The form applies to all state-funded and state-directed public construction programs, projects, and purchases in Rhode Island. The proposal deadline for MPA 439 is April 16, 2026, at 9:00 a.m.
The acknowledgment form requires prime contractors to confirm five key compliance obligations: acknowledgment of the state's MBE/WBE inclusion requirements; submission of executed agreements with all subcontractors used to achieve participation goals; monthly reporting and documentation to the MBE Compliance Office verifying payments to MBE subcontractors; immediate notification of all changes in vendors, subcontractors, suppliers, and Change Orders; and understanding that non-compliance may result in a determination of Non-Compliance with sanctions pursuant to state law. Contractors must indicate their business certification status as MBE, WBE, VBE, or Not Applicable, and an authorized signatory must initial each acknowledgment section and sign the form under penalty of perjury.
