About this file

This is a Brand Name Specification Determination document from the Oregon State Police (OSP), dated May 1st, 2025, requesting the acquisition of a LEEDS LCFS Comparison Microscope for forensic analysis purposes. The document justifies the procurement of a specific brand microscope to address a capacity limitation in their current forensic workflow, with the total estimated cost of $99,549. The microscope is a critical tool for bullet comparison methodology, enabling analysts to simultaneously view and compare two objects side-by-side, which is essential for determining if bullets are from the same gun in criminal investigations.

The procurement is driven by operational needs, as the agency currently has three identical microscopes and four working analysts, creating a potential bottleneck in their operations. The brand-specific purchase is justified by the ability to maximize instrument management, maintain consistency in analytical results, and leverage existing maintenance agreements without requiring additional calibration or training adjustments. The document cites specific administrative rules (ORS 279B.200-215 and OAR 125-247-0691) to support the brand-specific procurement, and it was approved by the Delegated Procurement Officer on May 1st, 2025.

DETERMINATION

Brand Name Specification

1. Agency Name: Oregon State Police

2. Date: May 1st, 2025 3. Agency Number: 25700

4. Agency Contact Name: Rachel Kittson 5. Phone: 971-372-4634

6. Total Estimated Cost: $99549

7. Brand Name to be Acquired: LEEDS LCFS Comparison Microscope

8. Background: Efficient utilization of existing Supplies/Goods requires the acquisition of compatible Goods or Services. These scopes are an essential tool in the workflow of the analysts in their comparison methodology. It is a split screen microscope that enables the analyst to see, side by side simultaneously, two objects. With this device, an unknown (for example bullet from a crime scene) can be placed next to a known (for example bullet from the test fire of a gun), and viewed for direct comparison of microscopic detail (example grooves in the bullets) to determine if the two objects were fired from the same gun (“identifying source”). It is, in fact, the workhorse tool of the methodology that enables vital associations to be made in combatting gun violence throughout the state. Currently we have three, but with four working analysts, this creates a potential bottleneck in our operations that artificially limits our productivity potentially jeopardizing prosecution of dangerous offenders.

9. Findings that satisfy the required standards based on one or more of the following (a-d) pursuant to

OAR 125-247-0691(2).

Agency determines that:

(a) Use of a Brand Name Specification is unlikely to encourage favoritism in the awarding of Public Contracts or substantially diminish competition for Public Contracts because:

(b) Use of a Brand Name Specification would result will result in substantial cost savings to the contracting agency because:

The maintenance of the new scope would immediately fall under the existing agreements in place for the additional three without consideration of adjustment, including calibration of the measuring capacity, training for use, and upkeep.

(d) Efficient utilization of existing Supplies/Goods requires the acquisition of compatible Goods or Services because:

We currently have three identical scopes. Purchasing an additional fourth would maximize our instrument management (calibrations, maintenance, usage, care) by only increasing our capacity without changing the platform and/or technology. As these are used for casework, there would be, additionally, a consistency of analytical results that is a critical element of the workflow, in visual capacity, depth of field, lighting capability, and resolution.

PART B. Law and Rule, Authority and Approval of Brand Name Specification.

STATUTE AND RULE: ORS 279B.200-215 and OAR 125-247-0691

AUTHORITY TO APPROVE BRAND NAME SPECIFICATIONS: OAR 125-246-0170 (2)

FINDINGS: The findings are accepted, adopted, and incorporated by reference herein.
