the DS-80 unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The Doppler Speed Log is an intricate component, identifying the ship’s speed when navigating. Failure of the Doppler Speed Log will severely impede the ships ability to safely navigate and degrade mission capabilities. Proper refurbishment and maintenance of the Doppler Speed Log is critical to the safe navigation and operations of the USNS JOSHUA

n. WI 504 and WI 505 Ships Service Diesel Generator No 3 and No 4 (SSDG)

The OEM for the vessel’s SSDG is Fairbanks Morse Engine (FME) and Breco International.

FME and Breco International can provide OEM parts and services to Alco SSDG’s engines. The proper service of the SSDG is critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another than FME OR Breco International.

SMS number 10.6-002-01-AO lists the ship’s SSDG as critical equipment. The Generator provides 100% of the ship’s electrical power. This power is used to run essential equipment like main engines and all supporting equipment such as central fresh water pumps and main seawater pumps.

Failure of the SSDG would severely impact the mission capability of the ship, and would cause the ship to be unable to perform her mission. Proper refurbishment and maintenance of the SSDG is critical to the mission capability of the USNS JOSHUA HUMPHREYS (T-AO 188).

o. WI 509 Distilling Plants; Replace T-ALT 907

The OEM for the vessel’s new distilling plants is Alpha Laval which has technical representatives to commission new installations and to service their equipment. The OEM provides parts and proprietary technical data/drawings only available from the OEM. This maintains the OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002—01-AO lists the distilling plant as critical equipment. The ship’s distillers produces water for crew consumption and feed water for boiler operations. Failure of the distilling plant will severely impede the ship’s ability to operate at sea. The ship must comply with regulations as required by USCG and ABS. Proper set up and operation of the distilling plant are critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188).

p. WI 510 Lube Oil Purifier Replacement T-ALT 910

The OEM for the vessel’s new Lube Oil Purifiers is GEA Westphalia Separator Group which has technical representatives to commission new installations and to service their equipment. The OEM is required to provide factory authorized parts and proprietary technical data/drawings only available from the OEM. Utilizing the OEM ensures that all warranties will be honored which further ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002—01-AO lists the Lube Oil Purifiers as critical equipment. Purifiers separate water from lube oil used for Mains Engines, SSDGs, and Stern Tube Hydraulic oil.

Failure of the purifiers will severely impede the ship’s ability to operate at sea. The ship must comply with regulations as required by USCG and ABS. Proper set up and operation of the purifiers plant are critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188).

q. WI 512 No. 3 SSDG Turbocharger Overhaul

The OEM for SSDG Turbocharger is Alco Power Inc. which is the OEM licensed/authorized supplier of approved repair parts and services for their equipment. Proper refurbishment and maintenance of the SSDG Turbocharger is critical to the safe operation of the SSDGs onboard USNS JOSHUA HUMPHREYS (T-AO 188). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

Safety Management Systems (SMS) number 10.6-002-01-AO lists the SSDG as critical equipment. The SSDG produces 50 percent of the ship’s power generation and provides power to light off main engine and associated components. Failure of the SSDG will prevent the ship from getting underway and completing mission requirements. Proper refurbishment and maintenance of the SSDG’s Turbocharger is critical to the safe operations of the USNS JOSHUA

r. WI 514 Flexible Coupling Element; Replace

The OEM for the ship’s SSDG is American Vulkan Corporation which is the OEM licensed/authorized supplier of approved repair parts and services for their equipment. Proper refurbishment and maintenance of the SSDG Flexible Coupling is critical to the safe operation of the SSDG’s onboard USNS JOSHUA HUMPHREYS (T-AO 188). Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety

Safety Management Systems (SMS) number 10.6-002-01-AO lists the SSDG as critical equipment. Flexible coupling connects the diesel engine to the generator to produce electricity.

Failure of the SSDG will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the SSDG’s Flexible coupling is critical to the safe operations of the USNS JOSHUA HUMPHREYS (T-AO 188).

s. WI 601, Life Raft Recertification

The OEM for the vessel’s Life Rafts is Elliott. Elliott has numerous authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the Elliott Life Rafts that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the life raft as critical lifesaving equipment. Failure of proper inspection by an authorized USCG facility will severely impede the ship’s ability to get underway and complete mission requirements. Proper maintenance and inspection of the life rafts are critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188).

t. WI 602, Self-Contained Breathing Apparatus (SCBA) Compressor/Refill Station Annual Service

The OEM for the vessel’s SCBA Compressor and Refill Station is MAKO. MAKO has numerous authorized vendors to provide service to their equipment. Vendors are required to provide documentation with a certificate of approved training for the MAKO Model No. 9400E3 Compressor and Model No. M3100 Refill Station units installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized

The vessel’s SCBA Compressor and Refill Station are required to refill expended SCBA bottles used when fighting a shipboard fire or addressing a HAZMAT situation. u. WI 607, Rescue Boat Winch & Davit Inspection

The OEM for the vessel’s Rescue Boat Davits is Palfinger Marine Safety Corp (Palfinger).

Palfinger is the OEM authorized vendor and supplier of approved repair parts and service for the starboard and port davits. Proper refurbishment and maintenance of Rescue Boat Davits is critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188). Factory authorized suppliers provide parts and technical data/drawings from the OEM as required by USCG and ABS regulations. w. WI 611, Self-Contained Breathing Apparatus (SCBA) Equipment Annual Inspection

The SCBA are critical for the crew’s safety when fighting fires. Interspiro is the OEM for SCBA Equipment on the ship. Interspiro has numerous authorized vendors to provide service to their equipment. An authorized vendor is required to provide documentation with a certificate of approved training for the Interspiro breathing air bottles that are installed.

Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the OEM’s authorized vendors. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

MSC does not have the manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. The work items listed in this section require special tools, specialized repair parts, and technical expertise unique to this equipment; only approved OEM parts are authorized to be installed on this highly sophisticated equipment.

Further, OEMs are required to perform service work for MSC vessel critical systems and equipment. The OEM Representative has access to provide parts and technical data / drawings from the OEM, as required to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements.

x. WI 612, Life Boat Replacement

The OEM for the vessel’s Lifeboats is Fassmer International. Fassmer International is the OEM authorized vendor and supplier of approved repair parts and services for their equipment. Proper refurbishment and maintenance of Lifeboats are critical to the safe operation of the USNS JOSHUA HUMPHREYS (T-AO 188). z. WI 902, Marine Growth Inhibitor Anode Replacement

The OEM for the vessel’s Marine Growth Inhibitor is Cathodic Protection Marine. Allied Marine Services, Inc is the US authorized vendor to provide parts and services to their equipment.

Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the Central Fresh Water (CFW) Cooling System as critical equipment. The Marine Growth Inhibitor is an integral part of the CFW system, in that it helps to prevent fouling of the salt water side of the CFW cooler, thereby reducing the cooling capability of the CFW Cooler. Failure of the Fresh Water Cooling System will severely impact the operation of all ship’s auxiliary operating systems; SSDG’s, HVAC, Ship’s Service Air, etc.

Proper refurbishment and maintenance of the Marine Growth Inhibitor is critical to the safe operations of the USNS JOSHUA HUMPHREYS (T-AO 188).

aa. WI 905, Propeller System Maintenance

The OEM for the vessel’s Controllable Reversible Pitch Propeller is Bird Johnson/Rolls Royce Naval Marine. Rolls Royce Naval Marine, as the OEM, is the only authorized vendor to provide parts to their equipment. Factory parts and proprietary technical data/drawings are only available from the original manufacturer. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.

SMS number 10.6-002-01-AO lists the Propulsion CRP System as critical equipment. The CRP system controls the pitch of the variable pitch propellers onboard the USNS JOSHUA HUMPHREYS (T-AO 188) which ultimately controls the vessel’s speed in the forward and aft directions. Failure of the CRP System will severely impact the safe operation of the ship and its ability to move under its own power. Proper refurbishment and maintenance of the CRP System is critical to the safe operations of the USNS JOSHUA HUMPHREYS (T-AO 188).

ab. WI 912, Inspect & Repair Hull Cathodic Protection System

The OEM for the vessel’s Cathodic Protection (CAPAC is a Trade Mark Name for Impressed Current Cathodic Protection ) system is Electro catalytic Inc. The CAPAC system is critical to the vessel as it helps maintain the structural integrity of the hull and hull coating systems. The system is designed to prevent the buildup of growth on the hull that can cause coating system breakdown and hull degradation. The buildup of growth on the hull also effects the ship’s ability to maintain the required speed through the water that is required by the Navy to support the ship’s mission and commitments. Vendor is required to provide documentation with a certificate of approved training for the Electrocatalytic Cathodic Protection System. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer Authorized Vendors.

ac. WI 914, Simplex Stern Tube Seals Maintenance

The OEM for the vessel’s Stern Tube Seal System is Simplex Americas LLC. As the OEM, Simplex Americas LLC is the only authorized vendor to provide parts to their equipment.

SMS number 10.6-002-01-AO lists the Stern Tube Seal System as critical equipment. The Seal System prevents oil escaping into the water onboard the USNS JOSHUA HUMPHREYS (T-AO

188) which ultimately cools the vessels shaft bearing. Failure of the Stern Tube System will severely impact the safe operation of the ship and its ability to move under its own power. Proper refurbishment and maintenance of the Stern Tube Seal System is critical to the safe operations of the USNS JOSHUA HUMPHREYS (T-AO 188).

6. Description of Efforts Made To Solicit Offers from as Many Offerors as Practicable:

The Government intends to post a synopsis and a Request for Proposal (RFP) for the ROH at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm fixed-price contract. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the aforementioned WIs.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the cost to the Government for the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.

8. Market Research: The USNS JOSHUA HUMPHREYS (T-AO 188) is home ported on the East Coast and therefore considered an East Coast asset. All non-emergent vessel repairs are required to be conducted on the East or Gulf Coast. The purpose of market research was to collect historical information from the ship’s last two (2) CONUS availabilities. Purchase Orders N32205-17-C-4004 and N32205-10-C-1001 were the contract numbers identified. In researching this information, it was discovered that the aforementioned acquisitions were solicited and awarded as 100% total small business set-asides under NAICS code 336611 with a standard business size of 1,250 employees.

9. A Listing of the Sources, if any that expressed, in writing, an interest in the Acquisition:

A sources sought notice was posted on 19 June 2018 with a response date of 06 July 2018. A total of one (1) compliant response was received. BAE Systems Norfolk expressed interest, it is considered a large business and has the capability to perform the work. Boston Ship Repair, LLC, and Detyens Shipyards, Inc. both expressed interest via telephonic conversation and are considered small businesses that have the capability to perform the work.

10. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
