Statement of Work Liquefied Petroleum Gas (LPG) LPG Tank Rentals
1) DESCRIPTION/SPECIFICATIONS
a) General
This contract sets forth the requirements for the uninterrupted delivery of Liquefied Petroleum Gas (LPG), Grade HD5 and rental of tanks at various locations on Marine Corps Base Hawaii, Kaneohe Bay and Camp H.M. Smith.
b) Definitions
Liquefied Petroleum Gas (LPG) – A fuel gas, which consists predominantly of propane, propylene, butanes (including isobutanes), butylenes, or any combination or dilution thereof.
2) DELIVERY OF LPG
a) The Contractor shall ensure that all tanks are kept supplied with adequate levels of LPG so that there shall be no disruption of services during normal working hours of the using activity.
b) All LPG delivered by the Contractor shall be measured by metering equipment of standard manufacturer, furnished, installed, maintained, calibrated, and read by the contractor at his/her own expense. In the event that any meter fails to register or registers incorrectly, the quantity of LPG delivered through it during that period shall be determined and an equitable adjustment based thereon shall be made in the Government’s Bills. Any meter which registers not more than two percent (2%) slow or fast shall be deemed correct. Failure to agree on any such adjustments shall be a dispute concerning a question of fact within the meaning of FAR 52.233-1 Disputes clause of this contract.
c) Delivery Ticket - The Contractor is responsible for obtaining a signature to confirm the delivered quantity at each delivery location specified in the Statement of Work and shall submit an electronic copy of the delivery ticket via email to Contracting Officer’s Representative (COR) (Name and email to be filled in at time of award) and the Administrative Contracting Officer (Name and email to be filled in at time of award). The delivery ticket shall state the delivery order number, the sub-contract line item number (subCLIN), and the amount of LPG delivered.
d) Monthly Report - The Contractor shall submit a monthly report to the Contracting Officer’s Representative (COR) for each Delivery Order within 10 working days of the end of each month. The monthly report shall contain a consolidated list of the quantities delivered to each tank. All delivered quantities shall be reflected on this report. If the quantity is zero, indicate “zero gallons delivered.” This is a separate requirement from the monthly invoicing requirements.
3) TANKS
a) All tanks are contractor-owned and leased by the Government; therefore, at the beginning of the contract, the contractor is responsible for all costs of delivery and installation of any required tanks, including but not limited to, off-loading the tanks, setting, mounting, and stabilizing of the tanks and all necessary connections. At the end of the contract, the contractor is responsible for the removal of all tanks should a new contractor receive the follow-on contract. The outgoing contractor may choose to sell the tanks that are already in place to the incoming contractor, but that is up to the discretion of contractors involved and it is not mandated by the Government. The Government shall be credited for any remaining LP Gas in any tanks that are removed from Government Property. (See paragraph #6 for further details on Transition Requirements.)
b) The tanks provided shall be in such condition as to conform to all requirements of NFPA 58 and any additional requirements which are governed by any State, City & County and Federal regulations. In addition, the tanks and pressure relief valves and other components shall be in such condition which meets all Federal, State, and local regulations prior to installation of tanks.
c) The Contractor shall be responsible for maintaining Contractor-owned tanks in accordance with the guidelines set forth in NAVFAC “Uniform Facilities Criteria UFC 3-430-07.” If a conflict occurs between State, City & County and Federal regulations, UFC 3-430-07 shall govern. The Contractor shall comply with tank inspection and replacement requirements and ensure tank will be issued a NAVFAC operating permit as final acceptance of tank installation.
d) If it is apparent that a tank has exceeded its useful life and needs to be replaced, the contractor is responsible for replacing it with the same capacity tank at no additional cost to the Government. (See paragraph #4 for additional details.)
e) If new locations requiring LPG arise during the period of performance, a new delivery order will be issued (or an existing delivery order will be modified) to arrange for the additional LPG needs and tank rental. The contractor is responsible for providing and installing any additional tanks needed at no additional cost to the Government beyond the price for leasing the particular sized tank.
f) The Navy Inspector shall be present during any installation, maintenance, or repairs conducted on the tanks. Contact the Contracting Officer’s Representative (COR) to schedule all tank installations, and all repairs and maintenance conducted on such Contractor-owned equipment. At the commencement of the contract, the Contractor shall be present at each tank inspection to ensure the tank passes inspection and is issued a certificate. The Contractor’s presence is not required on subsequent inspections of tanks.
4) TANK SAFETY AND INSPECTIONS
a) Tank installations shall be in accordance with NFPA 58.
b) The Government will inspect LPG tanks every two years commencing with the start of this contract. Additional inspections may be conducted at the discretion of the Navy Inspector where unsafe conditions exist. NAVFACENGCOM operating certificates are valid for two years, and operation of LPG tanks on Government property without valid NAVFAC Operating Permits is not authorized. Uncertified tanks shall be certified within 3 months from the date of notification of a discrepancy or it shall be removed and replaced with a tank that passes inspection.
c) Inspections and certifications shall be performed by an authorized NAVFAC Hawaii, Naval Facilities Engineering Command, Licensed and Authorized, Boiler and Pressure Vessel Inspector (Navy Inspector). The coordinator for this function is Maintenance Supervisor, PRJ 3571, Mr. Wesley Toyama or designee, ph: (808) 471-0374, wesley.toyama@navy.mil.
d) All tanks provided by the Contractor and the Government shall be ASME code stamped for applicable service and in an acceptable, serviceable condition to the Navy Inspector.
e) No repairs, alterations, or reconfiguring of tanks shall commence without prior notification and approval of the Navy Inspection Office.
f) All structural repairs to pressure retaining items shall be done in accordance with the current edition of the National Board Inspection Code (NBIC) and NAVFAC requirements. Notify the Navy Inspector of any such repairs prior to commencing repairs. In the event a disagreement arises between the NBIC and the NAVFAC requirements, the NAVFAC requirements will govern. All costs for structural repairs shall be borne by the contractor for Contractor owned equipment.
g) All parts used shall conform to a nationally recognized standard.
h) Hydrostatic strength testing is required after any repair, alteration, or when the tank is in a questionable physical condition as determined by the Navy Inspector. Hydrostatic strength testing shall be performed with the Navy Inspector present.
i) In accordance with NAVFAC requirements, Safety Relief Valves shall be:
(1) ASME Division VIII Section I certified, or Underwriters Laboratories UL 32stamped, spring loaded safety relief valves.
(2) Shall not be fitted with lifting devices.
Safety Relief Valves shall be removed and replaced after every six (6) years of service. Primarily, the stamping on the relief valve will be used as the start date. Previously purchased new valves may be accepted by the Navy Inspector in new condition and accompanied with a purchase receipt, in which case, the start date would be the date of installation. Safety valve bench-tested by a company authorized to perform such tests on either ASME or UL safety relief valves may be reused with proper safety valve testing documentation. This testing documentation shall be retained by the Contractor and presented to the Navy Inspector upon request.
j) Tank Replacement Requirements:
(1) The Contractor shall provide all repairs, replacements and/or correction of Contractor-owned tanks at no additional cost to the Government.
(2) The Contractor shall at no additional cost to the Government replace tanks requiring welding repairs to the pressure retaining structure. If the Navy Inspector notes areas of external corrosion, the Contractor shall remove the tank and replace it with a tank that is acceptable to the Navy Inspector. In the event of isolated corrosion, the Contractor shall replace the tank or shall provide professional Non Destructive Testing (NDT) services from an ASME qualified company. Testing shall be done with the Navy Inspector present. The costs for the NDT services shall be borne by the Contractor.
k) If the tank installation is in non-compliance, the contractor is responsible for any additional NAVFAC HI engineering service costs required to bring the tank back into compliance.
l) Any deviation of the above requirements will require approval from MCBH Facilities and may require a review and approval by NAVFACHI Fire Inspection Branch, at the expense of the action proponent.
m) For installation of new tanks associated with the ROICC construction project, the contractor shall provide ample notification (minimum 15 working days) to MCBH Facilities and/or the ROICC, prior to the installation of the LPG tank and its support structure(s) on the existing concrete pad.
5) OTHER REQUIREMENTS
a) The Contractor shall make every effort to schedule in advance any work involving possible disruption of service and notify the Contracting Officer and activity at each location of the scheduled time and date of the scheduled work prior to the commencement of such work. In no event shall there be any disruption of services during normal working hours of the using activity.
b) All Contractor personnel handling LP Gas at Marine Corps Base Hawaii shall be trained in proper handling and operating procedures of such gas. Written documentation of such training shall be kept by the contractor. All Contractor employees shall carry written certification of their job qualification issued by the training agent or a written document issued by the authority having jurisdiction identifying the function the individual is to perform.
6) UNITERRUPTION OF SERVICES DURING TRANSITION PERIOD AT THE END OF THE CONTRACT
a) This paragraph applies at the end of the final performance period if the successor Contractor is not the incumbent Contractor.
b) To ensure an efficient and orderly transition upon contract completion, the incumbent Contractor shall exercise every effort and cooperate fully with the successor Contractor during the transition period. Final payment shall not be made until the Contractor has fully complied with transition issues.
(1) If the incumbent is the awardee, then removal of the Contractor-owned tanks will not be necessary. If the successful Contractor is not the incumbent, the tanks provided under the current contract shall be removed and tanks are to be installed by the new Contractor within the first Fifteen (15) working days of the new contract period according to the schedule set forth below.
(2) Removal of Contractor-owned tanks by the predecessor Contractor shall be coordinated with the new Contractor, through the COR and the Contracting Officer, so as not to cause a minimal disruption in service to the activities. Minimal disruption of services for the purposes of transition is defined as no more than 4 hours during a time of non-working or non-peak hours for the activity.
(3) Transition Report - The time(s) and the date(s) of the change overs of the tanks shall be documented by both the outgoing and incoming contractor(s) and shall be reported to the COR and the Contracting Officer at time of transition completion. The COR will verify the accuracy of the reports.
(4) The Government shall be credited for the amount of the LPG remaining in any of the tanks removed.
