JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
A procurement activity must justify its action when restricting consideration and competition.
Brand-Name / Limited Source Justification for Other Than Full and Open Competition I recommend other than a competitive effort for the acquisition of the following supplies or services. If deemed necessary, negotiations will be conducted with the indicated proposed supplier. This acquisition is not subject to FAR 6. However, an ordering activity must justify its action when restricting consideration and competition.
This requirement is conducted under the authority of:
FAR 8.4 – Required Sources of Supplies and Services (Multiple Award Schedule Program (FAR 8.405-6(g)(1)))
• Within 14 days after placing an order or establishing a BPA, post for minimum of 30 days on GPE.
FAR 13 – Simplified Acquisition Procedures (SAP)
• Post brand-name justification IAW 5.102(a)(6).
FAR 13.5 – Simplified Procedures for Certain Commercial Products and Commercial Services
• Make publicly available within 14 days after contract award or in the case of unusual and compelling urgency within 30 days after contract award on GPE.
• Brand name justifications with the solicitation, IAW FAR 5.102(a)(6) on GPE.
FAR 16 – 16.505(b)(2) Exceptions to the fair opportunity process.

Only One Responsible Source Only one source is capable of responding due to the unique or specialized nature of the work (explain what makes this contractor the only responsible source.)
Logical Follow-On The new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures.
The original order must not have been previously issued under sole source or limited source procedures.
X_ Peculiar to One Manufacturer The item is peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
Urgent and Compelling An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays.
JUSTIFICATION
1. A description of the supplies or services required to meet the agency’s needs.
EXIM currently uses DB Textworks, an archives catalog that is no longer being supported by the vendor, Lucidea Technologies. An archives catalog is a structured database that stores descriptive records of archival materials. EXIM requires a modern archives catalog. Lucidea’s new generation archives catalog, ArchivEra, will replace the old platform.
The EXIM Archives collection contains approximately 8,222 print materials and more than 1,500 audiovisual items dating back to 1934 and serves as the official system of record documenting EXIM’s institutional history. Research & Information Services (RIS) librarians rely on the archives catalog to catalog, manage, preserve, and retrieve these materials in support of internal research, policy analysis, and reauthorization activities.
2. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
Lucidea Technologies (US) Corp. is uniquely qualified and the only responsible source capable of providing the required ArchivEra services. Lucidea is the sole authorized U.S. supplier of the ArchivEra application and all related services, including SaaS hosting, software updates, technical support, maintenance, and system migration. Lucidea Technologies Corp. retains exclusive ownership of, and all intellectual property rights to, the ArchivEra application.
Lucidea is the only vendor with authorized access to the proprietary software that runs both the legacy environment currently in use and the successor platform being implemented, and therefore the only entity capable of performing the required system migration while ensuring data integrity, continuity of operations, and preservation of archival metadata.
As shown above, Lucidea has supported EXIM’s archival systems for nearly two decades and possesses extensive knowledge of EXIM’s archival structure and operational requirements. While incumbent experience is not the basis of this justification, it further reduces implementation risk and supports Lucidea’s ability to successfully perform the required services without the substantial cost duplication that would result from developing an alternate platform. As such, only the replacement Lucidea platform can be considered for this acquisition.
3. A determination by the ordering activity contracting officer that the order represents the best value.
It is determined that this acquisition represents the best value to EXIM Bank as it will avoid duplication of cost associated with 1.) having a new vendor develop a new platform, and 2.) executing a migration to said new platform.
4. A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted
Market research was undertaken, however, no alternatives in the form of a readily available platform, were identified.
5. Any other facts supporting the justification.

6. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
Competition will be sought on future requirements, and if other databases emerge or are identified, these sources/platforms will be considered as such.
7. Evidence that any supporting data that is the responsibility of technical or requirements personnel (e.g., verifying the Government’s minimum needs or requirements or other rationale for limited sources) and which form a basis for the justification have been certified as complete and accurate by the technical or requirements personnel.
Applicable technical and/or requirements personnel fully participated in the requirement development process, and have verified all information herein to form the basis for this justification.
