Effective October 1, 2006 through September 30, 2O1 0:

After one (1) year of continuous service, one (1) week of vacation After two (2) years of continuous service, two (2) weeks of vacation.

After four (4) years of continuous service, three (3) weeks of vacation After seven (7) years of continuous service, four (4) weeks of vacation After ten (10) years of continuous service, five (5) weeks of vacation And for employees with date of hire dates prior to and including November 30, 2002, after fifteen (15) years of continuous service; six (6) weeks of vacation.

Length of service includes the whole span of continuous service with, the present (successor) contractor whenever employed and with the predecessor in the performance of similar work at the same Federal facility. Time worked will be construed to include hours paid for holidays and sick leave. In the event the employee elects to not take vacation time, vacation pay will not accrue to the following year’s vacation pay. Vacation time may not be rolled over from year to year or taken back to back.

Effective October 1, 2008 through September 30, 2010:

The employee will receive vacation pay through a lump sum payment on their anniversary date.

Effective October 1, 2008 employees must submit their request for vacation time by their anniversary date for all vacation accrued and. available from the previous anniversary year per their seniority as stated in the table above. There shall be no pay out in lieu of taking vacation time, Time off should be taken by the employee’s next anniversary date. For contract year beginning October 1, 2008, employees must submit their request for vacation time by October 1, 2008 for all vacation accrued and available as of that date. Any vacation accrued after October 1, 2008 will be paid out on the employee’s next anniversary date.

Temporary layoffs and leaves of absence during the year will not interrupt the continuity of service for purpose of eligibility for vacation. Such layoffs and leaves of absence shall, however, be counted toward the required year for each vacation period.

Vacation pay shall be calculated per Article 20, Section E, (Vacation) of the Collective Bargaining Agreement covering Food Service Workers between Sodexo Management inc., and the United Industrial Workers at Marine Corps Mess Halls (CONUS) in effect from October 1, 2008 through September 30, 2010.

Applicable to New Hires Vacation will begin to accrue, or accumulate, from your first day of work. Vacation leave accrues while you are actively at work, or on paid vacation, sick, or holiday leave. Vacation leave is not available for you to use or be paid out until your first service anniversary date.

Your accrued vacation leave is held in two vacation leave accounts-un vested vacation leave and vested vacation leave. The balance in each of these accounts will appear on your paycheck stub every payday. The vacation leave you accrue each pay period is placed in your unvested vacation leave balance. Unvested vacation leave is not available for you to use or be paid out until your service anniversary date.

After your service anniversary date, all leave accrued during the year transfers to your vested vacation leave balance and will be paid out in a lump sum payment.

Your vacation benefits are based on the number of hours you are at work (hours submitted to payroll) up to 2,080 per year. An anniversary year is the twelve consecutive months following your most recent service anniversary date.

Vacation accrual rates vary depending on your seniority date. If your vacation accrual rate increases, you will immediately begin to accrue unvested vacation leave at the new increased vacation leave accrual rate. You will be paid out the additional vacation leave after your unvested vacation leave transfers to your vested vacation leave balance on your most recent service anniversary date.

Prorated Accruals If the number of total hours you work during a service anniversary year is less than 2,080 (40 hours x 52 weeks), you will accrue a prorated portion of the full vacation benefit.

Exarnpjc~ If you are eligible to accrue 80 hours (10 days) of vacation per your seniority date:

40 hours x 52 weeks = 2,080 hours worked per year 2,080 hours x .03850 (80 hour accrual rate) = 80 hours of vacation leave If you work only 35 hours each week, you would accrue only 70 hours of vacation:

35 hours x 52 weeks 1,820 hours worked per year 1,820 hours x .03850 (80 hour accrual rate) 70 hours of vacation leave To earn the maximum vacation accrual of 80 hours, you would need to work at least 2,080 hours (a 40-hour week) in your service year.

Accruing Vacation Leave While Away from Work on Disability or Workers Compensation You will not accrue vacation if you are receiving payments through a disability plan or workers compensation.

Unvested Leave Each pay period, accrued vacation leave is added to your unvested vacation leave balance.

The amount of vacation leave is determined by the number of hours that you work multiplied by your vacation accrual rate.

(Hours paid x accrual rate accrued vacation leave)

The vacation leave held in your unvested vacation leave balance is not available for you to use or be paid out until:

G Your service anniversary date The day you return to work if you are on a Leave of Absence on your service anniversary date

Your vested leave balance will appear as vested vacation on the paystub the week following your vesting date.

If you are on a Leave of Absence on your service anniversary date or unit vesting date, your unvested vacation leave will become vested when you return to work and receive your first paycheck.

Carry-over of vacation leave is not permitted on government contracts due to the liability of a successor contractor if and when the contract is awarded to another contractor. The employee is made whole for all vested vacation earned with the current employer at the time the employee vests.

Payout of Unvested Vacation Upon Separation Unvested vacation leave is forfeited upon termination, with the exception of employees who:

Retire between the ages of 55 and 59, and have at least 10 years of continuous service.

are separated because of a permanent disability, regardless of length of service.

are separated because of death regardless of their length of service, and are separated due to lack of work, and have at least 6 months of service.

Employees who meet these exceptions will be entitled to both vested and unvested vacation lèavè upon termination.

Appendix E: Holidays

Effective October 1, 2006 through September 30, 2010

1. New Year’s Day 7. Labor Day

2. Martin Luther King Jr’s Birthday 8. Columbus Day

3. President’s Day 9. Veteran’s Day

‘~4. Good Friday 10. Thanksgiving Day

5. Memorial Day 11. Christmas Day

6. Independence Day

The Employer may substitute for any of the named holidays another day off with pay in accordance with a plan communicated to the Employees involved.

Employees will receive holiday pay equal to the greater of (1) the amount computed using the formula set forth in Article 22, Section B (Holidays) of the Collective Bargaining Agreement covering Food Service Workers between Sodexo Management Inc. and the United Industrial Workers at Marine Corps Messhalls (CONUS) in effect October 1, 2008 through September 30, 2010, or (2) the actual number of hours a given employee actually worked on a particular holiday times his base rate of pay.

Appendix F: Uniforms and Footwear

Effective October 1, 2006 through September 30, 2010 The Contractor will supply each Stock Clerk employee with one (1) pair of Steel Toe Safety Shoes annually (depending on wear and tear.) The shoes are valued at $59.98 per pair. The Steel Toe Safety Shoe shall be worn during working hours only.

Appendix G: Sick Leave

Effective October 1, 2006 through September 30, 2010 After one (1) year of continuous service each Employee shall accrue sick leave at the rate of seven (7) days per year. Time worked will be construed to include hours paid for holidays, vacations and sick leave but not to exceed forty (40) hours in anyone (1) week.

Sick leave benefits shall not accumulate from year to year. All unused sick leave pay will be paid in cash to Employees at the end of each contract year (Sodexo’s contract year for the Marine Corps Messhalls - CONUS).

An Employee who resigns from employment shall be paid for all unused sick leave. Employers will accrue sick leave on a pro-rata basis. Pro-rata means that an employee will accrue sick leave on the basis of actual paid hours during the year divided by 2,080 (the full time equivalent number of hours). The calculation is made on the basis of “paid” as opposed to “worked” hours in order to keep from penalizing employees: for taking their allocated vacation, holiday’, or sick leave days. Employees are paid for these vacation and sick days and will receive credit for them in the number of the above fraction. Once developed, this fraction is the multiplied by the appropriate number of days (eight (8) hours per day) as set forth above to arrive at the. total amount of accrued sick leave pay due to a particular employee.

Appendix H: Bereavement

Effective October 1, 2006 through September 30, 2010 The Employer and the Union agree that for purposes of the bereavement benefit for food service workers and maintenance employees at Quantico covered by this agreement, this local addendum definition of “immediate family” supersedes definition of “immediate family” in Article 13, Section A (Bereavement Leave) of the Collective Bargaining Agreement covering Food Service Workers between Sodexo Management Inc. and the United Industrial Workers at Marine Corps Messhalls (CONUS) in effect October 1, 2008 through September 30, 2010.

In instances of the death of a member of the employee’s immediate family, the employer will grant a paid bereavement leave up to three (3) days per death. An employee will be granted up to a maximum of nine (9) bereavement leave days per year.

Such employee will be required to give proper notice to the Employer in any event, in order that the employer may obtain a temporary replacement.

An employee taking leave under this section shall provide appropriate evidence of death upon request of the employer.

Effective October 1, 2006 through September 30, 2010:

The term “immediate family” shall mean only the following: mother, father, sister, brother, spouse, child, father-in-law, mother-in-law, brother-in-law, sister-in-law, grandparent, grandchild.

Employer will grant a paid bereavement leave of one (1) day per death for the death of the employee’s aunt or uncle.
