QUESTIONS AND ANSWERS (6)
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
1. CLINs 0005 (Base), 0010 (OY1), 0015 (OY2), 0020 (OY3), 0025 (OY4) ask Vendors to price the 3 General Classroom Facilities described in PWS 3.2.1.5 . Can the Government please specify if these General Classrooms must be dedicated solely for MUTC on a full time basis. If not, please clarify the level of availability required.
ANSWER: AMENDMENT 0003 will be issued to amend section 3.2 of the PWS. Please see the amended references of section 3.2. of the PWS copied below in reference to this question.
3.2 Training Classroom and Facilities Support. MUTC may require as a contingency measure additional contractor-furnished training facilities as required for temporary "surge support" for MUTC related training courses. The contractor will receive at least 14 days' advance notice of the requirement, and may anticipate five to seven occasions per year. Currently MSC is not building additional training facilities to support the additional training course we will be adding over the next 1-5 years. CLINs 0005 (Base), 0010 (OY1), 0015 (OY2), 0020 (OY3), 0025 (OY4) will support this requirement and will "not exceed" $150,000 during the base year and each option year. The contractor will be reimbursed for the training facilities when used.
3.2.1 Classroom Requirements. As detailed in the reference Unified Facilities Criteria (UFC)2- 000-05N, Planning Criteria for Navy / Marine Corps Shore Installations (100 Series, Operational and Training Facilities), Chapter 171, buildings being used to deliver instruction are of two (2) types for the courses listed, above. Specifically:
3.2.1.1 An Academic Instruction Building (Category Code 171 10): “This facility provides accommodations for classroom lecture instruction, using chairs with fixed table arms, tables, desks or other similar working surfaces.” This category is applicable to all of the COIs that can be delivered at a contractor-furnished training facility, with the exception of the AMC.
3.2.1.2 An Applied Instruction Building (Category Code 171 20): “This facility is used to accommodate training through the use of equipment and tools, such as drafting tables, workbenches, machinery, equipment or functional systems.” The Ordnance Inventory System – Retail (OIS-R) computers, printers and scanners used to deliver that portion of the AMC that pertains to ordnance inventory management constitutes a “functional system” and therefore falls into this category.
3.2.1.3 General Academic Space: “These classrooms devoted to lecture space are academic instruction classrooms defined under Category Code 171 10. Use Table 17110-1 for space allowances.”
3.2.1.4 Space for Hands-On Mockups: “This space is for a classroom in which instruction is given to individuals or groups of students on stationary training devices representing all or part of an operating system. The size of this type of classroom is generally determined not by the number of students, but by the physical size of the equipment. Figure 17120-1 under Category Code 171 20 provides a formula, which may be used to determine the required net floor space.
3.2.1.5 MUTC may require up to three (3) General Instruction classrooms for temporary surge support.
3.2.1.6 The temporary surge support classrooms will be located in the Hampton Roads area in the vicinity of the Norfolk, VA Naval Base and Joint Expeditionary Base Little Creek.
3.2.2 Support Spaces
3.2.2.1 Student Break Area. Table 171-1 allows a net of six square feet per student in attendance, each day. A 22.4 ft. X 22.4 ft. break area would allow for the installation of vending machines and some table space for students to use when eating lunch. For purposes of surge training support in contractor-furnished temporary surge training facilities, In lieu of separate support spaces or break areas, adequate alternatives may be acceptable. "Adequate alternatives" means contractor-furnished or commercial spaces within a reasonable walking distance of the classrooms and training facility that could provide a functionally equivalent standard for student break areas.
2. ADDING the requirement for letters of intent to Sub-Factor B with less than two weeks to the submission deadline. That was not in the original RFP, and based on those terms and conditions, this sets us back considerably as the incumbent employees whose resumes we do have may be hesitant to sign a letter of intent for fear of reprisal from their current employer. These are unintended consequences of making random "good idea" requirements without walking through the reality of contract transition for these specialty individuals. Additionally, despite requiring letters of intent, 52.212-2 Sub-Factor B does not include Key Personnel letters of intent as a criteria for evaluation.
ANSWER: AMENDMENT 0002 was issued on Friday, 21 April 2017 to extend the response deadline from 1 May to 16 May 2017 to provide adequate time for reviewing changes and submitting proposals.
In accordance with Amendment 0001 Ref. (a)(i)(2) on pg.30, MSC will remove the criterion pertaining to submitting letters of intent for evaluation listed under Sub-Factor B.
3. Removal of the SCA and associated Non-displacement clause put non-incumbents at a huge disadvantage, and provides the current employees with zero wage protection. This is still a services contract (whether acknowledged by FAR Clause or not, it meets the definition, and there are labor categories to cover every position except the PM), and we believe that to comply with the CFR and FAR, we are still obligated to offer employment to the incumbent workforce if awarded the contract - as also stated in PWS 2.1.8.4.1.
ANSWER: AMENDMENT 0003 will be issued to replace wage determination requirements. The intent was to never place non-incumbents at a huge disadvantage.
4. The answer provided for Question 28 (PWS 3.2) does still not clearly articulate the requirement for additional training space. The PWS uses non-specific language for a FFP CLIN - "would request", "as required" - answers to Q27 and Q28 also conflict WRT GFE for a facility. "As required" implies that the government intends to only use and compensate "IF" they "need" the space for "a significant training surge requirement."
There is no data to price this as a FFP CLIN so MSC is essentially limiting competition to those that have excess infrastructure in the local area. Is that really the intention? As such, recommend that this be included as part of the material reimbursable CLIN.
ANSWER: AMENDMENT 0003 will be issued to amend section 3.2 of the PWS.
**Please refer back to the answer section of question 1above ; the amended references
3.2 thru 3.2.2.1 provide clarification regarding the requirement for additional training space, i.e., classrooms. Again, the revision of section 3.2 of the PWS will be indicated on Amendment 0003.
