106 - Acceptance of Work

Delete Subsection 106.01 and replace with the following:

106.01 Conformity with Contract Requirements

Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is stricter.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove, repair, or replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted. Removing, repairing, or replacing work; providing temporary traffic control; and any other related work to accomplish conformity will be at no cost to the Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

1) Sampling method;

2) Number of samples;

3) Sample transport;

4) Test procedures;

5) Testing laboratories;

6) Reporting;

7) Estimated time and costs; and

8) Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third-party laboratory. Use a third-party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute.

The CO will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol.

If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

1) Have the work accepted at a reduced price; or

2) Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

Delete Subsection 106.02 and replace with the following:

106.02 Visual Inspection

Acceptance is based on visual inspection of the work for compliance with the specific contract requirements.

Use prevailing industry standards in the absence of specific contract requirements or tolerances.

107 - Legal Relations and Responsibility to the Public

107.05 Responsibility for Damage Claims

Delete the entire subsection.

107.10 Environmental Protection

Add the following:

Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.

Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill.

Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information. Immediately notify the CO of all hazardous material spills. Provide a written narrative report form no later than 24 hours after the initial report and include the following:

(a) Dam Excavation and Embankment. This work consists of excavation of portions of the existing south dam embankment approximately as shown in plans, replacing select borrow material salvaged from the excavation, and mining and importing select borrow from the designated borrow area as required to get the embankment dam up to design grade. Dam embankment excavation at the South embankment shall be conducted so that material is removed as a mass excavation – approximate extents of the excavation are shown on the grading plan. The contractor shall excavate down to competent bedrock as directed by the CO and remove any deleterious or overly wet materials within the excavation limits. Estimated construction surfaces are shown on the cross sections within the design plans. The work also includes importing select borrow material and raising the north embankment as outlined in the plans. This work also includes foundation earthwork and preparation, filter sand placement, pipe placement, and miscellaneous grading, earthwork, and compaction required for the embankment construction.

This work also consists of removal of miscellaneous debris and unsuitable material encountered during excavation of the existing south embankment. It is anticipated the contractor will have to remove most material in the regions where excessive seepage has been noted on the Drawings. The extents of material to be removed will be reviewed and approved by the CO as the work progresses. This work also consists of the salvaging and placement of native streambed gravel to fill the voids of the rock riprap pad at the downstream end of the outlet pipe.

This work also includes reclamation of the designated borrow area.

Material

204.03 Add the following:

Dam embankment fill shall consist of Select Borrow per Section 704.07.

Filter sand shall meet the requirements of Section 703.01.

Rock infill and riprap filter gravel shall meet the requirements of Section 703.03

Construction Requirements

204.07 Subexcavation

Add the following:

Portions of the existing embankment material shall be excavated as shown on the Drawings. The existing embankment material shall be stockpiled on-site and select material shall be re-used as embankment fill per Section 704. Potentially hydrocarbon-impacted soils may be encountered during excavation of the south dam.

Refer to FSSS 650 for the action to be taken if hydrocarbon-impacted soils are encountered. The CO shall be allowed to witness the foundation conditions to ensure that the designated portions of the existing embankment fill have been removed down to native, competent bedrock, and that the existing foundation is a stable, dense material compacted per Subsection 204.11. If overly moist, soft, or otherwise unsuitable foundation material is encountered, that material should be over-excavated down to adequate foundation soils and the over-excavated material placed within the designated borrow area.

204.08 Borrow Excavation

Add the following:

Government-furnished select borrow will be required to supplement the excavated embankment soils as specified in Section 704. The designated borrow area is specified in Section 105.02. Prior to mining the material, topsoil shall be stripped from the designated borrow area and temporarily stockpiled adjacent to the borrow area. Blend finished side slopes of the borrow area at 3H:1V or flatter slopes. The floor of the borrow area shall be gently sloped to allow run-off to drain to the existing roadside ditch and proofrolled to ensure a dense, unyielding condition. Conserved topsoil as specified in Section 105.02 shall be replaced evenly on side slopes of the borrow area and slopes shall be hydroseeded as specified in Section 625. Do not stockpile woody debris or cleared and grubbed material within the borrow area.

204.10 Embankment Construction

Add the following:

The construction of each lift shall be in a continuous, approximately horizontal layer for the full length and width of the dam embankment. Embankment material shall be mixed and blended to provide a homogeneous section. Provide primary water conditioning, mixing, and blending in stockpiles if necessary. Distribute the fill in any given zone and lift such that it is free from lenses, pockets, streaks, or layers differing in material type or texture or gradation from the surrounding fill.

204.11 Compaction

Add the following:

Equipment and Operation. Compaction equipment will be of suitable type and size adequate to obtain the material in-place densities specified in an efficient process in the judgment of the CO. The combination of compaction equipment weight and energy shall achieve a dense unyielding soil condition with 4 to 6 passes over compatible lift thicknesses of between 4 and 9 inches and with moisture content within 3% of optimum. A ride-on vibratory roller with either smooth or padded drum is suggested, and it is also suggested that the contractor demonstrate that their combination of equipment, lift thickness, material types, and number of passes achieves the specified dry density early in the compaction process to expedite production and confidence in the results. Contractor is welcomed to submit alternate equipment for review and approval by the CO. Compaction equipment shall be operated in strict accordance with the manufacturer's instructions and recommendations.

Equipment shall be maintained in such condition that it will deliver the manufacturer's rated compactive effort.

The loose lift thickness of the material placed should be appropriate for the compaction equipment being utilized, and the maximum loose lift thickness shall be 9 inches.

Provide hand-operated tampers equal to a Wacker model GVR100Y and lift thickness of no more than 5 inches for compacting against concrete surfaces and at locations where large compacting equipment cannot operate effectively. Compaction shall be performed in a way that ensures adjacent structures are not damaged during compaction. All materials shall be compacted to standards including in areas unsuitable for large equipment access. Additional compactive effort is anticipated in these areas.

Flathead National Forest

Dam Foundation Subgrade and Embankment Fill Requirements. The embankment foundation (native shale subgrade) shall be proof-rolled or compacted to a dense, unyielding condition to the satisfaction of the CO.

Compact all select borrow used as embankment fill in 9-inch thick (maximum) loose horizontal lifts to a minimum of 95% of the maximum dry density per AASHTO T-180 (modified Proctor). It may be necessary to adjust the moisture of the material to achieve the specified optimum moisture and compaction standard.

Additionally, each lift of select borrow used for the dam embankment shall be rolled for a minimum of 4 passes with a suitable compactor and lift thickness to achieve a dense unyielding condition and shall be tested for in-place density before placement of the next lift.

Seepage areas below toe and chimney drains shall be backfilled with filter sand and lightly compacted up to said drains to provide an outlet for the seepage.

The Contractor shall protect the embankment fill lifts from drying, freezing, or over-wetting during construction. Any areas that form shrinkage cracks or a hard crust should be scarified, watered, and recompacted before placing the next lift to ensure adequate bonding to subsequent lifts. If standing water or ponding occurs, the Contractor shall adequately dry the material before placing the next lift. Frozen materials or snow-contaminated materials shall not be used within the embankment and areas to be filled should be protected from freezing.

Density Testing and Inspection. The Contractor shall engage a qualified independent geotechnical engineering testing agency to perform field quality-control density tests. The CO will require the Contractor to measure the degree of compaction (field density) during embankment construction at the rate specified in the table below. Measurements will be based on optimum moisture contents and maximum density curves submitted prior to construction. Field or in-place density refers to the dry density expressed in pounds per cubic foot of a layer of compacted material in place at the site as determined by a sample representative of the compacted layer. Frequency of testing beyond the requirements outlined here is at the discretion of the CO. All compaction testing results shall be furnished to the CO within 48 hours.

Compacted materials shall also meet the performance specifications discussed previously and summarized in the table below.

(1) Boulders shall be placed on the upstream face of the finished embankment for wave protection. If there are not enough boulders to protect the entire upstream face, boulders shall be prioritized for beach and water access areas, and Class 1 riprap shall be used as needed for remaining areas as approved by the CO.

(2) Class 2 riprap shall be placed at the erosion control pad at the discharge of the outlet pipe.

Riprap filter/bedding gravel is incidental to this pay item.

Material

251.02 Add the following:

Boulders shall be reclaimed from the existing shoreline and site area. Boulders shall have a minimum diameter of 2.5 feet. An estimated 200 linear feet of qualified boulders are available for reuse based on aerial drone imagery. Contractor shall verify amount of qualified boulders before procuring Class 1 riprap.

Class 1 and Class 2 riprap shall meet the requirements of Section 705. Other gradations may be acceptable, as approved by the CO.

Filter/bedding gravel shall meet the requirements of Section 704.10. Required filter/bedding gravel quantity is estimated at 350 CY based on the following:

• 40% coverage of upstream dam face riprap area (Drawings Sheet 5) using boulder detail on Drawings Sheet 7, where the estimated cross-sectional area of gravel is taken as the average of the actual area shown on Sheet 7 and a conservative “boxed” area of the boulder section (Sheet 7), subtracting the boulders (estimated 3-ft average diameter).

• 60% coverage of upstream dam face riprap area (Drawings Sheet 5) using Class 1 riprap, with a depth of 1 foot of bedding gravel and an additional 1 foot of gravel on top of placed riprap per FSSS 215.03.

• Class 2 riprap area (Drawings Sheet 15) with a depth of 1 foot of bedding gravel and an additional 1 foot of gravel on top of placed riprap per FSSS 215.03.

Boulders shall be placed in two or three rows parallel to the shore. Boulders within each row shall be tightly spaced. The horizontal distance between rows of boulders can be variable and field-fitted to the site to maintain an approximate 3H:1V overall. Additional filter/bedding gravel shall be placed roughly level between boulder rows at an elevation no lower than the top elevation of the lower row of boulders.

Elevations of boulders shall be as follows:

a) The top row of boulders should have a top elevation at least 3 feet above normal pool elevation, which means the top elevation of the top row of boulders must be at least 3469 feet. The top row of boulders shall be excavated into the embankment so that the top elevation protrudes at least slightly above the finished embankment slope.

b) For two adjacent rows of boulders, the bottom elevation of the upper row of boulders shall be a minimum of 12 inches below the top elevation of the lower row of boulders. In other words, the lower row of boulders must have a top elevation at least 12 inches higher than the upper row’s base elevation.

c) The lowest row of boulders should have a base elevation at least 2 feet below normal pool elevation, which means base elevation of the lower row of boulders must be 3464 feet or lower.

If only two rows of boulders are used, the boulders in the upper row must have a minimum diameter of 3 feet to meet the above criteria.
