Alternate Prime Vendor Medical Supplies Contract

Questions and Answers

Q1. Must it be a brand name equipment?

A1. The items on the Sample Procurement List included as Attachment 2 to the solicitation do not need to be brand name; however, they must match the required salient characteristics, as indicated by the provided National Stock Numbers (NSNs). That being said, individual delivery orders could include brand name-specific items. Each order will specify which items must be brand name, and which items must only meet the required salient characteristics.

Q2. Will the Government please provide the current contract number providing these contemplated services?

A2. This solicitation is for the acquisition of supplies, not services. The previous contracts, expired 22 March 2021, were M67854-16-D-5014, -5015, and -5016.

Q3. Will the Government please provide the current pricing under the current contract serving these contemplated services for Base and Option years?

A3. For the previous supply contracts, each delivery order was competed among the awardees of the base contracts using the lowest-price technically acceptable source selection process, and pricing was determined at award. The same will be true for any contracts awarded through this solicitation.

Q4. Are you all looking for pricing right now or proposals from vendors looking to be added?

A4. We are looking for proposals meeting the requirements listed in FAR 52.212-1 (and addendum) of solicitation M67854-21-R-5110. For price analysis purposes, we are requiring that offerors provide pricing on the Sample Procurement List of 34 items that was included as Attachment 2 to the solicitation.

Q5. Will we be asked to assemble multiple items into one kit, or will we ship items separately as requested in the PO?

A5. Items can be shipped separately. Some items may be kits, but awardees should not be required to assemble items into kits unless they are the manufacturers of those items.

Q6. Are there any incumbents for this engagement? Are there any solicitations with incumbents that are similar to this engagement?

A6. Yes. See A2.

Q7. Please define covered telecommunications equipment. On the acquisitions.gov site—4.2101 Definitions—covered telecommunications equipment includes equipment made by Huawei Technologies Company or ZTE Corporation or surveillance equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company. For this solicitation, should we assume that covered telecommunications equipment includes all telecommunications equipment made in China?

A7. In accordance with FAR 52.204-24(a), “covered telecommunications equipment or services” has the meaning provided in FAR 52.204-25, which is the same as the definition provided at FAR 4.2101. FAR 52.204-25(a) states the following:

Covered telecommunications equipment or services means—

(1) Telecommunications equipment produced by Huawei Technologies

Company or ZTE Corporation (or any subsidiary or affiliate of such entities);

(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);

(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or

(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Q8. Is there a required form or preferred format for acknowledging the amendments or can we develop our own?

A8. According to the addendum to FAR 52.212-1 under number 16, the Business Volume shall include one signed and completed copy of the Standard Form (SF) 1449, acknowledging any solicitation amendments and signed by a person authorized to enter into the proposed contract on behalf of the offeror. An authorized signature on the amended SF 1449 will suffice as acknowledgement of any amendments.

Q9. Is there a required form or preferred format for discussing past performance or can we develop our own?

A9. As stated in the addendum to FAR 52.212-2, in accordance with FAR 15.101-2(b)(1) and 15.304(c)(3)(iii), past performance will not be evaluated as an individual factor for this solicitation. Given that award will be made to the lowest price, technically acceptable offeror and since the Contracting Officer will consider past performance as part of the required responsibility determination for each awardee, the Government will not utilize a separate evaluation factor for past performance.

Q10. How many past performance contracts should we include?

A10. See A9.

Q11. Can you give examples of occasions when product samples are required?

A11. Product samples are not required for this solicitation.

Q12. Is there a preferred platform used for transferring barcode information? Will we need to send it by email, drop box, secured email?

A12. There is no preferred platform for transferring barcode information. Per section 5.1.3 of the Statement of Work (SOW), awardees shall affix barcode technology onto every shipment delivered. The information contained within these barcodes shall be in line with the preservation, packing, packaging, labeling, and marking instructions found in section 4.2.2 of the SOW.

Q13. As referenced in the Inspections and Acceptance Terms section, how often do you estimate that goods will be required to be delivered before 120 days?

A13. In the seldom event that an item is critical in nature, we will request quotes for delivery earlier than 120 days. However, 120 days is the benchmark.

Q14. In developing the unit of measure in our proposal, should be we bidding on the NSN UOM or is there a different UOM for each line item?

A14. Offerors should use the NSN unit of measure in their proposals.

Q15. Considering potential supply chain issues, what is the stipulation governing providing clinical equivalents?

A15. See A1. Each item that an offeror provides as a substitute to an indicated NSN will be evaluated to confirm that the item meets the required salient characteristics.

Q16. The following line item products have been discontinued: Line 3 (5640014620102), Line 11 (6510013833833), Line 18 (6515008413665). Can you provide replacements or would you like us to suggest replacements?

A16. All items currently appear as procurable in our system, although items have been known to become discontinued without notice. Any offerors unable to procure an item may propose a substitute that meets the salient characteristics of the provided NSN. Offerors are to include detailed information in the form of pictures or a link to the substituted item so that the Government is able to determine whether the substitution meets the required salient characteristics.

Q17. We would like to know a little more about the kits. When I looked at the 29 items it said “kit” but I did not see a list of what makes up the kits. Can we get a list of items that will be needed to complete the kits or packages to ensure we have everything and can modify to meet this need?

A17. As stated in the addendum to FAR 52.212-1, because the complete list of possible AMAL, ADAL, and medical kit items to be procured is near 6,500 unique items, and is subject to continual change, the Government has identified 34 items that serve as a sample of the overall items to be procured. Offerors are to propose prices for this subset of the total list of items, provided with the solicitation as Attachment 2. Due to the sheer amount of items on the AMALs, ADAL, and medical kits, we will not be identifying individual items apart from the 34 items on Attachment 2.
