Corps’ requirement for 360 Dismounted Counter-Radio Electronic Warfare (CREW) systems. This is in support of an Urgent Statement of Need (USON) to provide Counter Improvised Explosive Device (CIED) capabilities as described in this Request for Proposal (RFP).
The Government is seeking a Non-Development Item (NDI) solution for the stated requirement to provide all the services and supplies contained within this solicitation. The Government intends to make award(s) to the responsible offeror(s) for the purposes of providing support to the CREW Marine Expeditionary Unit (MEU) Special Operations
Capable (SOC) Program, hereafter referred to as the Program, Dismounted effort.
The Government intends to award multiple Firm Fixed Price, Indefinite Delivery/Indefinite Quantity (IDIQ) contracts for the items as contained within this solicitation. The projected period of performance for this effort is a five year ordering period.
The Government intends to evaluate proposals and award a contract without discussions in accordance with FAR
52.215-1, Instructions to Offerors. Therefore, each initial offer should contain the offeror’s best terms for evaluation and acceptance. However, the Government reserves the right to hold discussions if determined to be in the best interest of the Government.
This solicitation is an unrestricted solicitation in accordance with FAR 52.219-6. The NAICS Code for this acquisition is 334511 with a size standard of 750 Employees.
The contract contains classified annexes and will require the submission of classified responses to the RFP. Only those offerors that have the required facility and personnel clearance as stated in this solicitation will be eligible to be considered to receive the classified annexes. If an offeror is unable to receive the classified annexes, and therefore unable to provide a responsive proposal, any such proposal will not be evaluated for award.
L-2.0 SOLICITATION INFORMATION
L-2.1 PERIOD AND CONDITIONS FOR ACCEPTANCE OF OFFERS
(a) Offeror agrees, if this offer is accepted by the Government within 230 days from the date for receipt of offers specified in Section L, B, Proposal Due Date, to furnish any or all items upon which prices are offered at the price set opposite each item, delivered at the designated point(s), within the time specified in the schedule.

(c) Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).
L-2.2 PRE-AWARD/SITE SURVEY
The use of the term “pre-award/site survey” throughout this solicitation refers to any type of site inspection or site survey conducted by the Marine Corps evaluators or other designated government personnel for the purposes of evaluation or compliance. The Government reserves the right to conduct a pre-award/site survey or to require other evidence of technical, managerial, personnel, financial, storage, security, and similar abilities to perform the required work prior to the award of any contract. Performance of a pre-award/site survey or other visit in no way indicates that an award may be imminent or apparent. Use of pre-award/site surveys is solely at the discretion of the
PCO.
L-2.3 REQUIREMENTS FOR CERTIFIED COST OR PRICING DATA AND DATA OTHER THAN
CERTIFIED COST OR PRICING DATA
It is anticipated that this acquisition will not necessitate the submission of cost or pricing data as defined in FAR
2.101. In the event of a submission of a single offer from this solicitation, a competitive one-offer situation will have occurred. If a competitive one-offer situation occurs, this single offeror may be required to submit Certified
Cost or Pricing Data or Other Than Certified Cost or Pricing Data for the purposes of evaluation and negotiation.
By submission of an offer to this solicitation, the offeror acknowledges that Certified Cost or Pricing Data or Other
Than Certified Cost or Pricing Data may be required in the event of a competitive-one offer situation. The decision for the need of Certified Cost or Pricing Data or Other Than Certified Cost or Pricing Data will be at the discretion of the PCO. In the event that Cost or Pricing Data or Other Than Cost or Price Data are required, it shall be in accordance with FAR 52.215-20 (OCT 2010).
L-2.4 INTENT TO INCORPORATE CONTRACTOR'S PROPOSAL
All or part of the successful offeror's proposal (e.g. technical approach, schedule, past performance and price) may be incorporated by reference or other means in any contract(s) resulting from this solicitation. This may include specific portions of the Contractor's proposal that exceed any of the Government's threshold requirements and/or meet or exceed any of the Government's objective requirements provided in the Schedule, Statement of Work, or
Performance Specification (including, but not limited to dates, performance values, and/or any other measurable criteria). If incorporated, these values will supersede the Government's threshold requirements that were exceeded and/or the Government's objective requirements that were met and/or exceeded. Nothing contained in the successful offeror's proposal shall constitute a waiver to any other requirement of the contract.
The successful offeror will provide, as necessary, any updated proposal changes that reflect the results/responses to any items of clarification and/or discussions. If, after contract award, it is discovered that changes made as a result of any clarifications and/or discussions were not incorporated into those portions of the proposal, such changes to the contractor's documents shall be considered administrative in nature and shall be made by unilateral modification to the contract, at no change in contract cost, price, or other terms and conditions.
L-2.5 USE OF GOVERNMENT PROPERTY
The Offeror shall state whether, in the performance of the contract, it will require the use of existing Government-owned property (including, but not limited to, facilities, equipment, production, and/or research property) or information, whether or not it is currently in its possession or in the possession of its proposed subcontractors. Do not include the Government Furnished Equipment listed in this solicitation unless a substitution is requested. The substitution needs to be described along with the exceptions, deviations, and/or request for waiver.
a. The following information shall be provided by the Offeror:
i) A list or description of all such property involved which the Offeror and/or anticipated subcontractor(s), propose to use along with the quantity.
ii) The dates during which such property will be needed for use. (i.e. need date and return to Government date)
iii) The Offeror shall discuss alternatives in the event the proposed property is unavailable at the time proposed.
iv) The Offeror shall identify all Government test facilities anticipated for use under the contract.
v) The Offeror shall identify when the facilities are required and the anticipated duration of their use. The Offeror shall discuss alternatives in the event the proposed facility is unavailable at the time proposed.
vi) The Offeror shall request a cost quote from the cognizant Government office for use of Government property, equipment and facilities. This quote shall be included in the cost volume of the proposal and shall include the following:
vii) The GP and use requirements.
viii) The name and phone number of the Government activity and point of contact of the person supplying the quote.
ix) The cost quoted with terms and conditions.
b. The Offeror's proposed price in Section B shall not include Government cost associated with Offeror proposed
GP. The price associated with the GP proposed under this section will be included in the price evaluation. The
Government reserves the right to verify all quotes received. If the Offeror is unable to obtain a cost quote from a
Government agency in time for proposal submission, the Government reserves the right to unilaterally apply a price estimate to the GP. (See example)
Example: Offeror's proposed price is $6.25M with a projected cost of 750K for GP. The total price for evaluation of the Offeror's effort will be $7M (6.25M + 750K). However, the contract award amount would be
