2. No additional questions will be accepted after April 10, 2013.

QUESTION AND ANSWER:

The following questions and the Navy's answers are hereby provided. Some of the answers include changes to the solicitation:

Question 43: Page 3- Question 8 and Answer 8- SECTION F- DELIVERIES OR PERFORMANCE

Upon review of the question 8 and answer 8 pertaining to the delivery performance clarification as outlined in Amendment 0002 (pages 2-3), we require further explanation and clarification on this matter as the potential requirement for industry to deliver up to a quantity of 653 units in 90 days is not realistic. This delivery would require vendors to order materials and manufacture the product in advance of notification of award at full risk to the vendor and at increased cost to the program.

Cleary this cannot be the expectation of the government and yet the language as it stands would demand that this type of extreme risk be taken.

It would be extremely difficult for us to commit to the delivery requirement as currently stated.

We agree with the position put forth in the original question and request that a realistic, not to exceed, monthly quantity delivery range be established and to begin a certain number of days after receipt of contract and delivery order.

Answer 43: FAR clause 52.211-8 -Time of delivery on page 19 of the solicitation is replaced with the following:

The following applies to Clin 0001

52.211-8 --Time of Delivery (Jun 1997)

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor's date of receipt of the contract or notice of award by adding

(1) Five calendar days for delivery of the award through the ordinary mails, or

(2) One working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) Question 44: Page 5- C.4.3.11.1 Craft Accessories References: a. Soliciation section C, Paragraph C.r.e.e.10, Roll-Up floor

b. Amendment 0009, Answer to Qestion 13, new Section C.r.3.11.1

The Solicitation Paragraph C.4.3.3.10, Roll-Up floor, requires a roll-up floor that attaches to the transom and thrust board. Further this paragraph specifies that the roll-up floor shall be contstructed to prevent chafing against the hull and any inflatable section, plus shall be able to operate with the 55-HP outboard engine. The answer to question 13 in Amendment 0009 changes Paragraph C.4.3.11.1 of the CRRC solicitation to now require that the Craft Accessories include "one (1) fabric covered aluminum slatted roll up floor."

Amendment 0009 appears to make a significant change to the Roll-up floor specification by requiring it to be constructed of "fabric covered aluminum." In addition, this appears to step away from a performance based specification, keeping in mind that a vendor's COTS product may use a material other than aluminum with proven performance experience and meeting the requirements of C.4.3.3.1 0. Is it the government's intent to specify that the roll-up floor be constructed of "fabric covered aluminum"?

N00104-12-R-L001, Amendment 0013 Page 14 of 18

Answer 44: Please review section C.5.3.1.1 on page 14 of the solicitation. Section C.4.3.11, Craft Accessories, in Answer 13 on page five of Amendment 0009 is replaced by the following:

C.4.3.11 Craft Accessories

C.4.3.11.1 The Bare craft manufactured for delivery to the Government is required to include the following accessories: one( 1) each commercial technical manual, attachment straps to secure all removable accessories, and one ( 1) bag for the storage and transportation of the boat when in its rolled up position. Question 45: Bellows- Berry amendment

Questions 28 and 38 in Amendments 0009 and 0011 to the solicitation address concerns regarding the Berry Amendment and in particular the Bellows which is to be supplied with the boats. As noted in the questions, the bellows contains a fabric component. The bellows is not physically attached t the boat. It is a separate part used for manual inflation of the boat when necessary. It can be purchased separately from the boat as a spare part. Alone, it may not be classified as a textile item inasmuch as the fabric portion of the bellows is not the main portion of the overall bellows.

Your agency replied in response to Question 38 that it is " ... not aware of any problems locating Berry compliant foot pumps ... "

This is to inquire whether your agency considers the bellows to be a textile item subject to the Berry Amendment. If your agency does consider the bellows to be a Berry Amendment covered textile item, since your agency has indicated that there is no problem locating Berry compliant foot pumps, we request that your agency advise from what source they might be obtained.

Alternatively, if your agency does not consider the bellows to be a Berry Amendment covered textile item for the purposes of this procurement, we request that you likewise advise of that circumstance.

Answer 45: Yes, it is subject to the Berry Amendment. However, please see Section C.4.3.11, Craft Accessories in answer 43 above.
