SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMENDMENT 02

1) The FBO File Identified as “Attachments 3 to 11:”

a) contains 32 files.

Government Response: Yes. This is correct.

b) File 50623288 and 50623280 seem to be the same item ADL 10001-564220 Rev R. Is this correct? Is there a missing file that should have been provided?

Government Response: Yes. There is not a missing file.

c) Is there a list for all drawings to be provided, beyond Section J HQ J-2-0002, as this does not include all drawings?

Government Response: Section J provides a complete list of drawings associated with the solicitation.

2) WS 35947 references drawings that were not provided. 5871470 and 6214082. If possible please provide them as a separate attachment, as we have already downloaded, changed the file names to match the drawing numbers and began review. If you re-submit a new full folder, we would need to re-start the process to ensure we have the correct drawings, revision levels, and more.

Government response: The PCO will provide an electronic copy of the drawings for all Offerors.

3) In our initial review of WS 18782E we are having difficulty understanding the relevance of this document to M51A4N since the round is injection molded and not painted or marked. Can you clarify what paragraphs are relevant to M51A4N?

Government Response: WS 18782E is the specification for Painting, Marking and Lettering of Naval Gun Ammunition. The scope of the specification describes the requirements for painting, marking and lettering of all Naval ammunition including the M51A4N 20MM Dummy Cartridge with Mark 7 Mod 0 Link. The specification is a second reference for the M51A4N 20MM Dummy Cartridge with Mark 7 Mod 0 Link.

4) DTL-WS-22458A –

a) References 7497064 and 6264393. Please confirm these drawings are not necessary for this solicitation.

Government Response: These drawings are not necessary for this solicitation.

b) Paragraph 4.4.1 requires a minimum lot size of 150,000 links. The base year only contains 120,000 units.

Does the USG expect the contractor to buy additional units at risk? Can this be waived, if it is not possible to piggyback on another lot?

Government Response: The Government does not expect the Offeror to purchase assets at risk. The Offeror may elect to submit an alternative offer, one including a proposal to waive the minimum lot size requirement to support the base year requirement in the solicitation. The Government reserves the right to consider entertaining a follow-on order request after a decision has been made to exercise future contracts and/or option year awards with the same supplier.

c) If the contractor is able to piggyback on another lot – would they be able to have the DCMA & USG ‘buy off’ on the lot based upon a prior FAAT/FAATR by the link manufacturer (assuming it was for identical drawings, ADL, etc)? Even if this was not an item previously supplied for this item? (There are multiple link manufacturers).

Government Response: The Government reserves the right to evaluate future production of link manufacturers after a demonstration has been made that the product conforms to all contract requirements for acceptance. Follow-on order requests will be entertained after acceptance testing has been proven to meet all test requirements for the links manufactured.

d) Can a contractor get confirmation if they would be approved to waive FAT, prior to closing of the solicitation?

Government Response: Waiving FAT will not be considered prior to closing the solicitation.

5) The solicitation references DO-C9 rating. Should this not be DO-A6, as it is “Ammunition,” even though it is Dummy Ammunition?

Government Response: Yes. The rating has been corrected to DO-A6.

6) We cannot find a specific drawing for the Palletization of the ammo cans. Is this missing or is there no drawing and only use the Mil-Spec?

Government Response: See drawing 6214082, Unit Load Construction Guidelines for the M548 Metal Container, called out in response to question 2.

7) We cannot find a specific drawing or drawings to call out all of the required marking requirements on the palletized ammo can – bar codes, etc.

Government’s response: See response to question 3.

8) Drawing 5871720B references several drawings that are not included:

a) Filler Top, 7259015

b) Liner Bottom, 7258966

c) Protector, 7258963

d) Liner, Side, 7258962

e) Filler, long, 11075799 Government’s response: The correct drawing number is 7258961.

f) Liner, end, 7258960 Can these be provided?

Government Response: The PCO will provide an electronic copy of the drawings.

9) Drawing 2923568F – the ADL did not remove List Find note 2- which still references the old drawing and DTL for M51A4N. Can this be removed to prevent confusion or error?

Government Response: The drawing referenced in the ADL is still a requirement for the M51A4N 20MM Dummy Cartridge with Mark 7 Mod 0 Link.

10) The solicitation Line items only allow pricing for 1 First Article. Is it the USG’s intent to re-use this same dollar number for Option 1 & Option 2? Or is there no intent to have a 2nd or 3rd FAT with options or changes of requirements? The 1st FAT could be 1080 days before the 2nd FAT.

Government Response: The Government does not intend to use the FAT cost proposal for Options 1 and 2. FAT shall be calculated based on the impact on costs or time of delivery, risk to the Government for undergoing the test, and the availability of other, less costly, methods of ensuring the desired quantity. FAT costs should be separately priced for Options 1 and 2 and separate CLINs have been added to suuport this. The Government reserves the right to inform Offerors that the FAT requirement may be waived when the product is identical or similar to those called for have been delivered by the Offeror and accepted by the Government when production has not been discontinued for an extended period of time.

11) Solicitation Line item 0001 & Clause 52.209-4 on page 58 – This appears to indicate all 750 FAT rounds go to Dahlgren, Va. How do the 750 rounds align with Table 1 of WS 35947? On prior efforts – 250 were consumed in contractor testing and then 500 were sent to Dahlgren, VA for cycling (following WS 35947). By the information provided, this does not appear to be the plan. Can you please clarify?

Government Response: 500 cartridges are used for the cycling test at NSWC Dahlgren for a total of 750 cartridges for FAT. This quantity is a combined total of the FAT test sample for tests performed at both the Government and Contractor test facilities.

12) Solicitation Section F References “AOE” – what does this term mean?

Government Response: AOE is After Option Exercise.

13) Solicitation Section C – SOW – 2.2.2 & 4.6 – References ISO 9001:2015. Does this mean the contractor is required to be compliant or certified to ISO? How does this apply to sub-tier suppliers? Will DCMA audit to this standard be required of the prime and sub-contractors? If certification is required, is evidence required at time of bid, award or prior to production?

Government Response: ISO9000:2015 is an applicable document in the solicitation. The Government places an emphasis on Offerors maintaining its quality management system to the most up-to-date standards at both its and their sub-contractor facilities to ensure they are ISO 9001:2015 certified with adherence resulting in improved efficiency, communication and implementation of continuous improvement. Subcontractors, as well as prime contractors, must adhere to government-mandated quality standards. The Offeror should provide a systematic approach for evaluation, inspection, testing, calibration or whatever is needed to monitor and assure the quality of your product. And, most importantly, that approach should be documented. The Offeror’ s proposal shall include existing quality assurance system (applicable to contracts for commercial items).

14) Solicitation Section C – SOW – 3.2.2.6 – This requires re-FAT after 90-day lapse. Based upon our experience on same NSN, this is un-realistic/commercial impractical. If the head and stem are made in batches in month 1, then injection molded in month 2, then tested in month 3 and assembled into a finished lot in month 4 the 90 days is already lapsed. Unless the contractor is running all steps at risk, they will exceed 90 days. Can this time frame be extended for this effort?

Government Response: First article testing serves as a manufacturing standard. The acquisition of materials or components, or commencement of production, is normally at the sole risk of the contractor. To minimize this risk, the contracting officer shall provide sufficient time in the delivery schedule for acquisition of materials and components, and for production after receipt of first article approval. When Government requirements preclude this action, the contracting officer may, before approval of the first article, authorize the contractor to acquire specific materials or components or commence production to the extent essential to meet the delivery schedule.

15) Solicitation Section C – SOW –4.4 – POP testing is usually only required for Hazardous Goods per 49 CFR 172.101. The 20mm M51A4N is not Hazardous. This was not required for prior efforts on identical NSN. Is the USG sure they want to add this additional requirement?

Government Response: Yes. POP test certification is required by DOD components to ensure that hazardous materials are in containers that have successfully passed the required test standards according to the mode of transport, physical state of material, packing groups, weight, and container configuration rather than National Stock Numbers (NSN). Periodic testing should be accomplished on packaging configurations in production by DOD activities as required by Title 49 CFR, Section 178.601(e) or the Competent Authority. The M548 metal container is a packaging configuration used for transportation hazardous and non-hazardous 20MM ammunition. POP testing is not required for this solicitation.

16) Solicitation Section C – SOW – 5.3 – In out review of DOD 5100, we do not believe M51A4N is required to have security in transportation. Can you confirm this?

Government Response: DOD 5100.76-M (Physical Security of Sensitive, Conventional Arms, Ammunition, and Explosives) is not necessary for this solicitation.

17) Solicitation Section D – HQ D-2-0003. Does this apply only to the FMS deliveries identified? Is this supposed to go on the M548 can? If so, where? What letter height? What color ink? I assume the information is to be completed, i.e. – Item Description – 20mm M51A4N Dummy Cartridge?

Government Response: This requirement is applicable for the FMS requirements in the solicitation. All markings shall be in accordance with the “Additional Marking for FMS” requirement. Letter height and color on the M548 metal container shall follows WS 18782E, the specification for Painting, Marking and Lettering of Naval Gun Ammunition. This information will also be filled out upon award.

18) Solicitation Section G - G-232-H002 – Within this section the Progress Payments clause is referenced.

Are progress payments applicable to this solicitation? If they are not, can they be added.

Government Response: This is the standard payment clause which lists all payment options. Progress payments will not be applicable to this solicitation.

19) Solicitation Section G -52.209-3 – part (d) – this appears to indicate if FAT is not complete with 270 days the contract is terminated. There is significant USG involvement in the approval of numerous documents (Procedures, Quality Inspections, FAT Plan, etc.) to get to FAT and get FATR Approved, how does a contractor address excessive USG paperwork delays and delays in approvals of documents?

Government Response: CDRL A001, the First Article Test Plan and CDRL A002, First Article Test Report, shall describe the Government’s response and approval time for each contract deliverable to ensure it satisfies the terms defined in the contract or in the requirements definition or other project documentation. Should the Government’s review process impact the quality, performance or functionality of the artifacts being impaired or cause a delay of a contractual requirement; the Government shall consider granting an extension for the submission with a modification to the contract.

20) Solicitation Section L Page 105 references NSWC IHEODTD Form 146. This is not attached. (Also mentioned again on page 116).

Government Response: Form 146 is added as Attachment 12.

21) Solicitation Section L page 108 references a Past Performance Matrix in Section J. There does not seem to be anything mentioned in section J, nor is any Matrix attached.

Government Response: The past performance questionnaire and matrix are added as Attachments 13 and 14.

22) Solicitation Section L page 109 references Volume III and Price with instructions to fill in prices in section B of executed solicitation. However, page 105 mentions excel spreadsheets.

a) Are the Excel Spreadsheets optional?

Government Response: The proposal format is described in Section L, paragraph 3 to help ensure Offeror’ s comply with all page, font, binding pagination and printing requirements. Paragraph 3.5, Price Information describes the format for the Price Proposal.

b) Are we to place pricing at CLINS or sub-CLINS?

Government Response: CLIN structured pricing is described in the proposal. Each subCLIN should have a price.

23) Solicitation Section L page 110 – Mid page this appears to jump back to Clauses from Section H or I from here to page 115. Should this be moved to preserve contract integrity?

Government Response: Section L clauses are not to be removed from the solicitation.

24) Solicitation Section M page 116 – 1. references 4 option years. I believe this is incorrect.

Government Response: This has been corrected to state 2 option years.

25) Solicitation Section L page 120 – Bottom of page this appears to jump back to Clauses from Section H or I from here to page 122. Should this be moved to preserve contract integrity?

Government Response: Section M clauses are not to be removed from the solicitation.

26) CDRL A016 – Indicated that there will be a Post Award Conference. We do not see any other reference to Post Award Conference in the solicitation. Please Clarify.

Government Response: The post award is described in Section 4.9 of the SOW of the solicitation.

27) CDRL A015 – Requires a monthly report for GFM. Since the only GFM is the pallets, which should be a 1-time event with base award, option 1 and option 2 is the monthly report necessary? Even for the Base award there should only be +/- 50-55 pallets. This seems excessive considering the circumstances.

Government Response: GFM has been described as MK3 Metal pallets and MK7 Link Gages. A GFM Consumption report is required for the contract.

28) CDRL A015 – Since the base contract is only requiring +/- 50-55 pallets, can this GFM element be removed? The price of these is only around $125 to 150 each. This is a total cost of $8,250 (55x$150) on the high side. With the numerous GFM requirements MAST and the USG will spend far more than $8000. On a prior effort getting the GFM took months. We could have what we need on our door in days. In addition, it would remove 2 CDRL’s.

Government Response: CDRL A015 shall not be removed from the solicitation. The Offeror shall be responsible for notifying the Government of any items that are to be requested to fill contractual requirements will be so requested in a timely manner to minimize the use of emergency priorities. All incoming items furnished by the Government will be checked to verify contractual authorization

29) A number of documents are still unavailable. Our document control department has requested these and this is just a follow-up to see if you can kindly check on the status of that request?

Government Response: All contractors that have requested explict access have been granted access.

30) Test system at Dahlgren -will the contractor bear those costs for FAT and LAT cycle testing conducted at Dahlgren? We are operating under the assumption that we should price in freight to transport the rounds to Dahlgren but need clarification on how to handle the costs of the testing.

We have found that if the USG requires in the contract for the testing to be performed at Dahlgren that the costs are easier to get approved as well. The alternative supplier for this testing does not have tool use permission.

Government Response: Respectfully request bids to the solicitation include acceptance testing and transportation costs in your submission.

31) Can you kindly confirm the quantity on page 5 of the SOW is part of the base award and not

Option 1?

Government Response: Yes.

32) Please confirm it is acceptable to offer NTE for the Option periods.

Government Response: Yes.

33) Will the government have furnished material or property for this contract?

Government Response: Yes. GFM will be comprised of MK3 Metal Pallets and MK7 Link Gages. Please reference Government Furnished Material (GFM) and Government Furnished Equipment (GFE) in paragraph 4.8 of the solicitation; and the AIE Design and Government Furnished Equipment (GFE) in paragraph 3.4.4 and the GFP attachment.

34) Could we offer an alternate schedule for early delivery including the options quantity (leveraging 48 CFR 52.207-4 Economic Purchase Quantity - Supplies) which could give the USG an option for a lower price?

Government Response: Yes.

35) Is a separate FAT required for Mark 7 Mod 0 links?

Government Response: Yes. Please reference page 2 of the solicitation, the Statement of Work, and the applicable document DTL WS22458A – Item Specification for Link, Cartridge, 20MM, MK 7 MOD 1 for a description of the FAT requirement.

36) Is a separate FAT required for the M548 Ammo Can?

Government Response: First article testing serves as a manufacturing standard. FAT is dependent on the source of supply the contractor chooses to use. If a FAT has been previously conducted on another government contract, a FAT for the M548 Ammo Can may not be necessary. The PCO may request a FAT for the M548 Ammo Can if (a) the contractor has not previously furnished the product to the Government; (b) The contractor previously furnished the product to the Government, but (1) There have been subsequent changes in processes or specifications; (2) Production has been discontinued for an extended period of time; or (3) The product acquired under a previous contract developed a problem during its life. The FAT is described by a performance specification.

37) The solicitation is FOB destination. For FMS shipments what shipping costs are applicable to the contractor?

Government Response: The contractor shall pay and bear the freight charges and owns the goods while they are in transit to the FMS location.

38) If option 0004 is awarded will it be both 0004AA and 0004AB or can it be just one of them?

Government Response: Yes, as separately priced subCLINS, one can be exercised and another not exercised.

39) CDRL A008 is for a POP test report. Since this item is inert is POP testing required?

Government Response: The solicitation will be corrected. POP testing is not required for this contract.

40) Are the transportation security requirements of paragraph 5.3 applicable to the shipment of the

20mm Dummy? If so what sensitivity category applies to the item Government Response: The solicitation will be corrected. Transportation security requirements are not required for this contract.

41) Are RFID tags required for the pallets?

Government Response: RFID tags are not required for the MK3 Metal Pallets.

42) Section B Item 007 includes a note regarding “Item Identification and Valuation”? We do not see this for the other CLINs. Is this an error?

Government Response: This is a DFARs clause for items which the Government’s unit acquisition cost is less than $5,000 that are identified in the original part, lot, or batch number, subassemblies, components, and parts embedded within delivered items, and items with warranty requirements as referenced in MIL-STD-130. Please reference page 76 of the solicitation.

43) Clause 252.211-7003 ITEM UNIQUE IDENTIFICATION AND VALUATION (MAR 2016) is included in the solicitation but the 20mm Dummy Cartridge is not listed in paragraph (ii). Are Unique Item Identifiers required for the 20mm Dummy Cartridge? Do the rounds need to be serialized?

Government Response: Yes. 20MM Dummy Cartridges shall be identified by lot number for the end item, its sub-components and packaging materials. Please reference MIL-STD-1168, applicable document standard listed on page 10 of the solicitation.

44) The Statement of Work Paragraph 3.2 references Quality Assurance Provisions(QAP). Is there a

QAP for this item?

Government Response: There is no requirement for Quality Assurance Provisions (QAP) with this contract.

45) DTL-WS-35947 Paragraph 4.2.1 identifies the items to be submitted to the government for First

Article Testing. These are 770 20mm Dummy Cartridges (not 750) and also 150 Head-Stem Assemblies. It appears that the government will be performing the FAT tests. Please clarify which of the FAT and LAT tests and inspections are to be performed by the contractor and which are to be performed by the government.

Government Response: Contractor FAT and LAT tests and inspections are listed in Statement of Work (SOW) starting on page 11 of the solicitation. Tables for specified testing is also listed in the DTL WS35947 – Item

Specification for the Cartridge, 20MM Plastic Dummy, M51A4N and DTL WS22458A – Item Specification for Link, Cartridge, 20MM, MK 7 MOD 1.

46) DTL-WS-35947 identifies a minimum lot size of 25,000 rounds. Is this applicable to the present procurement?

Government Response: Yes, this is correct.

47) Will progress payments be allowed?

Government Response: Progress payments will not be applicable to the current solicitation.
