JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Southwest Regional Maintenance Center, San Diego
2. Description of the Action Being Approved.
Award of a sole source contract action to add one (1) New Work Item to an Firm Fixed Price
Contract awarded to BAE Systems San Diego Ship Repair (BAE SDSR) on 09 November 2016 under contract N00024-17-C-4414 for USS NEW ORLEANS (LPD-18) Fiscal Year 2017 (FY17) Dry-
Docking Selected Restricted Availability (DSRA) to procure supplies and services described below. Authority to act under this class justification expires on 1 February 2017.
3. Description of Supplies/Services.
Supplies/Services Estimated Value Funding
ShipAlt LPD17-86669K, CIDS 23TV $50,000 CLIN: 0004, ACRN: AC (FY17 NAVSEA)
Upgrade to V5.1 Windows 10 Installation, (AIT) Support Service
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)
(1), only one responsible source and no other supplies and services will satisfy agency requirements, as implemented by FAR 6.302-1 (b) (1)(i).
5. Rationale Justifying Use of Cited Statutory Authority.
There is only one responsible source and no other supplies or services will satisfy this Agency’s requirements because the ship will be in BAE SDSR’s facility within this maintenance availability.
BAE SDSR is the only source that can provide the necessary support services to the AIT in order to accomplish the work. AIT support services to be provided by BAE SDSR include, but are not limited to, welding, crane, rigging and staging. Award to any other source would result in substantial duplication of costs to the Government that cannot be recovered through competition and will cause unacceptable delays in fulfilling the Agency’s requirements.
Bringing another contractor into BAE SDSR’s facility during this availability is not a viable
SWRMC, San Diego options since it would be disruptive and interfere with other work going on throughout the ship.
This ship alteration must be completed within the window of maintenance period for the USS
NEW ORLEANS (LPD 18) and the work cannot be deferred to a subsequent availability due to substantial impact on the ship’s operational readiness.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
The original contract was placed under a competitively awarded Coast-Wide Bid in which BAE
SDSR was awarded based on Lowest Price Technically Acceptable (LPTA) criteria. The full installation of the CIDS 23TV Upgrade to V5.1 Windows 10 alteration was inadvertently included in the original specification package as Basic Work Item (BWI) 433-90-001. The
Requiring Activity had requested only AIT support services before contract award. The
Requiring Activity arranged to bring in an AIT for this BWI to mitigate schedule and cost risks associated with performing the entire installation as a first-time install by BAE SDSR. The original scope of work for full installation has been changed to AIT support services only in a new work item. It is in the best interest of the Government to award this requirement to BAE
SDSR.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, SWRMC has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, SWRMC will assess whether competition for future requirements is feasible.
