Question 3: If the solicitation comes out as an SDVOSB set aside, our understanding is that mulitple SDVOSB companies can partner to cover 51% of the work in order to meet the requirements. If that is true, must all SDVOSB companies who make up the 51% Footprint be SEAPORT E Primes? What level of SEAPORT enrollment is required in order for an SDVOSB to help comprise a 51% SDVOSB work force that could qualify meet the requirments of and SDVOSB Set Aside solicitation?

Response Date: 9/29/2010 3:07 PM

Answer: Before we determine if we will be setting this requirement aside for any small business category we will be posting a Sources Sought Notice and evaluating the responses. As discussed at the Industry Day for a HubZone or SDVOSB set aside a prime contractor of these types can team with other of their approved subs or teaming partners of these types to meet the 51% requirement. This can be found in Federal Acquisition Regulation (FAR) Subpart 9.6-Contractor Team Arrangement, FAR Subpart 19.13-Historically Underutilized Business Zone (HUBZone) Programs, FAR Subpart 19.14-Service-Disabled Veteran-Owned Small Business Procurement Program and FAR Clause 52.219-14 Limitations on Subcontracting.
