143-144 L/Attachments/IMPORTANT The referenced section/paragraph includes the following:

"The Offeror (and any subcontractors performing SECRET-level work shall not be:

· Under a special security agreement"

The beta.sam.gov posting states that “Prime contractors interested in bidding under any subsequent solicitation must be able to receive classified documents up to the SECRET level and must be a United States (U.S.) company or an independent U.S. subsidiary. Offerors must be a United States (U.S.) company or an independent U.S. subsidiary…”

These statements seem contradictory as a Special Security Agreement (SSA) is what ensures the independence of U.S. companies that are also U.S.

subsidiaries. Please confirm that companies under a SSA are able to compete under this solicitation.

Offerors under a special security agreement are able to compete for this solicitation. Solicitation will be amended to remove bullet point "Under a special security agreement". Amendment to the solicitation is forth coming.

L / 3.6.3 The fee restrictions specified for Section B Pricing are unreasonably more restrictive than the statutory limitations imposed by 10 U.S.C. 2306(d) and 41 U.S.C. 3905. FAR 15.404-4(a)(2) recognizes that it is in the Government’s interest to offer contractors opportunities for financial rewards sufficient to stimulate efficient contract performance, attract the best capabilities, and maintain a viable industrial base.

The Government appreciates the feedback received however, the requirements remain unchanged.

L / 2.1 Proposal Structure, Format and Proposal Page Counts

Given current guidance from CDC and Government authorities for social distancing and safe material handling, will the Government rescind the requirement for 1 original and 2 hard copies of an Offeror's proposal? Producing hard copies requires handling by numerous employees during the printing, assembly, checking, packing and shipping of those copies. Allowing purely electronic delivery provides Offeror(s) additional flexibility to observe CDC and other government guidance to businesses to maximize working from home. While producing DVDs requires less interaction than paper hard copies, multiple employees are still involved in burning, checking and packing the physical DVDs.

Amendment 0001 of the solicitation updates Section L proposal submission requirements.

F - Deliveries or Performance

Delivery dates specified in Section F appear predicated on a base contract award no later than 11/30/20. If for any reason, the contract award is delayed past this date, can we assume Section F delivery dates will be accordingly adjusted?

The stated notional contract award date of November 30, 2020 is solely for the purpose of preparing the IMS. It is incorrect for offerors to assume that the notional date has any impact on the stated Section F dates.

Attachment-8 PCR outlines the requirements for the replacement transmitter. If there are any specific questions regarding a specific requirement the Government encourages offerors to re-engage through bidders questions if the offeror believes Attachment-8 PCR does not provide the requested information.

Are dimensions measured on a unit by unit basis, or a cumulative area/volume. For example, if a design can save 1Ft2/5ft3 on the Power amplifier (MK177) could that be applied to controller cabinet (MK32) or other unit of the transmitter group?

Attachment-8 PCR outlines the requirements for the replacement transmitter. If there are any specific questions regarding a specific requirement the Government encourages offerors to re-engage through bidders questions if the offeror believes Attachment-8 PCR does not provide the requested information.

electronic/digital signatures to include hallmarks that verify the identity of the person making the mark and a “present intention to authenticate the writing”, such as evidence of an individual’s full name, personal key, certificate, time and date stamp, etc. If planning to use an electronic/digital signature to support proposal requirements, offerors are encouraged to engage in further question/answer with the Government, before the deadline for receipt of proposals, to determine if the Government concludes that the components of the electronic/digital signature are acceptable.

F - Deliveries or Performance and L -paragraph 3.6.2 Cover Letter

We acknowledge per prior question answered that the stated notional contract award date of November 30, 2020 is solely for the purpose of preparing the IMS. This draws attention to the prescribed validity of the proposal per Section L, para. 3.6.2, which is 360 days following the due date for receipt of proposals. The current due date of August 31, 2020 requires that we assume the award could occur as late as August 26, 2021, resulting in an approximate 4 month period of performance for the execution of CLIN 0001 and since the CLIN 0002 no later than award date is 31 Aug 2021, this would causing significant overlap between the design and build phase of the EDM increasing risk due to schedule constraints with work being performed in parallel that should properly be serially performed.
