About this file

This is a Questions and Answers document for federal contract solicitation N00244-26-R-3016, addressing six inquiries from potential offerors regarding submission requirements and contract terms.

The document clarifies submission requirements for Volume 1, specifying that only the signed page 1 of the SF33 is required rather than the entire 41-page RFP. Regarding Representations and Certifications, offerors may submit SAM.Gov screenshots demonstrating completion status with their Unique Entity ID and expiration date (in this case, 11/18/2026) as an acceptable alternative to a formal certificate of completion. The Government acknowledged that no Key Personnel positions or minimum qualifications were identified in the Performance Work Statement and committed to issuing an amendment shortly to address concerns raised about requiring resumes and Letters of Intent under these circumstances. The document confirms that FAR 52.222-17 (Non-Displacement of Qualified Workers) was removed from the Federal Acquisition Regulation and will not apply to the resulting task order. Two separate concerns regarding whether the resume and Letter of Intent requirements provide the incumbent contractor an unfair competitive advantage in this follow-on service contract subject to Service Contract Labor Standards are both marked for resolution through forthcoming amendments.

Questions and Answers

N00244-26-R-3016

1. It was brought to my attention in Section L, under Specific Instructions for Volume 1, it states that “The offer must include a complete copy of the Solicitation.” Are you requesting the entire RFP of 41 pages or are you referring to only the SF33 and Section B to be completed?

a. The signed copy of page 1 of the SF33 will suffice.

2. For Volume 1: the Reps & Certs, our Company has completed the SAM.Gov reps and certs but never received a certificate of completion. However, we have screen shots from the website (SAM.GOV), showing the entity status with our Unique Entity ID (UEI) and shows that our Reps & Certs have been completed. The Assertions and Reps & Certs need to be updated every year in SAM.GOV. Our last update was on 11/20/2025 and expires 11/18/2026 which also shows on the screen shot. Will this screen shot be acceptable? Please advise when you have a quick moment.

Thank you.

a. As stated in the solicitation, Completed Representations and Certifications of solicitation provisions or certification of completion within the offerors System of Award Management (SAM) profile.

3. The solicitation requires submission of resumes and Letters of Intent; however, no Key Personnel positions or their minimum qualifications are identified in the PWS. Please clarify the Government's basis for requiring resumes and Letters of Intent when no Key Personnel have been designated.

a. An amendment will be issued shortly.

4. Will FAR 52.222-17, Non-Displacement of Qualified Workers, apply to the resulting task order?

a. 52.222-17 was removed from the FAR and will not apply to the resulting task order.

5. Given that this is a follow-on service contract subject to the Service Contract Labor Standards, the requirement for resumes and Letters of Intent appears to provide the incumbent contractor a significant competitive advantage. Will the Government consider removing the resume and Letter of Intent requirements and instead evaluate offerors based on their recruiting, retention, and transition approach?

a. An amendment will be issued shortly.

6. If the Government intends to retain the resume and Letter of Intent requirements, please explain how the Government determined that such requirements are necessary for successful contract performance and do not unduly favor the incumbent contractor.

a. An Amendment will be issued shortly.
