Dear Mr. Nelson:

The Department of Environmental Quality (DEQ) has approved the enclosed effluent limitations and monitoring requirements for the above-referenced permit. Copies of your permit and fact sheet are enclosed.

A Discharge Monitoring Report (DMR) form is no longer included in the reissuance package since you are already enrolled in DEQ's electronic DMR (e-DMR) program. The first electronic DMR submittal for the month of September 2016 is due by October 10, 2016.

Please reference the effluent limits in your permit and report monitoring results in e-DMR to the same number of significant digits as are included in the permit limits for the parameter. Please note that compliance with the permit's requirements for use and disposal of sewage sludge does not relieve you of your responsibility to comply with federal requirements set forth in 40 CFR Part 503. Until DEQ seeks and is granted authority to administer the Part 503 regulations by EPA, treatment works treating domestic sewage should continue to work directly with EPA to comply with them. For more information, you can call the EPA Region III office in Philadelphia at (215) 814-5735.

As provided by Rule 2A:2 of the Supreme Court of Virginia, you have thirty days from the date of service (the date you actually received this decision or the date it was mailed to you, whichever occurred first) within which to appeal this decision by filing a notice of appeal in accordance with the Rules of the Supreme Court of Virginia with the Director, Department of Environmental Quality. In the event that this decision is served on you by mail, three days are added to that period.

Alternately, any owner under §§ 62.1-44.16, 62.1-44.17, and 62.1-44.19 of the State Water Control Law aggrieved by any action of the State Water Control Board taken without a formal hearing, or by inaction of the Board, may demand in writing a formal hearing of such owner's grievance, provided a petition requesting such hearing is filed with the Board. Said petition must meet the requirements set forth in § 1.23(b) of the Board's Procedural Rule No. 1. In cases involving actions of the Board, such petition must be filed within thirty days after notice of such action is mailed to such owner by certified mail.

A Reliability Class I is assigned to this facility and this facility has Class III licensed operator requirements.

12. Effluent Monitoring Frequencies

The following sampling frequencies shall apply as described below:

The sampling frequencies defined above are based on monthly average flow. Should the monthly average flow exceed the defined threshold category for any three (3) consecutive months, the permittee shall commence the monitoring frequencies of the next higher threshold category established above. Once actual monthly average flows exceed 0.1 MGD for three consecutive months, the reduced monitoring frequencies above shall cease and the monitoring frequencies specified in Part LA shall apply.

In addition, if the facility permitted herein is issued a Warning Letter, a Notice of Violation, or is subject to an active enforcement action related to effluent limitation violations for any of the parameters listed in the table above, the monitoring frequencies contained in Part LA shall be reinstated and shall remain in effect for a period of at least six (6) months upon written notification from DEQ. If influent flow is too low and discharge does not occur, the permittee shall state "No Discharge" on the DMR. If the facility remains in compliance during the aforementioned period of at least six (6) months, the permittee may submit a written request reinstating a reduced monitoring frequency.

13. Total Maximum Daily Load (TMDL) Reopener This permit shall be modified or alternatively revoked and reissued if any approved wasteload allocation procedure, pursuant to Section 303(d) of the Clean Water Act, imposes wasteload allocations, limits or conditions on the facility that are not consistent with the permit requirements.

e. The analytical techniques or methods used; and

f. The results of such analyses.

2. Exceptfor records of monitoring information required by this permit related to the permittees sewage sludge use and disposal activities,which shall be retamedforaperiod of at least five years, me permit shall retam records of all monitoring information, mcludmg all calibration and mamtenance records â all original strip chart recordings for contmuous monitoring instrumentation, copies of all reports by this permit, and records of all data used to complete the applicationfor mis permit,foraperiod of at least3years from the date of the sample, measurement, report or application. This period of retention shall be extended automaticallyduring me course of any umesolved litigation regarding the regulated activity or regarding control standards applicable to me permittee, or as requested by the Board.

Ĉ Reporting Monitoring Results

D^ Duty to Provide Information

The permittee shall mrnish to the Department,withmareasonable time, any inform may request to determine whemer cause existsfor modifying, revoking and reissuing,or terminating this permit or to determine compliance with this permit. The Board may require me permittee to furnish,upon request, suchplans, specifications,andomerpertment informationasmay benecessary todeterminethe effect of the pastes from this discharge on the quality of state waters, or such other information asm necessary to accomplish the purposes ofthe State Water Control Law. The permittee shall also furnish to the Department upon request, copies ofrecords required to be kept by this permit.

^ Compliance Schedule Reports

Reports ofcompliance or noncompliance with,or any progress reports on, interim and final requirements contained in any compliance schedule of mis permit shall be submitted no later than 14daysfollowing each schedule date.

P̂ Unauthorized discharges

Except in compliance wim mis permit, or anomer permit issued by me Board, it shall be u n l a w f u l ^ person to:

1. Discharge into state waters sewage, industrial wastes, otherwastes, or any noxious or deleterious substances; or

2. Cmerwisealterme physical, chen^cal or biological properties ofsuch state waters and make m^ detrimental to the public healm,orto animal or aquatic life, or to the use ofsuch waters for domestic or industrial consumption, orfor recreation, orfor other uses.

Any permittee ŵ ho discharges or causes or allowsadischarge of sewage, industrial waste, other wastes or any noxious or deleterious substanceinto or upon state watersinviolationof Part ii.E.;or who discharges or causes or allowsadischarge that may reasonably be expected to enter state waters in violation ofPartlf.E., shall notify the Department ofthe discharge immediately upon discovery ofthe discharge, but in no case later than 24 hours after said discovery. Awritten report of the unauthorized discharge shall be submitted to the Department,within five days of discovery of the discharge. The written report shall contain:

1. A description ofthe namre and location ofthe discharge;

2. The cause of me discharge;

3. The date on which the discharge occurred;

4. The length oftime that the discharge continued;

5. The volume ofthe discharge;

6. ifthe discharge is continuing, how long it is expected to continue;

7. I f the discharge is continuing,what the expected total volume of the discharge will be; and ^. Any steps planned ortaken to reduce, eliminate and preventarecurrence of the present discharge or any future discharges not authorised hy this permit.

Discharges reportable to the Departs exempted from this requirement.

H^ Reports ofUnusual or Extraordinary Discharges

If any unusual or extraordinary discharge includm^abypass or upset should occurfromatr^eatmentwor^^ and me discharge enters or could he expected to enter state waters, me permittee shall promptly notify, in no case later man24 hours, me Department by telephone after the discovery of the discharge. This notification shall provide all available details ofme incident, mcludmg any adverse affects on aquatic life and m^ number of fish killed. T^e permittee shall reduce me report to writing and shall submit it to the Department withinfivedaysofdiscovery of the dischargeinaccordance with Part H.I.2. Unusualandextraordinary discharges include but are not limited to any discharge resulting from;

1. Unusual spillage ofmaterialsresultmg directly or indirectly from processing operations;

2. Breakdown ofprocessing or accessory equipment;

3. Failure ortaking out ofservice some or all ofthe treatment works; and

4. Flooding or other acts of nature.

L Reports ofNoncompliance

Thepermitteeshallreportanynoncompliancewhichmay adversely affect statewatersor may endanger public health.

1. An oral report shall be provided wimin24hours from me time me permittee becomes aware of the circumstances. The following shall be included as information which shall be reported within24hours underthis paragraph:

a. Any unanticipated bypass; and

b. Any upset which causesadischarge to surface waters.

2. A written report shall be submitted within^days and shall contain:

a. Adescription of the noncompliance and its cause;

b. The period ofnoncompliance, including exact dates and times, and ifthe noncompliance has not been corrected, the anticipated time it is expected to continue; and

c. t̂eps taken or planned to reduce, eliminate, and prevent reoccurrence ofthe noncompliance.

The Board may waive me written report onacase-by-casebasisfor reports of noncompliance under Part II . I . i f the oral report has been received within24 hours and no adverse impact on state waters has been reported.

3. The permittee shall report all instances ofnoncompliance not reported under Parts I I , I.l.orl.2., in writing, at the time the next monitoring reports are submitted. The reports shall contain the information listed in PartlT12

^ Notice ofRlanned Changes

1. The permittee shall give notice to me Department as soon as possible ofany planned physical alterations or additions to the permitted facility. Notice is required only when:

a. The permittee plans alteration or addition to any building, strucmre,facility,or installation f^^ which there is or may beadischarge of pollutants, the construction of which commenced:

1) Arter promulgation of standards of performance under Section 306 of CleanWater Act which are applicable to such source; or

2) After proposal of standards of performance in accordance with Section 306 of CleanWater Act which are applicable to such source, hut only ifthe standards are promulgated in accordance with Section 306 within 120 days of their proposal;

b. The alteration or addition could significantly change me namre or mcrease me quantity of polluta^^ discharged. This notification applies to pollutants which are subject neitherto effluent limitations nor to notification requirements specified elsewhere in this permit; or

c. The alteration or addition results inasignificant change in the permittee's sludge use or disposal practices, and such alteration, addition, or change mayjustify the application ofpermit conditions that are different from or absent in me existing permit, including notification ofadditional use or disposal sites not reported during the permit application process or not reported pursuant to an approved land application plan.

2. The permittee shall give advance notice to the Department ofanyplanned changes in the permitted facility or activity which may resultinnoncompliance with permit requirements.

^ Signatory Requirements

1. Applications. All permit applications shall be signed asfollows:

a. Eoracorporation:byaresponsible corporate officer. Tor the purpose of this section,aresponsible corporate officer means:

1) Apresident,secretary,treasurer, or vice-president of me corporation in charge ofaprincipal business mnction, or any omer person who performs similar policy-or decision-making m^ forthe corporation, or

2) The manager of one or more manufacturing, production, or operatingfacilities, provided the manager is authorised to make management decisions which govern the operation ofthe regulatedfacility including having me explicit or implicit duty of making major capital investment recommendations, and initiating and directing other comprehensive measures to assure long term environmental compliance with environmental laws and regulations; the manager can ensure that the necessary systems are established or actions taken to gather complete and accurate informationforpermit application requirements; and where authorityto sign documents has been assigned or delegated to the manager in accordance with corporate procedures;

b. Toraparmershiporsoleproprietorship;byageneral partner or the proprietor,respectively; or

c. Toramunicipality,state, federal, or omerpublic agency: by eitheraprincipal executive officer or ranking elected official. Torpurposes of this section,aprincipal executive officer ofapublic agency includes:

1) The chief executive officer of the agency,or

2) A senior executive officer having responsibility for the overall operations ofaprincipal geographic unit ofthe agency.

2. Reports etc. All reports required by permits, and other information requested by the Board shall be signed byaperson described in Part 11.^.1.,or byaduly authorized representative of that person. A person isaduly authorized representative only if:

a. The authorisation is made in writing byaperson described in Part Ll.R.l.;

b. The authorisation specifies eimer an individual oraposition having responsibilityforthe overall operation ofthe regulated facility or activity such as the position of plant manager, operator ofawell orawell field, superintendent, position of equivalent responsibility,or an individual or position having overall responsibility for environmental matters forthe company. (A duly authorized representative may thus be eimeranamed individual or any individual occupyinganamed position.);

and

c. The written aumori^ation is submitted to the Department.

3. Changes to authorization. If an authorization under Part 11.1 .̂2.is no longer accurate becauseadifferent individual or position has responsibilit^forthe overall operation ofthefacility,anew authorisation satisfying me requirements ofPart 11.^.2.shall be submitted to me Department prior to any reports, or information to be signed by an authorized representative.

4. Certification. Any person signingadocument under Parts B,r^.l.or 1 .̂2.shall make thefollowing certification;

^certify under penalty oflaw mat this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry ofthe person or persons who manage the system, or mose persons directly responsiblefor gathering me information, the information submitted is, to me best of my Imowledge and belief, accurate, andcomplete. lam aware that there are significant penaltiesfor submitting false information, includmg me possibility of fine and imprisorm^entforlmowing violations

Duty to Comply

Thepermittee shall comply with allconditions of thispermit. Any permit noncompliance constitutesa violation of the ^tateWater Control Law and me CleanWater Act, exceptmat noncompliance wimcertam provisions of this permit may constituteaviolation of the State Water Control Law but not the CleanWater Act. Permit noncompliance is grounds for enforcement action; for permit termination, revocation and reissuance, or modification; or denial ofapermit renewal application.

The permittee shall comply with effluent standards or prohibitions established under section 307(a) of the CleanWaterActfor toxic pollutants and with standards for sewage sludge use or disposal established under section 40S(d) ofthe Clean Water Act within thetime provided in the regulations that establish these

MDDutytoReapply ifthe permittee wishes to contmue an activity regulated by this permit afier me expir^^ the permittee shall apply tor and obtainanew permit. All permittees withacurrently effective permit shall submitanew application at leastl^Odays before me expiration date of the existing permit, unless permission foralater date has been granted by the Board. The Board shall not grant permission for applications to be submitted later than the expiration date ofthe existing permit.

N Effect ofaPermit

This permit does not convey any property rights in either real or personal property or any exclusive privileges, nor doesit authorise anymjury to private propertyorinvasionof personal rights,or any mfrmgem^ federal, state or local law orregnlations.

Ô State ^aw

Noming in this permit shall be construed to preclude the instimtion of any legal action under, or relieve the permitteefiomanyresponsibilities,liabilities,or penalties establishedpursuanttoan regulation or under authority preserved by Section^ldof the Clean Water Act. Except as provided in permit conditions on^bypassing''(Part 1I.U.), and''upsets (Part ll.V.)nomingmmisper^ relieve me permittee from civil and criminal penaltiesfor noncompliance.

P̂ Oil and Hazardous Substance Eiability

Nothingmmis permit shall be construed to preclude the instimtion of any legal action or relieve me from any responsibilities, liabilities, or penalties to which me permittee is or may be subject u^ 62.1^.34:14through62.1^4.34^ofthe State WaterControlEaw.

0^ Proper Operation and Maintenance

The permittee shallatalltimesproperlyoperate and maintain allfacilities and systems of treatment and control (and related appurtenances)which are installed or used by the permittee to achieve compliance with the conditions of this permit. Proper operation and maintenance alsoincludes effective plant performance, adequate funding, adequate staffing, andadequate laboratory andprocesscontrols, includingappropriate quality assuranceprocedures. Thisprovision requires the operation of back-up or auxiliary facilities or similar systems which are installed by the permittee only when the operation is necessary to achieve compliance with the conditions of this permit.

RD Disposal ofSolids or Sludges

Solids, sludges or omer pollutants removed in the course of treatment or management of pollutants shall be disposed of inamanner so as to prevent any pollutant from such materials from entering state waters.

SD Dutyto Mitigate

The permittee shall take all reasonable steps to minimise or prevent any discharge or sludge use or disposal in violation of this permit which has areasonable likelihood of adversely affecting human health or the environment.

T̂ Need to Halt or Reduce Activity notaDefeuse

It shall not beadefenseforapermitteeinan enforcement action mat it would have been necessary to halt or reduce me permitted activity in order to maintain compliance with the conditions of this permit.

^ Bypass

1. ''Bypass''meansthe intentional diversion ofwaste streams from any portion ofatreatmentfacili^ The permittee may allow any bypass to occurwhich does not cause effluent limitations to be exceeded, but only i f i t also isfor essential maintenance to assure efficient operation. These bypasses are not subject to the provisions ofParts 11, U.2.andU.3.

2. Notice

a. Anticipated bypass, If the permittee knows in advance of the need forabypass, prior notice shall be submitted, impossible at least ten days before tbe date of tbe bypass.

b. Unanticipated bypass. The permittee shall submit notice ofan unanticipated bypass as required in

Partll.l.

3. Prohibitionofbypass.

a. Bypass is prohibited, and the Board may take enforcement action againstapermittee for bypass, unless:

1) Bypass was unavoidable to prevent loss oflife, personal injury,or severe property damage;

2) There were no feasible alternatives to me bypass, such as the use of auxiliary t^eatmentfacilities, retention ofunt^eated wastes, or mamtenance during normal periods of equipment downtime.

Tbis condition is not satisfied ifadequate back-up equipment should have been installed in the exercise of reasonable engineeringjudgment to preventabypass which occurred during normal periods ofequipment downtime orpreventive maintenance; and

3) The permittee submitted notices as required under Part 11.U.2.

b. The Board may approve an anticipated bypass, after considering its adverse effects, i f the Board determines mat it will meet me three conditions listed above in Part ll.U.3.a.

V^ Upset

1. An upset constimtes an affirmative defense to an action brought for noncompliance wimtechnoi^ based permit effluent limitations ifthe requirements ofPartll.V.2.are met. Adetermination made during administrative review of claims mat noncompliance was caused by upset, and before an actionfor noncompliance, is notafinal administrative action subject to judicial review.

2. A permittee who wishes to establish me affirmative defense of upset shall demonstrate,^ signed, contemporaneous operating logs, or otherrelevant evidence that:

a. An upset occurred and that the permittee can identify the cause(s)of the upset;

b. The permittedfacility was at the time being properly operated;

c. Tbe permittee submitted notice ofthe upset as required in Part 11.1.; and

d. The permittee complied with any remedial measures required under Part H.^.

W. Inspection and Entry

The permittee shall allow me Director, or an authorised representative, upon presentation of credential other documents as may be required by law,to:

1. Enterupon the permittee's premises wherearegulated facility or activity is located or conducted, or where records must be kept underthe conditions ofthis permit;

2. Have access to and copy,at reasonable times, any records mat must be kept underthe conditions of this permit;

3. mspect at reasonable times anyfacilities, equipment (mcluding monitoring and control equipment), practices, or operations regulated or required under this permit; and

4. sample or monitor atreasonahletimes,forthe purposes of assuring permit compliance or as otherwise authorized by the CleanWater Act and the ^tateWaterControlEaw,any substances or parameters at any location.

Tor purposes ofmis section, me time for inspection shall be deemed reasonable during regular business hours, and whenever thefacility is discharging. Nothing contained herein shall make an inspectionunreasonable during an emergency.

^ Permit Actions

Permitsmaybemodified, revoked and reissued, orterminatedforcause. Thefil ingof arequestby the permitteeforapermit modification, revocation and reissuance,ortermination,oranotificationof planned changes or anticipated noncompliance does not stay any permit condition.

YD Transfer of permits

1. Permits are not transferable to any person except after notice to me Department. Except as provided in Part Ii.Y.2.,apermit may be transferred by the permittee toanew owner or operator only i f the permit has been modified orrevoked and reissued, oraminor modification made, to identifythe new permittee and incorporate such omer requirements as may be necessaryunderme State Water ControlEaw and the dean Water Act.

2. As an alternative to transfers under Part i i .Y . l . , this permit may be automatically transferred toan^ permittee if:

a. The current permittee notifies me Department at least 30 days in advance ofthe proposed tran the title to thefacility or property;

b. The notice includesawritten agreement between me existing and new permittees containinga specific dateforttansferofpermitresponsibility,coverage, and liability between m^

c. The Board does not notify me existing permittee and the proposed new permittee ofits intent to modify or revoke and reissue the permit, ffthis notice is not received, the transfer is effective on the date specified in the agreement mentioned in Part il.Y.2.b.

^ Severability

The provisions of thispermit are severable,andif any provision of this permitor the applicationof any provision of this permit to any circumstance is held invalid, the application of such provision to other circumstances, and me remainder ofthis permit, shall not be affected thereby.
