SECTION SF 30 BLOCK 14 CONTINUATION PAGE

The following items are applicable to this modification:

SUMMARY OF CHANGES

The purpose of this amendment is to extend the closing date of the solicitation, incorporate attachments to the solicitation, and answer questions from potential offerors.

1. The closing date of the solicitation is hereby extended as follows:

From: 07 March 2014, 3:00 PM

To: 17 March 2014, 4:00 PM

*The submission deadline was inadvertently listed as 03 March 2014 on the SF33 when the solicitation was released. It should have been listed as 07 March 2014 as shown in the FedBizOpps system at the time of release.

2. Important Information for All Offerors

The following questions were posed to NSWC-IHEODTD Contracts Department. The answers are provided here for use by all offerors in the preparation of proposals for solicitation N00174-14-R-0005.

Q1: Please provide the contract number and prime contractor for the predecessor of this contract. If there is none, request the government provide the contract number(s) under which these services have been performed in the past.

A1: This is a first-time procurement for NSWC IHEODTD and there is no incumbent for this requirement.

Q2: The SF-33 requires offerors to submit an original and two copies of their offer. RFP paragraph L.3.1.1 requires offerors to submit four copies of the technical volume, two copies of the past performance volume, and two copies of the cost volume. Request the government clarify the requirement for the submission of originals and numbers of copies of each volume.

A2: The SF-33 is revised to reflect the following: Offerors are to submit an original and four copies of their offer. RFP paragraph L.3.1.1 requires offerors to submit four copies of the technical volume, two copies of the past performance volume, and two copies of the cost volume.

Q3: RFP clause HQ C-2-0014 refers to solicitation N00174-13-R-0044. As this clause results in a contractual agreement between the contractor and the government, request that it be updated to reflect solicitation N00174-14-R-0005.

A3: Clause HQ C-2-0014 has been updated to reflect solicitation N00174-14-R-0005.

Q4: RFP paragraphs C.3.2.6.1 requires all contractor employees to obtain and maintain a minimum security clearance level of Secret. Not all personnel supporting this contract will require clearances, for example, contractor production personnel fabricating material in support of shipboard installations.

Recommend the government revise this requirement to read “Contractor employees working in a government facility, aboard ships, or assigned to a task order that specifically requires a clearance, must obtain and maintain a minimum security clearance level of Secret.”

A4: 3.2.6.1 Personnel Security. Contractor employees shall be a U.S. Citizen. There will be times when contractor employees will be assigned tasking in areas where "Sensitive information or equipment" will be.

These employees shall possess and maintain a security clearance of the appropriate level to work in these areas on this Contract.

Q5: RFP paragraph 3.2.5 specifies that a full list of potential HAZMAT materials is provided in attachment

B (found on page 20 of the RFP). Attachment B was truncated during production of the RFP. Request the government provide a complete copy of attachment B.

A5: Attachment B was provided as an attachment to the solicitation and can be found on FedBizOpps.

Q6: RFP Section K, page 89 addresses the Facility Security Clearance requirement. The level of security to be specified in subparagraph (a) is blank. Request the government identify whether or not there is a facility clearance requirement.

A6: The facility clearance requirement should be as required for handling material at the "Classified" level.

At no time will any secret material related to this contract be in possession of the contractor. The contractor shall have accommodations for storage of small amounts of "Classified Material" on a temporary basis.

Q7: RFP paragraph 5.0, Sub-Factor 5 (page 119) requires offerors to demonstrate in their safety plan how they will comply with all applicable requirements of Naval Facilities Expeditionary Logistics Center instructions, policies, procedures, and guidance. Request the government provide copies of the Naval

Facilities Expeditionary Logistics Center safety manual and all applicable instructions, policies, procedures, and guidance.

A7: A copy of the Naval Facilities Expeditionary Logistics Center safety manual can be found at http://www.navfac.navy.mil/products_and_services/sf/products_and_services/construction/safety_shack/co ntr_safety_resources.html.

Q8: Section I of the RFP incorporates, by reference, FAR 52.222-20, Walsh-Healy Public Contracts Act, and FAR 52.222-41, Service Contract Act of 1965. These requirements are contradictory in that Walsh-

Healy specifies that employees cannot be paid less than minimum wage while the Service Contract Act

(SCA) specifies that employees (defined as service employees) cannot be paid less than wages and fringe benefits determined by the Secretary of Labor. As SCA requirements are discussed in detail throughout the

RFP it is clear that the government intends that the contract be compliant with the SCA. Request the government delete FAR 52.222-20 from Section I.

A8: Clause 52.222-20 is hereby removed from the subject requirement.

Q9: Section I of the RFP incorporates, by reference, FAR 52.222-20, Walsh-Healy Public Contracts Act, and FAR 52.222-41, Service Contract Act of 1965. Request the government specify which CLINs are subject to the Service Contract Act and which are subject to the Walsh-Healy Public Contracts Act.

A9: Clause 52.222-20 is hereby removed from the subject requirement. Clause 52.222-41 will apply to

CLINs 0001, 0005, and 0009.

Q10: Request the government provide Department of Labor Wage Determinations applicable to all locations specified in the RFP, Picatinny, NJ; Norfolk, VA, Jacksonville, FL; San Diego, CA; Pearl Harbor, HI; and Bremerton, WA; and any other CONUS locations the government anticipates work will be performed.

A10: Wage Determinations for all locations specified above will be uploaded as attachments to

FedBizOpps.

Q11: On page 124, the RFP specifies that “composite rates are required for any labor category under each type of services category in which more than one individual is proposed.” On page 127 the RFP specifies that offerors are instructed not to use composite rates for the labor categories; the cost proposal should reflect actual rates.” Request the government resolve this contradiction.

A11: Information on page 127 is correct. Offerors are instructed not to use composite rates for the labor categories; the cost proposal should reflect actual rates.

Q12: Page 125 discusses “Other Direct Costs” and specifies that the offeror is to include “material” costs and “supplies” costs. Request the government provide definitions that distinguish “material” from

“supplies.”

A12: Material is directly related to the accomplishment of the tasking (ie. Metal for fabrication of foundations, copper or fiber optic cable installed between two pieces of equipment) Supplies are items indirectly related (ie. Office supplies, tarps, tools) and are non-fee bearing

Q13: In the middle of page 128 the RFP states “All ODCs are non-fee bearing.” This contradicts the statement on page 125 that specifies that fee is allowable for material costs. Request the government resolve this contradiction.

A13: Fee is not allowable for material costs. Information on page 125 is hereby revised to reflect that.

Q14: Table 2 on page 128 lists the other direct costs for supplies/materials as not to exceed $1,381,296.00 for the base and each option year. This far exceeds the value listed in CLINs 0002, 0006, and 0010.

Request the government clarify the amounts to be included in Table 2 and CLINs 0002, 0006, and 0010 for supplies/materials.

A14: Table 2 has been revised to match the amounts listed in CLINs 0002, 0006, and 0010.

Q15: CLINs 0003, 0007, and 0011 are firm fixed price CLINs for “Supplies” related to installation hull specific items considered non-ODC material items required for installation services to support the Close-In

Weapon Systems (CIWS). Request the government provide a more detailed description of the “supplies” that are included in these CLINs and whether or not these costs are fee bearing.

A15: Material is directly related to the accomplishment of the tasking (ie. Metal for fabrication of foundations, copper or fiber optic cable installed between two pieces of equipment) Supplies are items

Q16: CLINs 0003, 0007, and 0011 are provided for “supplies” considered “non-ODC.” CLINs 0002, 0006, and 0010 are provided for ODC, including “supplies.” Request the government provide definitions that distinguish “ODC supplies” from “non-ODC supplies.”

A16: Material is directly related to the accomplishment of the tasking (ie. Metal for fabrication of foundations, copper or fiber optic cable installed between two pieces of equipment) Supplies are items

Q17: Worksheet “Analysis” of the Attachment 7, Cost Summary Format, refers to the maximum allowable pass through/fee of the SEAPORTe contract in row 22 and row 27, respectively. As this is not a

SEAPORTe task order, is the offeror constrained to a pass through or fee rate of 8%? Recommend all references to SEAPORTe and MAC task orders be removed.

A17: All references to SeaPort-e and MAC task orders have been removed from the Cost Summary Format and a revised copy has been uploaded to FedBizOpps.

Q18: Worksheet “Analysis” of the Attachment 7, Cost Summary Format, includes the following note beginning in row 29 of the worksheet: “When analyzing pass through costs, the government will consider prime offeror fee on subcontractor and consultant price as an element of pass through as explained in the

Section H Savings Clause of the MACs.” This note is included at the bottom of each succeeding worksheet. As this contract is not related to a MAC-type contract, is this note applicable to this solicitation?

A18: This note is not applicable to this solicitation and it will be removed. A revised copy of the Cost

Summary Format will be uploaded as an attachment to FedBizzOpps.

Q19: As discussed on page 119 of the RFP, offerors and subcontractors are required to submit past performance information on relevant contracts that were performed in the last five years. The Past

Performance Matrix (Attachment J.2) specifies that “only past performance references within the last three years of the date of the solicitation issuance will be considered compliant with the solicitation instructions.”

Request the government resolve this contradiction.

A19: Offerors and subcontractors are required to submit past performance information on relevant contracts that were performed in the last three years. The information on page 119 will be revised to reflect this language.

Q20: SF33, Paragraph 9 states indicates proposals are 4:00PM EST, 3 Mar 2014. The due date posted on

FedBizOps is 3:00PM EST, 7 Mar 2014. Please clarify.

A20: As stated above proposals are now due no later than 17 March 2014, 4:00 PM.

Q21: Section L – 3.1.1, page 114 provides instructions for numbers of copies but does not indicate whether these are to be hardcopies or electronic format (e.g., CDs). Section L, paragraph 4.1, page 115 provides format instructions including paper size. It goes on to provide file names and states “The Offeror shall submit the following information in hard copy only to:” but does not list what is to be provided. Please clarify whether proposals are to be submitted as hardcopy, electronic or both.

A21: The offeror shall submit both hard copies and electronic copies of the proposal.

Q22: Section C, Paragraph 3.2.3.1. (I, j, and k), page 16 identifies the requirements for Electrical, Cooling, and Dry air. Please provide specific requirements.

A22: Electrical: 1) 440 VAC, 3 Phase, 60 Hz, 100 AMP Type I Primary Power. 2) 120 VAC, Single Phase

60 Hz, 20 AMP, 8 outlets. Cooling: 1)Chilled water at 5.5 to 7 GPM, >30 PSI, <75 PSI at an adjustable temperature. 2)HVAC @ 300 cu. ft./min, 50 degrees F to 80 degrees F Dry Air: Nitrogen. Nitrogen (FED

SPEC BB-N-411,Type 1, Class 1, Grade B or Commercial SpecificationA-A-59503, Class 1, Type 1, Grade B) shall be supplied in shatterproof cylinders (FED SPEC RR-C-901) having a filled pressure of

1800 lbs/in2

Q23: Section C, paragraph 3.2.6, page 17 indicates a minimum security clearance level of SECRET for all contractor employees. Additionally, section L , paragraph 4.2, requires affirmative statement in cover letter relative to employees possessing SECRET clearance. However, much of the Government site work being performed under this PWS will be accomplished by tradesmen in non-restricted areas on non-classified equipment and all logistic/administrative work accomplished at contractor’s facilities will be unclassified.

1) Will the Government allow the use of non-cleared US citizens for industrial work in non-restricted areas at Government sites?

2) Will the Government waive the SECRET clearance requirement for logistical/administrative support personnel working at the contractor’s site?

A23: 1) Yes. The Government will allow the use of non-cleared US citizens for industrial work in non-restricted areas at Government sites.

2) Yes. As long as the support personnel are not handling any related "Classified Material", the

Government will waive the SECRET clearance requirement for logistical/administrative support personnel working at the contractor’s site.

Q24: Section K, Facility Security Clearance, paragraph (a), page 89. The required facility security clearance level is blank. Please clarify.

A24: Please see response to Question 23.

Q25: Section L.5.0, Volume II: Past Performance (Factor 2), page 119 provides for listing up to seven relevant contracts for Offeror and each subcontractor. The matrix to be used provides minimal space for offeror to provide work description and relevancy. Section L 5.0, Volume I Technical, Sub-Factor 2:

Corporate Relevant Experience, page 118 has a page limitation of five pages. Please consider increasing

Sub-Factor 2 page limitation to 10 pages in order to allow sufficient space to provide details on relevant experience related to past performance contracts being used for evaluating past performance.

A25: Sub-Factor 2 page limitation is hereby increased to 10 pages and will be reflected in Section L of the solicitation.

Q26: Section L – 4.1.2 (iv), “subcontract plan” is listed as not included in the page limitations. However, on Page 140, Volume IV – Individual Small Business Subcontracting Plan Goals, a 10-page limit is given.

Is there a page limit for the FAR 52.219-9 compliant subcontracting plan?

A26: “Subcontract plan” has been removed from the list of sections with page limitations in Section L of the solicitation.

Q27: Section M, paragraph 4 under the General heading, page 134 includes four subfactors are under

Factor 1 - Technical. Subfactor 5 is not included. Please clarify.

A27: Section M is hereby revised to reflect Subfactor 5 under Factor 1 – Technical.

Q28: Key personnel requirements for Field Service Engineer require an engineering degree + 5 years of experience. However, the position description lists duties normally accomplished by an onsite lead installer. Typically, these individuals are not degreed professionals but rather are supervisory technicians that possess 10 years or more shipboard installation experience. Will the Government consider allowing 10 years shipboard installation experience, with a minimum 5 years leading major shipboard electronic systems installation, 2 -3 years of which are directly related to CIWS installations in lieu of degree requirements?

A28: Yes. The Government will consider allowing 10 years shipboard installation experience, with a minimum 5 years leading major shipboard electronic systems installation, 2 -3 years of which are directly related to CIWS installations in lieu of degree requirements.

Q29: The cost template (CIWS_-_CSF) has been annotated in a manner that does not permit the Prime to enter total Subcontractor cost but rather appears to require the Prime to enter the Subcontractors direct and indirect costs separately to derive the total. Most subcontractors will not be willing to disclose proprietary cost detail. Can the Prime be allowed to enter the total subcontractor cost in lieu of individual cost elements?

A29: Yes. The Prime may enter the total subcontractor cost in lieu of individual cost elements.

Q30: The Solicitation Section L, page 120, states Offerors shall only provide information for the columns entitled “Element/Category” and “Proposed”. The Solicitation Section L, page 126, states Offeror is to copy all formulas used in the preparation of its cost proposal into columns that the Offeror shall label

“DCAA” and “Government Cost Realism”. Can the Government please clarify if the Offeror is only to provide information in the columns stated on page 120 or if the Offeror is also to provide the information and additional columns stated on page 126?

A30: Last paragraph on current page 126 “Offeror is to copy all formulas…” is hereby removed.

Q31: The Solicitation Section L, page 126, states Offeror is to copy all formulas used in the preparation of its cost proposal into columns that the Offeror shall label “DCAA” and “Government Cost Realism”. This requirement appears to duplicate information presented in the spreadsheets from the calculations already provided. Can this requirement be removed?

A31: Yes this requirement can be removed. Last paragraph on current page 126 “Offeror is to copy all formulas…” is hereby removed.

Q32: The Solicitation Section L, page 126, states Offeror is to copy all formulas used in the preparation of its cost proposal into columns that the Offeror shall label “DCAA” and “Government Cost Realism”. If this requirement will not be removed can the Government please clarify by example what is meant to be displayed by copying and pasting the formulas?

A32: Last paragraph on current page 126 “Offeror is to copy all formulas…” is hereby removed.

Q33: The Solicitation SOW paragraph 3.2.3.1 states that the contractor shall provide shore facilities for the duration of the required maintenance, installation and/or repairs. Can the Government please provide a schedule (actual or notional) for the purpose of pricing the facilities requirement?

A33: As this is a first time buy for NSWC-IHEODTD Contracts Department, we currently do not have historical information available to provide to offerors with regards to a schecule for pricing the facilities requirement. We will contact our technical POCs to see if they can provide this information to us. Should we obtain an estimated schedule, the Government will distribute this information to potential offerors via amendment to the solicitation.

Q34: The Solicitation, Section I, page 71 invokes clause 52.222-2 Payment for Overtime Premiums which states the use of overtime is authorized if the overtime premium cost does not exceed zero or the overtime premium is paid for work --. Given that no overtime premium factor has been provided is it expected that work will be executed with straight time only?

A34: Anything over $0 you cannot do unless you get PCO approval. Overtime is not authorized unless reviewed by COR and approved by PCO.

Q35: An understanding of the intent for the Individual Small Business Subcontracting Plan. Volume IV is called out in the RFP but not part of the “Instructions for Submission of Offers”. Is it intended that the

Individual Small Business Subcontracting Plan be a separate volume (Vol. IV) or included as part of

Volume III?

A35: The Individual Small Business Subcontracting Plan is to be included in Volume IV.

NOTE: ALL VENDOR QUESTIONS MUST BE SUBMITTED NO LATER THAN 10 MARCH, 2014,

4:00PM. NO QUESTIONS WILL BE ACCEPTED AFTER THIS DATE.

The following SF33 changes are hereby made as follows:

SECTION A - SOLICITATION/CONTRACT FORM
