SUMMARY OF CHANGES

QUESTION 1

QUESTION The solicitation N00024-17-R-2201 mentions on the web that it is a total small business but I did not see this in the enclosure. Is this solicitation open for “All” or restricted to “Small Business concerns”?

ANSWER FAR 52.219-6, Notice of Total Small Business Set-Aside, is incorporated by reference in FAR 52.212-5 in Section I of the request for proposal (RFP). Section L.1 (a) (1) of the RFP also states, “In accordance with FAR 52.219-6, Notice of Total Small Business Set- Aside, this solicitation is a 100% small business set-aside. The NAICS code is 336612.

The small business size standard is 1000. Offers are only solicited from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected”.

QUESTION 2

QUESTION Normally when a government solicitation identifies a specific brand name for a major component of the overall vessel there is a justification posted with it. There is no sole source justification posted that shows why Caterpillar is the only brand listed. Please advise the justification used for this solicitation. If you will accept an alternative diesel engine where we can define the advantages of using an alternative diesel engine over the Caterpillar product, will you send out an amendment stating that?

ANSWER A brand name justification was posted with N00024-17-R-2201 on FedBizOpps when it was issued. The Attachment is titled "N00024_21084_FBP.pdf", and the description states, "Redacted J&A - Brand Name Justification". The justification used for this solicitation can be seen in the Attachment. An amendment will not be issued stating that an alternative diesel engine will be accepted based on the justification to accept only Caterpillar brand name in the RFP.

QUESTION 3

QUESTION In order to comply with Export Control regulations, we would need to know the end destination and user of the vessel to determine if we would need to get a specific license or technical assistance agreement (TAA) from the State Department to sell and service product into that country. I understand that as a FMS project this is not a requirement for you; however, once the FMS project is over (normally at the end of the vessel warranty period) and your office no longer oversees the vessel, these TAAs or licenses may be required to send technicians on to the end user's naval base to service the equipment.

This is not unique to one engine manufacturer; any US engine manufacturer is subject to the same US laws and regulations.

ANSWER 1) Per Section C, Statement of Work, in the event that the Government places an order for an NCPV that requests that the vendor transport the NCPV to FMS Customer(s)/Partner Nation(s) it will inform the Contractor of which FMS or partner nations the articles shall be delivered to.

2) The Government also intends to outline in Section B of all delivery orders which FMS Customer(s)/Partner Nation(s) the NCPV will be for.

N00024-17-R-2201

QUESTION 4

QUESTION In the solicitation N00024-17-R-2201, Section L, item (15) indicates, “All questions regarding to the RFP must be submitted twenty (20) business days prior to the closing date of the RFP.” With an RFP closing date of 14 November 2016, 20 business days would be today (14 October 2016). Was it the Navy’s intention to give one day after the release of the solicitation to ask questions?

ANSWER No, it was not the Navy’s intention to give one day after the release of the solicitation to ask questions. Twenty (20) business days was erroneously stated. This amendment (N00024-17-R-2201 0001) has updated the last date to receive Offerors’ questions to 1400 EST 24 October 2016.

QUESTION 5

QUESTION Would NAVSEA SEA 02 accept competitive quotes for brand name other than Caterpillar for the Marine diesel propulsion and genset units in accordance with point 7 of J&A 21,084 to compare and determine fair and reasonable costs?

ANSWER In accordance with the justification provided in J&A 21,084 and the RFP, the only brand name that will be accepted is Caterpillar for the diesel engines and generator sets. As provided in point 7 of J&A 21,084, “the Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the brand name J&A will be fair and reasonable.” Further, with regard to the NCPV competition “the NCPV contract award will be based on competition; therefore, the prices of the diesel engines, generator sets, and RIB outboard motors contributing to the total price are expected to be determined fair and reasonable based on adequate price competition”.

The diesel engines and generator sets are part of the total price of the NCPV competition being conducted.

SECTION L: INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS
