CLIN Ceiling

Hour

Distribution

The directed labor hours provided by the Navy in Section B of this Request for Proposal are disproportionate to the hours identified in the first LCS PY Request for Proposal (N00024-

13-R-4304. Will the Navy confirm the accuracy of the directed labor hours and reconsider the distribution across the CLINs?

The Government has updated the direct labor hours as reflected in the attached amendment.

002 Sec. L (1.4)

p. 207-208

Proposal

Delivery Date RFP states: “Proposals are due at 14:00 Eastern Standard Time (EST) on Thursday, 23

August 2018.”

Offeror requests that the LCS RFP proposal submittal due date be changed from

8/23/18 to 9/28/18 for the following reasons:

1. The Pre-Solicitation issued 5/2/18 on FEDBIZ states “It is anticipated that the solicitation will be available on the FedBizOpps website at www.fbo.gov in Q3 FY18 and will be open for a minimum of 45 business days.” However, the proposal is now due on 8/23/18 and is only 30 days vice the 45 days indicated in the Pre- Solicitation.

2. The RFP has noted missing data that once received will be scoped, estimated and factored into the proposal. A separate Bidder’s Question requesting the specific data will be submitted via separate correspondence.

3. Section 4.1.4 requires a Transition Plan be developed. This Transition Plan requires a current state assessment of the incumbent based on publically disclosed information.

This assessment process will require additional time in order to provide a comprehensive scope and estimate.

4. This is a large and complicated RFP that necessities extensive coordination and integration of functional organizations and subcontractor scope throughout the Technical

Volume and Cost Volume and additional time is required to ensure completeness and compliance.

Thus, in order to ensure that a compliant and competitive offer is provided, Offeror requests that the proposal due date be extended to 9/28/18.

The Government will revise the due date from 23 Aug 2018 to

05 Sep 2018.

Attachment 1 Classification Attachment 1 DD254 is marked as secret and classified. Was this the Government’s intention?

The draft DD254 was erroneously marked as Secret

(Classified). No classified material was included in the DD254.

A revised DD254 will be included after contract award.

Section H

Clause

5252.216-9122

LEVEL OF

EFFORT

CLAUSE

(DEC 2000),

p. 157-160.

Level of

Effort

“The Contractor agrees to provide the total level of effort specified in the next sentence in performance of the work described in Sections B and C of this contract. The total level of effort for the performance of this contract shall be (See column B in the table below) total man-hours of direct labor, including subcontractor direct labor for those subcontractors specifically identified in the Contractor's proposal as having hours included in the proposed level of effort.”

Based on the wide range of OEMs associated with the LCS ship class, it will be extremely difficult to ensure that all possible subcontractors required to perform the contract scope of work are identified in the proposal. As such, it is recommended that language be added to all

Level Of Effort CLINs which allows for unforeseen subcontractor usage upon approval of the Contracting Officer. Would the Navy be amenable to adding a clause similar to the following to the Planning Yard contract?

The Government will allow for the inclusion of all man-hours incurred by Contractor and its subcontractors at any tier in determining allowable earned fee in accordance with the special contract requirement entitled “LEVEL OF EFFORT”, whether or not the subcontractors were identified in Contractor’s proposal at time of award, provided that the Contractor submits to the Contracting Officer details regarding the technical scope to be performed by the subcontractor(s) and the basic details of the subcontract(s) arrangement (including cost/price and fee/profit) with the Contractor. The Contracting Officer’s expressed permission is required in writing before any man-hours incurred by a subcontractor that was not identified in Contractor’s proposal at time of contract award will be included in determining the total allowable earned profit under the LOE clause.

The Government will not revise the language or add a clause.
