Part I: The following Vendor Questions/Clarifications ‘Q’ have been submitted. The Government Response ‘R’ follows each question/clarification. These questions/clarifications and responses in this section are provided for informational purposes only; neither the questions nor the responses set forth below amend the terms and conditions of the Request for Proposal (RFP) unless stated below.
Q.1 - Ref. Q&A # 10 - Missing Parts on Receipt (Ref. Question and Response # 10 from Amendment 0002 of RFP N00104-18-R-G005)
a. In past experience supporting this workload, the Contractor has received Repairable Parts (CLINs) in an incomplete configuration (missing parts)
b. The Government is contracting for the repair of a specific part number(s). These part number(s) are based on a specific part configuration. The Government should bear the responsibility of ensuring it sends the part(s) in the correct and complete configuration.
c. If this burden is shifted to the Offeror and the Offeror is supposed to include the potential cost of replacing material that may be missing; the Offeror, at best can only guess what part are may be missing and what the occurrence rate will be.
d. Pricing is based on historical repair data when processing a part received in its proper configuration.
e. If the Offeror is forced to factor in the possibility of having to pay for missing parts, the Navy will simply be paying for this risk in a higher price than what is necessary.
f. The Offeror requests the Government reconsider their position; if a part arrives in an incomplete configuration (missing parts) one or more of the following will occur to rectify the problem:
i. Contractor will return the bad part and the Government will issue a replacement part
ii. Contractor will submit an O&A proposal to cover the cost of replacing the missing parts
iii. the Government send the missing parts as Government Furnished Material (GFM) ASAP
g. In support of this workload, prior to the release of the RFP; if parts were missing, the Contractor would send the Navy an estimate to replace the missing parts and the estimate would be funded by the Navy.
R.1 – If a unit is received that is missing major component parts, the contractor is not responsible for replacing those parts, however, the contractor is responsible for replacing consumable parts that are missing from an asset.
The definition of a consumable part is a component to be replaced in a routine maintenance exercise in accordance with the manufacturer's requirements.
The following language regarding Missing on Induction (MOI) material is hereby included as SECTION C.2.2.4 in the Statement of Work, SECTION C.2.
C.2.2.4. MISSING ON INDUCTION (MOI).
Scope. A Weapons Repairable Assembly is subject to this MOI provision if the item received by the Contractor for repair is missing one or more Shop Repairable Assembly (SRA) and the SRA is not a separately inducted item. Contractor replacement of MOI SRAs is not included in the contract price.
Items received by the Contractor missing consumable parts are not MOI items. Rather, repair of such items and replacement of the missing consumable parts are included in the contract price and the item shall be inducted and repaired by the Contractor.
Procedures. The Contractor shall immediately notify DCMA when an item is received with MOI SRA(s) and shall obtain written verification from DCMA for all WRAs determined to have MOI SRA(s). The Contractor shall provide written notice of all such determinations, including identification of the missing SRA(s), and the DCMA written verification, to the IM with a copy to the PCO and ACO prior to induction and/or repair of the WRA. The Contractor shall not proceed with repair of WRAs with MOI SRAs until instructions on how to proceed are provided to the Contractor.
SEE PART 2 – Changes to the RFP, Change 1, included in this amendment.
Q.2 –Parts with Shipping Damage.
a. What happens if a part(s) is received damaged due to shipping?
b. Normally, if a part is received damaged, the Contractor will notify the Government and await disposition instructions from the Government. The Government will send the Contractor a replacement repairable part.
R.2. – Parts received with shipping damage will be evaluated on a case-by-case basis.
The following language regarding Shipping Damage is hereby included in Section C2. - Statement of Work as Section C.2.2.5 Shipping Damage.
Scope. Assets received with shipping damage will be evaluated on a case-by-case basis to determine the extent of damage to the asset and if it can be repaired within the firm fixed price quoted or if the unit is damaged to the extent it is beyond repair.
Procedures. The Contractor shall immediately notify DCMA when an item is received with apparent shipping damage and shall obtain written verification from DCMA that the item appears to have been damaged during shipment. The Contractor shall provide written notice of all such determinations, including identification of the damaged unit and the DCMA written verification, to the IM with a copy to the PCO and ACO prior to induction and/or repair of the damaged unit. The Contractor shall not proceed with repair of damaged units until instructions on how to proceed are provided to the Contractor.
SEE PART 2 – Changes to the RFP, Change 1 included in this amendment.
Q.3. - BER Parts
a. Will the Government please add the BER Clause added into the RFQ?
b. Typically there is a BER clause that allows us to deem parts BER if the price to overhaul is greater than seventy percent (70%) of the new market price.
R.3. –There is No Beyond Economical Repair material in firm fixed price contracts; the contractor agrees to repair all assets to the firm fixed price provided. All material sent to the contractor is considered repairable unless the unit is Beyond Physical Repair.
Paragraphs 2 and 3 are hereby added to Section C2. - Statement of Work, Section C.2.2.2. - BEYOND ECONOMICAL REPAIR (BER) and BEYOND PHYSICAL REPAIR (BPR)
Scope: An item is BR when the item is not capable of being repaired in accordance with the Statement of Work due to the extent of physical damage.
Procedures. The Contractor shall obtain written concurrence from DCMA for all units determined by the Contractor to be BR. All such determinations, including the basis for the determination and the DCMA written concurrence shall be provided by the Contractor to the PCO, with a copy to the Inventory Manager (IM). After receipt of the required documentation, the PCO shall provide the Contractor disposition instructions. If provided disposition instructions, the contractor shall submit a proposal for BR pricing to the PCO within 30 days of receipt of these instructions. Any disposal ordered shall be performed by the Contractor in accordance with all applicable regulations and the Contractor’s approved Government property disposal procedures.
SEE PART 2 – Changes to the RFP, Change 1, included in this amendment.
