About this file

This document is a Sole-Source Determination and Justification form from the Oregon State Police (OSP) Department for procuring a LEEDS LCFS Comparison Microscope. The document justifies the direct purchase of a fourth microscope for the state forensic laboratory, citing the need to increase analytical capacity and maintain consistency in forensic ballistics work. The estimated total contract value is $200,000, with the procurement being pursued under Oregon Administrative Rule (OAR) 125-246-0170(2)(c)(H), and the purchase is intended to address a current operational bottleneck caused by having only three microscopes for four working analysts.

The sole-source justification is supported by market research demonstrating that the LCFS3 microscope is not available through mandatory price agreements or authorized resellers, and the manufacturer (LEEDS) has provided a letter confirming they do not offer their products through distribution channels. The document emphasizes the compatibility and efficiency of purchasing an identical fourth microscope, which would maximize instrument management and ensure consistent analytical results in critical forensic casework. The procurement aims to enhance the state police's ability to compare forensic evidence, particularly in gun-related investigations, without changing the existing technological platform.

SOLE-SOURCE DETERMINATION AND JUSTIFICATION

FOR SUPPLIES AND SERVICES for Agency approval up to $250k

To: Designated Procurement Officer Department of State Police

From: OSP Procurement/

Designated Procurement Officer: Robert Johnson, DPO

Agency Analyst/Procurement Specialist: Rachel Meyer-Kittson

Date: May 1st, 2025

Re: Sole Source Determination pursuant to Oregon Revised Statute (ORS) 279B.075 and Oregon Administrative Rule (OAR) 125-247-0275

Part A

1. Authority to enter into a Sole-Source Contract: OAR 125-246-0170(2)(c)(H)

2. Estimated Total Value of Contract: $200,000

3. Subject of Contract: LEEDS LCFS Comparison Microscope

4. Background:

These scopes are an essential tool in the workflow of the analysts in their comparison methodology. It is a split screen microscope that enables the analyst to see, side by side simultaneously, two objects. With this device, an unknown (for example bullet from a crime scene) can be placed next to a known (for example bullet from the test fire of a gun), and viewed for direct comparison of microscopic detail (example grooves in the bullets) to determine if the two objects were fired from the same gun (“identifying source”). It is, in fact, the workhorse tool of the methodology that enables vital associations to be made in combatting gun violence throughout the state. Currently we have three, but with four working analysts, this creates a potential bottleneck in our operations that artificially limits our productivity potentially jeopardizing prosecution of dangerous offenders.

5. Findings:

Brand name has been determined on a separate document.

A. Market Research Overall Finding.

After considerable market research, the LCFS3 is not available for sale through our mandatory price agreements or any authorized re-seller.

The manufacturer (LEEDS) has provided a Sole Source letter explaining that they do not offer their products through distribution.

And

B. Findings of Fact pursuant to OAR 125-247-0275(2) must include, at a minimum, one of the following:

Sole-Source Determination_rev01-31-24 Page 2 of 2

1. Pursuant to OAR 125-247-0275(2)(a): Compatibility. Provide findings supporting your determination that the efficient utilization of existing goods requires the acquisition of compatible goods or services from only one source.

We currently have three identical scopes. Purchasing an additional fourth would maximize our instrument management (calibrations, maintenance, usage, care) by only increasing our capacity without changing the platform and/or technology. As these are used for casework, there would be, additionally, a consistency of analytical results that is a critical element of the workflow, in visual capacity, depth of field, lighting capability, and resolution.
