QUESTIONS AND ANSWERS FOR N00421-13-R-0069
1 AUGUST 2013
Q1: The solicitation cover page, Block 9, shows proposal receipt time of 12:00 AM on 22 August 2013.
The FBO posting shows proposal receipt time of 02:00 PM on 22 August 2013. Request clarification.
A1: The time of receipt of proposals in Block 9 of the solicitation cover page is incorrect. The time on the FBO posting is correct. An amendment will be issued to revise the time on the cover page. The proposal receipt time is 02:00 PM on 22 August 2013.
Q2: We have significant concerns with one of the RFP requirements and evaluation factors. Specifically, Sec M Part B, Workforce Qualifications, Sec L 2.3.3 and Attachment P-1. Those sections require the offerors to list ALL personnel and whether they are “current”, “contingent” or “prospective” hires.
Section I incorporates FAR 52.222-17 which requires the successor contractor to hire or provide right of first refusal to all qualified incumbent personnel and does not allow us to employ others outside that pool until we have satisfied that requirement.
It is unclear how you plan to evaluate Attachment P-1 and the personnel, as only the incumbent has the information on the current workforce and qualifications, and since any successor contractor has to make a good faith effort to hire the same people, what is the purpose of the listing? In addition, we do not have legal grounds to make a contingent offer to another person, when we are bound by the FAR to first offer any position to incumbents.
We would request that you remove the requirement to evaluate all the personnel in positions in the
Attachment P-1. Key management/personnel are not subject to that FAR clause and could be provided.
A2: It is acceptable to propose only Key Personnel positions in the P-1 attachment in light of the requirements of FAR 52.222-17. The RFP will be amended to revise the information requested in the P-1 to only include Key Personnel positions. It is noted, however, that some Key Personnel positions in this requirement are subject to the Service Contract Act. See Section L Paragraphs 2.3.2 (Key Personnel instructions) and 5.6.2 (Notes Key Personnel labor categories).
Q3: Is it acceptable for either of the suppliers listed in Attachment 9 to participate as a subcontractor for the CLS and aircraft maintenance portions of the performance work statement? That is, a supplier listed in Attachment 9 would be excluded from participating in the RDT&E portion of the PWS, but is eligible to participate in the CLS and aircraft maintenance portions.
A3: If a company on the OCI list (Attachment 9) is interested in participating as a subcontractor, offerors must follow the instructions in NAVAIR provision 5252.209-9513(e) in Section L:
(e) Along with responses to this solicitation, offerors must either (1) submit the following information concerning any existing or planned contracts with, or interests in, the suppliers and/or equipment identified above; or (2) state that to the best of the offeror’s knowledge no such interest or contract exists:
(1) a description of the conflict of interest (e.g., weapons systems supplier(s), corporate restructuring, first-tier subcontractor(s)) and identity of parties involved;
(2) a description of the work to be performed;
(3) the dollar amount;
(4) the period of performance; and
(5) a description of the contractor’s internal controls and planned actions, to avoid any potential organizational conflict of interest.
If a contract is planned with a supplier on the Attachment 9 list then the Offeror should check “yes” in the representation in 5252.209-9511, and provide the information listed in items (1)-(5) above.
Q4: With reference to the personnel, are any of the mechanics or support positions covered by a
Collective Bargaining Agreement (CBA)? If so, will a copy of the applicable CBA(s) be provided and can a
Tenure list be provided as well?
A4: None of the positions in this requirement are covered by a Collective Bargaining Agreement.
Q5: PBSOW paragraph 5.3.4.15 refers to Visual identification display system/maintenance action form
(VIDS/MAF) and also notes a NALCOMIS database administrator. Are they using both VIDS/MAF and
OOMA/NALCOMIS.
A5: The contractor will be required to use NALCOMIS/OOMA. As stated in PBSOW paragraph 8.1.2, the contractor will use VIDS/MAF in the event that NALCOMIS/OOMA is unavailable.
Q6: Section L.5.6.2, Labor Hours, CLIN X011 designated the Senior Maintenance Manager as a Key
Person but has no hours allotted until Option Year 2. Is this Correct? Does the Government require a resume for this person even though they have no hours allotted?
A6: It is noted that the Government has a requirement for Senior Maintenance Manager positions in the base year (see Section L, Paragraph 5.6.2, CLIN X001). The Government requires resumes for the Senior
Maintenance Managers being proposed in the base year. Resumes for additional Key Personnel associated with Option CLINs that are not scheduled to begin at contract award will not be required until if/when the Government exercises the options for those requirements and the additions would be handled in accordance with NAVAIR clause 5252.237.9501, Addition or Substitution of Key Personnel
(Services). The RFP will be amended to provide this clarification.
Q7: Section L.5.6.2, Labor Hours, CLIN X002, PHSF Overtime Labor. The Senior Maintenance Manager is allocated 100.0 hours for overtime in the Base and Option Year 1, but this position has no regular hours allotted in those years. Since these hours, when combined, are less than 1920; are the hours expected to be worked outside of normal workdays/hours? Please clarify.
A7: Refer to Section L, Paragraph 5.6.2 Labor Hours, CLIN X001- The Senior Maintenance Manager has hours allotted in CLIN X001 for the base and Option periods 1-4.
Q8: Section L.5.6.2, Labor Hours, CLIN X002, PHSF Overtime Labor. The Senior Maintenance Manager is allocated 125.0 hours for overtime in Option Year 2, but this position has only 960.0 regular hours allotted in Option Year 2. Since these hours, when combined, are less than 1920; are the hours expected to be worked outside of normal workdays/hours? Please clarify.
A8: The overtime hours for the Senior Maintenance Manager in CLIN X002 (Overtime) are based upon estimated overtime required in excess of 40 hours per week.
Q9: On page 98 and 99 of the RFP it states “It is requested that Volume 3 Past Performance information be submitted 14 days prior to the submission date specified in Block 9 of SF 33 of the RFP.” However, on pages 97, 108, and 109 it states that Volume 3 is Corporate Experience and Volume 4 is Past
Performance. Can you please confirm that you do in fact want Volume 4 Past Performance submitted early and not Volume 3 Corporate Experience? Thank you.
A9: The reference to Past Performance as Volume 3 is an error. Volume 4: Past Performance is requested 14 days prior to the proposal due date. Volume 3: Corporate Experience is not requested in advance of the proposal due date. An amendment will be issued to correct the discrepancy.
15 AUGUST 2013
Q10: Please note the formula for the CLIN X002 (Overtime) calculation is formatted for straight time labor calculations. Is it the Government intent to price CLIN X002 (Overtime) using the same pricing methodology as CLINs (X001, X007 – X014).
A10: The formulas embedded in the Attachment P6 CLIN Breakout Spreadsheet may be adjusted if the offeror determines that it is necessary to comply with Section L instructions and applicable labor laws and statutes; for example, to incorporate calculation of overtime premiums required by law.
