Addendum to Evaluation - Commercial Product and Commercial Services
52.212-2 ADDENDUM
52.212-2 EVALUATION - COMMERCIAL ITEMS - ADDENDUM
Basis for Contract Award - Best Value Tradeoff This acquisition is being conducted under FAR Parts 12 and 13. Quoters will be evaluated using the factors identified in FAR 52.212-2, Evaluation - Commercial Items, and this Addendum. Award will be made to the Quoter whose quote represents the best value to the Government, considering price and non-price factors using a Best Value Tradeoff source selection process.
The Government intends to award a contract resulting from this solicitation to the responsible Quoter whose quote conforms to the solicitation and is determined to offer the best value to the Government, based on an integrated assessment of the following factors:
1. Factor One: Technical Capability
2. Factor Two: Price
3. Factor Three: Past Performance The Government may award to a higher-priced Quoter if the technical capability and/or past performance of that Quoter are determined to provide a benefit to the Government that outweighs the price difference. Conversely, the Government may award to a lower-priced Quoter if the benefits of higher technical ratings or stronger past performance do not justify the additional cost.
The Government reserves the right to make award to other than the lowest-priced Quoter or to other than the highest technically rated Quoter.
1) Factor One: Technical Capability Quoters shall provide the following:
. A clear and concise Technical Approach that demonstrates an understanding of the requirement and how the Quoter proposes to meet or exceed performance expectations.
. A Quality Control Plan that outlines procedures for ensuring consistent quality, timeliness, and compliance with contract requirements.
Technical capability will be evaluated using the following adjectival ratings:
Outstanding - The quote demonstrates an exceptional understanding of the requirements and contains multiple strengths. The proposed approach significantly exceeds performance expectations and indicates a high probability of successful performance with very low risk to the Government.
Good - The quote demonstrates a thorough understanding of the requirements and contains at least one strength. The proposed approach meets requirements and may exceed some performance expectations. Risk of unsuccessful performance is low.
Acceptable - The quote demonstrates an adequate understanding of the requirements. The proposed approach meets minimum performance expectations. Strengths and weaknesses, if any, offset each other. Risk of unsuccessful performance is no greater than moderate.
Marginal - The quote demonstrates a limited understanding of the requirements. The proposed approach does not clearly meet requirements and contains one or more weaknesses that increase the risk of unsuccessful performance to the Government.
Unacceptable - The quote fails to meet the minimum requirements of the solicitation and/or contains one or more deficiencies.
The risk of unsuccessful performance is unacceptable. A quote rated Unacceptable is ineligible for award.
2) Factor Two: Price Prices will be evaluated to determine fairness, reasonableness, and balance in accordance with FAR 13.106-3(a).
The Government may use any one or a combination of price analysis techniques described in FAR 13.106-3(a)(2) to evaluate quoted prices.
Evaluation of Options: In accordance with FAR 52.217-5, the Government will evaluate quotes for award purposes by adding the total price for all options, including those under FAR 52.217-8, to the total price for the basic Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Quotation meets the requirements of the solicitation.
Unacceptable Quotation does not meet the requirements of the solicitation.
requirement. Evaluation of options does not obligate the Government to exercise any options. Quotes with significantly unbalanced option pricing may be deemed unacceptable.
3) Factor Three: Past Performance The Government will conduct a Performance Risk Assessment of each Quoter's record of recent and relevant past and current performance (within the past 3 years) as it relates to the probability of successful performance under this solicitation. This assessment will include review of past contracts of a similar nature, size, scope, and complexity, including those performed by proposed subcontractors or team members.
The Government may use information provided by the Quoter, as well as information from other sources (e.g., CPARS, PPIRS, customer references, etc.).
Past performance will be rated as follows:
Past Performance Evaluation Ratings Rating Description Acceptable Based on the Quoter's performance record, the Government has a reasonable expectation that the Quoter will successfully perform the required effort, or the Quoter's performance record is unknown. (See note below.)
Unacceptable Based on the Quoter's performance record, the Government has no reasonable expectation that the Quoter will be able to successfully perform the required effort.
Unknown No relevant past performance record exists or is available.
Treated as "Acceptable" in rating Note: A Quoter with an "unknown" past performance rating (i.e., no available or relevant past performance data) will not be rated favorably or unfavorably and will be considered "Acceptable."
Award Determination The Contracting Officer will perform a comparative assessment of all quotes that are deemed technically acceptable and have acceptable past performance. The tradeoff analysis will consider whether a quote's higher price is justified by its superior technical capability and/or past performance. The Government reserves the right to make award to the Quoter whose quote provides the best overall value.
The Government intends to evaluate quotes and make award without requesting or allowing revised quotes.
Therefore, Quoters are advised to submit their most favorable terms and best possible performance potential in their initial submission. However, the Government reserves the right to hold discussions or clarify aspects of the quotes, as necessary.
The Government reserves the right to make no award if it is determined that none of the quotes offer a best value or if funding is not available.
Proposal Submission Instructions All quotes shall be submitted electronically to kori.gearhart@usmc.mil or delivered by hand to:

A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts.
