About this file
This is a contract terms document for the Maine Military Authority (MMA), outlining the terms and conditions for a one-year procurement contract for lead-acid batteries to support vehicle and equipment refurbishment and maintenance operations. The contract term is one year, with provisions allowing the State Purchasing Director to extend the contract period beyond the indicated expiration date with contractor consent. Delivery orders will be transmitted via email to the vendor's primary contact, with each order containing a distinct order number and specified delivery date; MMA reserves the right to release multiple orders simultaneously with different delivery dates and will only accept shipments up to two weeks in advance of stated delivery dates without prior approval.
Bid prices must be net F.O.B. destination with all transportation and delivery charges fully prepaid by the contractor, and prices will remain fixed throughout the contract period unless periodic price changes are agreed to in writing. The State of Maine reserves the right to pay through multiple methods including check, electronic funds transfer, and procurement card; however, state statute prohibits sellers from imposing surcharges on credit or debit card purchases. Orders not delivered as scheduled are subject to modification or cancellation at MMA's discretion. The State Purchasing Director maintains the right to cancel the contract with thirty days' written notice.
