2. The following clause has been incoporated into SECTION I - CONTRACT CLAUSES

The following have been added by full text:

52.209-3 FIRST ARTICLE APPROVAL -- CONTRACTOR TESTING (SEP 1989) - ALTERNATE II (SEP 1989)

[Contracting Officer shall insert details]

(a) The Contractor shall test unit(s) of Lot/Item as specified in this contract. At least calendar days before the beginning of first article tests, the Contractor shall notify the Contracting Officer, in writing, of the time and location of the testing so that the Government may witness the tests.

(b) The Contractor shall submit the first article test report within calendar days from the date of this contract to [insert address of the Government activity to receive the report] marked "FIRST ARTICLE TEST REPORT: Contract No. , Lot/Item No. " Within calendar days after the Government receives the test report, the Contracting Officer shall notify the Contractor, in writing, of the conditional approval, approval, or disapproval of the first article. The notice of conditional approval or approval shall not relieve the Contractor from complying with all requirements of the specifications and all other terms and conditions of this contract. A notice of conditional approval shall state any further action required of the Contractor. A notice of disapproval shall cite reasons for the disapproval.

(c) If the first article is disapproved, the Contractor, upon Government request, shall repeat any or all first article tests. After each request for additional tests, the Contractor shall make any necessary changes, modifications, or repairs to the first article or select another first article for testing. All costs related to these tests are to be borne by the Contractor, including any and all costs for additional tests following a disapproval. The Contractor shall then conduct the tests and deliver another report to the Government under the terms and conditions and within the time specified by the Government. The Government shall take action on this report within the time specified in paragraph

(b) above. The Government reserves the right to require an equitable adjustment of the contract price for any extension of the delivery schedule, or for any additional costs to the Government related to these tests.

(d) If the Contractor fails to deliver any first article report on time, or the Contracting Officer disapproves any first article, the Contractor shall be deemed to have failed to make delivery within the meaning of the Default clause of this contract.

(e) Unless otherwise provided in the contract, and if the approved first article is not consumed or destroyed in testing, the Contractor may deliver the approved first article as part of the contract quantity if it meets all contract requirements for acceptance.

(f) If the Government does not act within the time specified in paragraph (b) or (c) above, the Contracting Officer shall, upon timely written request from the Contractor, equitably adjust under the changes clause of this contract the delivery or performance dates and/or the contract price, and any other contractual term affected by the delay.

(g) Before first article approval, the Contracting Officer may, by written authorization, authorize the Contractor to acquire specific materials or components or to commence production to the extent essential to meet the delivery schedules. Until first article approval is granted, only costs for the first article and costs incurred under this authorization are allocable to this contract for (1) progress payments, or (2) termination settlements if the contract is terminated for the convenience of the Government. If first article tests reveal deviations from contract requirements, the Contractor shall, at the location designated by the Government, make the required changes or replace all items produced under this contract at no change in the contract price.

(h) The Government may waive the requirement for first article approval test where supplies identical or similar to those called for in the schedule have been previously furnished by the offeror/contractor and have been accepted by the Government. The offeror/contractor may request a waiver.

(End of clause)

3. The following language has been added and or revised in SECTION L - INSTRUCTIONS, CONDITIONS

AND NOTICES TO BIDDERS

2.0 NOTICES TO OFFERORS

Each Offeror must (1) submit an offer, (2) submit information that addresses the evaluation factors, and (3) submit supporting price data. The Government will evaluate each Offeror's understanding of the Government's requirements and ability to perform the work on the basis of its proposal. It is the Offeror's responsibility to provide information and evidence that clearly demonstrates its ability to meet the solicitation requirements. Unless otherwise allowed, all questions shall be submitted by 4:30PM EST no later than 10 calendar days before solicitation closing.

4.1.2 Page Limitations

Page limitations are identified for each volume/section of the proposal, as described in paragraph 5.0 below and will be treated as maximums. If exceeded, excess pages will not be read or considered in proposal evaluation. When both sides of a sheet display printed material, it shall be counted as two pages. Graphs, charts, and tables are included in the page count**. The following are not included in the page limitations:

(i) Title/Cover pages

(ii) Tables of contents

(iii) Glossaries of abbreviations and acronyms

(iv) Subcontracting agreements, letters of intent, resumes, and subcontract agreements

(v) Proposal Cross-Reference Tables

**11” x 17” fold-out pages will be permitted and counted as 1-page, ONLY for the depiction of flow charts, facility maps, and schedules for the clarity of the reviewer. Any flow chart, facility map, or schedule that is shown on a 11” x 17” sheet shall utilize the full page and not utilize the extra space for written content that otherwise should be on 8.5” x 11”. In the event that additional space on the larger sheet is used for narrative, it will be counted as 2 pages.

4. The following language has been added in SECTION M - EVALUATION FACTORS FOR AWARD

Factor 3– Price (Volume III)

Although Price is the least important factor, the degree of its importance will increase with the degree of equality of the offers in relation to the other factors on which selection is to be made. Price will be evaluated by the Contracts personnel to determine fairness, completeness and reasonableness through the most appropriate method available in accordance with FAR Part 15.4.

Evaluation will be based on an analysis of an Offeror’s proposed pricing for Mk 187 line items 0002, 1004, and 2004, and Mk 92 line items 1002 and 2002, submitted by the Offeror. The Government will evaluate offers for award purposes by adding together the proposed maximum pricing for the Mk 187 base line item (0002) and all option line items (1004, 2004) and for the Mk 92 option line items (1002, 2002).

5. The following Questions were submitted to the Government as of 6 February 2019, and the Government has provided answers to all.

a. Solicitation N0074-19-R-0100 states that questions concerning the RFP must be received no later than 4:00PM EST 9 March 2019. However, Section L 2.0 states that questions shall be submitted by 4:30PM EST no later than 10 calendar days of solicitation posting, which would be January 27th. Please clarify the deadline for submittal of questions regarding this solicitation.

Answer: The deadline for questions to be submitted is 10 calendar days before the solicitation closes.

Section L 2.0 has been revised.

b. CLINs 1005 - 1008 reference CLIN 0012. CLINs 2005 - 2008 reference CLIN 0020. Neither CLIN 0012 nor CLIN 0020 is included in this RFP. Please clarify.

Answer: The reference to CLIN 0012 should be CLIN 1004. The reference to CLIN 0020 should be CLIN 2004. All affected CLINs have been revised.

c. CLINs 0003 - 0006 and 1005 - 1008 state "If quantity range is 1-999 delivery is 120 days after Mk 187 acceptance." What constitutes Mk 187 acceptance?

Answer: Mk 187 acceptance is constituted as the Government approval of a DD250 after the Contractor has provided all paperwork and testing results to the Government to validate that the Mk 187 Lot meets all requirements of the contract.

d. CLINs 0003 - 0006 and 1005 - 1008 state "If quantity range is 1-999 delivery is 120 days after Mk 187 acceptance." What is the delivery requirement for quantities greater than 999?

Answer: The 120-day requirement was added for the ability of the Government to quickly and easily acquire residual hardware quantities of components not used in the production of the All Up Round Projectiles. If the Government places an order in the second tier of a component, they shall be delivered 180 days after Mk 187 acceptance. If the Government places an order in the third tier of a component, they shall be delivered 365 days after Mk 187 acceptance.

e. CLINS 0003 - 0006; 1005 - 1008; 2005 - 2008 state "Delivery of residual hardware shall be priced at the base quantity unit cost." Is "residual hardware" defined as hardware in excess of the line item delivery quantity that may be available to be placed on order?

Answer: Yes.

f. CLINS 1002 & 0003 reference a base award and base price for MK92, which does not exist. Can this statement be deleted?

Answer: This statement has been removed from CLINs 1002 and 2002.

g. Please verify that the quantity range for CLIN 2005 is correct.

Answer: The Quantity Range for CLIN 2005 (Mk 419 Mod 1 MFF Option Year 2) has been changed to:

1-999 1000-2999 3000-10000

h. What is the award time range for Base year, Option 1, and Option 2?

Answer: Award time range for the Base Year is the Date of Contract award for one year. The award time range for Option Year 1 is the first day after completion of the base year award range for one year. The award time range for Option Year 2 is the first day after completion of the Option Year 1 award range for one year.

i. The statement in Section C 3.3.6 conflicts with the FAR clause 52.209-3(g) in Section I. Can FAR 52.209- 3 Alt II and 52.209-4 Alt II be incorporated into the RFP?

Answer: FAR 52.209-3 Alt II has been incorporated into the solicitation as full text.

j. Government Furnished Material listed in Section C 3.2 is different than the GFM listed in Section H 5252.245-9108. Which list is correct? Will the Inert Boosters be Government furnished?

Answer: Both lists are correct, although what is listed in H 52.245-9108 is a more extensive list. Section C.3.2. lists Government Furnished Material that is required for the packaging of the main deliverable items (Mk 187 and Mk 92) on this contract. In C.3.2. it specifies that this is consumable GFM and not an all-inclusive list. Inert Boosters in support of testing Mk 187 Projectiles and Mk 419 Multi-Function Fuzes will be provided by the Government.

k. Who will conduct Ballistics testing for First Article Testing and Lot Acceptance Testing, the Government or the contractor? It is not stated in SOW.

Answer: It is the responsibility of the Contractor to conduct all testing specified in the SOW. As stated in C.3.1, “The Contractor shall produce all required components, and manufacture, assemble, inspect, test, package, and deliver the items…”. The Contractor may contract a Government Test facility to perform the ballistic evaluation, but it is the responsibility of the Contractor.

l. Is an 11" x 17" fold-out allowed and if used would it count as 1 page or 2 pages?

Answer: The following has been added to Section L para 4.1.2:

11” x 17” fold-out pages will be permitted and counted as 1-page, ONLY for the depiction of flow charts, facility maps, and schedules for the clarity of the reviewer. Any flow chart, facility map, or schedule that is shown on a 11” x 17” sheet shall utilize the full page and not utilize the extra space for written content that otherwise should be on 8.5” x 11”. In the event that additional space on the larger sheet is used for narrative, it will be counted as 2 pages.

m. Please define "projectile" in regard to the 4000 minimum quantity. Does this refer just to MK187 or a combination of MK187 and MK92?

Answer: The 4,000 minimum quantity refers to a combination of Mk 187 and Mk 92 projectiles.

n. Will the Government consider including an Economic Price Adjustment (EPA) clause for steel and copper in the solicitation?

Answer: No.

o. Will the Government consider including a MK 64 Acceptance Inspection Equipment clause in the solicitation?

Answer: See para C.3.7 of the Statement of Work in Section C.

p. As mitigation for potential supply issues for PBXN-9, of which BAE Holston is the only NTIB manufacturer, we would like to request the Navy customer to consider potential alternate sources of supply through Chemring Nobel in Norway and Eurenco Bofors in Sweden. In order to request quotes from these two suppliers, we will need to provide them with MIL-DTL-82875A which contains the technical requirements for the materials. The document is currently Distribution Statement D and we will need concurrence prior to obtaining export approval to share the technical requirements with Chemring Nobel and Eurenco Bofors.

Answer: At this time, this procurement is approved for component sourcing within the NTIB (US and Canada Only). However, if a change is made it will come in the form of an amendment to the solicitation.

q. How does the USG plan to evaluate fairness, completeness, and reasonableness of price? Please elaborate on the statement “through the most appropriate method available in accordance with FAR Part 15.4”?

Answer: Evaluation will be based on an analysis of an Offeror’s proposed pricing for Mk 187 line items 0002, 1004, and 2004, and Mk 92 line items 1002 and 2002, submitted by the Offeror. The Government will evaluate offers for award purposes by adding together the proposed maximum pricing for the Mk 187 base line item (0002) and all option line items (1004, 2004) and for the Mk 92 option line items (1002, 2002). This language has been incorporated into Section M of the solicitation.

r. This question is regarding when in the Mk 64 manufacturing process Ultrasound Testing (UT) is to be performed. Following is contractual language that was incorporated into a prior contract for Mk 64 Projectile Body:

DWG. #8554400 Rev. - Sheets 9 & 10 Ultrasonic Inspection Std. Longitudinal Defects, and Sheet 10 of 10 Ultrasonic Inspection Std. Circumferential Defects:

Note 2 - Material: Standards shall be made from ultrasonically clean production 5 inch body and conform to drawing 6573623 prior to machining the band groove, internal and exterior threads, and forward staking notches. The standards must reflect the petal part configuration that is in production at the time the standards ae used. This may occasionally require the fabrication of new standards.

Note 8 - Variations in material and configuration may be permitted provided they are approved by: NACSURFWARCENDIV, Code R35, Indian Head, MD 20640-5101

This RFP states the following:

Dwg. #8630683 Rev. - Sheets 01 & 02 of 02 Ultrasonic Inspection Std. Mk64 Mod 2 Longitudinal and Circumferential Defects:

Note 1 - Materials - Standards shall be made from ultrasonically clean production 5 inch body and conform to drawing 53711-8605690 prior to machining the band groove, internal and external threads, and forward staking notches. The standards must reflect the petal part configuration that is in production at the time the standards are used. This may occasionally require the fabrication of new standards.

The RFP does not include Note 1 allowing for variation in material and configuration of the standards.

Will the previously approved relocation of the Ultrasonic Test operation and the variation in the standards prior to performing any finish machining of the projectile body be acceptable in the contract resulting from this solicitation?

Answer: The note allowing variations in material and configuration from what’s listed on the drawing is not applicable.

It is advised that if the Offeror would like to vary from the requirements of the RFP it be noted the Offeror’s technical volume response with supporting rationale. After award, any variations to the Technical Data Package may be submitted to the Government for review in the form of an Engineering Change Proposal (ECP) for permanent requests, or Request for Variance (RFV) for temporary requests, after award.

6. All other terms and conditions remain unchanged.

7. For further information regarding this amendment please contact Thomas Howes at thomas.howes1@navy.mil
