T-ARC(X) Q&A 21 AUG Batch 3 Solicitation N00024-20-R-2211 - T-ARC(X) Industry Studies Bidder's Q&A
21 AUG 2020
| Solicitation Section | Question | Draft Response | |
| 41 | In response to Question 7, the Government concurred that the T-ARC(X) vessel is an auxiliary ship and “falls under Commerce Control List (CCL) Export Control Category Number 8A609 so the technical data is subject to the Export Administration Regulations. The Bureau of Industry and Security in the Dept. of Commerce, not the Defense or Navy Department, is responsible for the export license process. BIS makes the call on categorization of exported items and the export license requirements (if any), and is the final authority when it comes to export licenses so we recommend that you contact them directly to make sure you are complying with those regulations.” |
| However, in response to Questions 5, 19, and 25, the Government indicated that Contractors should be prepared to have an approved Technical Assistance Agreement (TAA) in place upon award to share any of the J-1 documentation with foreign teammates. TAAs are only available for documentation that is subject to the ITAR; TAAs are not available for documentation that is EAR. Are the references to a TAA in error? | Responses to previous questions 5, 19, and 25 incorrectly referenced Technical Assistance Agreements (TAAs); as the ship is considered an auxiliary ship, it is our opinion that technical data is subject to the Export Administration Regulations and export authorization is required in accordance with those regulations. | |
| 42 | The Distribution Statement on J-1 provides: “DISTRIBUTION STATEMENT D: Distribution authorized to the Department of Defense and DOD Contractors only (Critical Technology, 11 Jun 2020). Other requests for this document shall be referred to PEO Ships (PMS325).” |
Question Number 2 asked: “For Attachment J-1, please clarify if additional authorization from PMS 325 is required to release this document to entities that are already covered via an approved Export License issued by the Department of Commerce as a subcontractor to a DoD Contractor?” The Government responded “No, Department of Commerce makes the final determination on export licenses for T-ARC(X) with input from PMS325.”
| If the authorization to export is by exemption, such as a via License Exception Strategic Trade Agreement (STA) (15 CFR 740.20), is additional authorization from PMS 325 required to release this document to entities that qualify to receive this information under such exemption? | The Bureau of Industry and Security in the Dept. of Commerce, not the Defense or Navy Department, is responsible for the export license process. We recommend that you contact them directly for guidance. | |
| 43 | RFP Statement: L.1.2.6. Cover Pages, Title Pages, Table of Contents, Executive Summaries, Lists of Illustrations, Lists of Tables, Tab Pages, Appendices, Glossaries, and Indices will not be included in the total page count. Additionally, teaming agreements, Key Personnel resumes (2 pages per resume), drawings, schedules and assertions of Technical Data Rights, will not be included in the total page count. |
Will the Government consider revising the RFP section to state: Additionally, teaming agreements, Key Personnel resumes (2 pages per resume), drawings, schedules, Organizational Charts, build strategies, launch plans, facility and labor capacity Sandcharts, Yard Layout Depictions, past performance items 1) through 7) and assertions of Technical Data Rights, will not be included in the total page count.
| No. The Governement will not revise the total page limits established in the solicitation. Build strategies and yard layouts are considered drawings for proposal purposes and therefore not included in the page count. Organizational charts, facility and labor capacity sandcharts, and past performance items 1-7 will be included in the page count; tables may be used to present information. | |
| 44 | The Government's response to contractor question 39 confirmed that IS Contractors are expected to submit Intact and Damage Stability calculations (DID A022) to ABS for preliminary review. Appendix D of the J-1 System Specification establishes damage stability criteria different from those invoked by ABS MVR for a vessel of this type. |
| Does the Government envision Contractors performing damage stability analysis to ABS MVR requirements, in addition to those in J-1 Appendix D? | Yes. Contractors are required to perform damage stability analysis required by ABS MVR in addition to those in J-1 Appendix D. | |
| 45 | The Government's response to contractor question 39 confirmed that IS Contractors are expected to submit Intact and Damage Stability calculations (DID A022) to ABS for preliminary review. Appendix D of the J-1 System Specification establishes damage stability criteria different from those invoked by ABS MVR for a vessel of this type. |
Does the Government envision ABS reviewing the damage stability calculations for compliance with J-1 Appendix D, with MVR, or with both?
| Yes, the Government anticipates ABS reviewing the damage stability calculations for compliance with J-1 Appendix D and the MVR. Section 3.4.4.5 of the SOW requires that contractors submit the Intact and Damage Stability Report, DI-A022, to ABS for review and the DI requires that ABS preliminary review be incorporated into the final submittal. | ||
| 46 | Two CDEs shall be provided. Each CDE shall have an overall diameter of at least 4.6 meters. It is our understanding that the largest self fleeting CDE to date is 4.0 meters. Please confirm that 4.6m drum diameter requirement is correct. | Yes, the 4.6 m drum diameter requirement is correct. |
| 47 | The response to Question 40 indicates that the Government considers T-ARC(X) to be subject to EAR but not ITAR. Will the Government then revise the Distribution Statement on the J-1, which is currently marked as DOD Distro D, to permit release of controlled information to non-U.S companies only if holding an approved export license under the Export Administration Regulations (EAR)? |
Alternatively, will the PMS 325 provide a letter upon request for authorizing Contractor to release the J-1 to specified non-U.S. subcontractor(s) subject to export control under the EAR?
| An updated Attachment J-1, appropriately marked for export, will be provided at contract award. | |
| 48 | The notional schedule in C.3.2.3 Table 1 shows the fourth design review (DR) being held in month 12, and Note 1 states this is the latest date an event may be scheduled. |
Section L.1.4.1.4.2.i states "Industry Studies must be completed within 12 months after start."
Block 6 of DI A037 requires the final submission of the Design Summary Report 30 days after the final scheduled DR. If the DR is allowed to be in month 12 as shown in C.3.2.3 Table 1, this final submission could conceivably be as late as 12 months and 30 days after start.
| Should bidders consider the 12 month deadline in Section L.1.4.1.4.2.i as being measured to the fourth DR, in which case the resubmission of DI A037 is excluded, or to the final submission of DI A037, in which case the DR may need to be earlier than month 12 and/or the resubmittal must be sooner than 30 days after the DR? | Bidders should consider the 12 month deadline in Section L.1.4.1.4.2.i as being measured to the final submission of DI A037, in which case the DR may need to be earlier than month 12 and/or the resubmittal must be sooner than 30 days after the DR. The Government will consider changes to the submittal schedule after contract award. | ||
| 49 | The resume attachment specifies that it is also acting as an employment agreement along with a salary commitment. Please elaborate as to the reasoning on having the salary and employment agreement on the resume attachment, and if this section may be removed. | Details of the salary and employment agreement are not required, the statement is intended to certify that the subject personnel is employed as described. | |
| 50 | Can all attachments be appended at the end of each volume to minimize confusion? | Yes, all attachments may be appended at the end of each volume or provided as separate documents, as submissions are electronic only. | |
| 51 | The requirement for all recipients of Government Information to accept unlimited liability through the indemnification terms of the T-ARC(X) Use and Non-Disclosure Agreement is a concern for potential supply chain participants both large and small. This limits our ability to share such information and obtain qualified quotes from suppliers of critical program services. We request that this requirement be removed from the NDA. | The Government has included standard terms and conditions in the T-ARC(X) Use and Non-Disclosure Agreement and does not intend to revise such terms at this time. |
