About this file

This document is a comprehensive solicitation for the Lock & Dam 7 Outdraft Modification project, detailing construction requirements for modifying an existing rock weir at Lock and Dam No. 7, located near La Crescent, Minnesota. The project involves notching and modifying the existing rock weir constructed between 2018-2020, with work to be performed upstream of the existing structure along the Mississippi River. The construction will include creating a dog-leg weir structure approximately 725 feet in length, with three notches at the downstream end to facilitate sand movement and improve navigation efficiency.

The solicitation (W912ES25BA001) is a small business set-aside contract with an estimated value between $5-10 million, classified under NAICS code 237990 with a small business size standard of $45 million. The work will be executed by the U.S. Army Corps of Engineers St. Paul District and is scheduled for completion by May 2025. Key technical requirements include constructing a weir with a top elevation of LCP+1, a 5-foot wide top, side slopes of 4H:1V for the top 3 feet and 3H:1V for the remainder, and notches at the bottom with an elevation of LCP-12. The project aims to mitigate the outdraft current that makes lock navigation challenging for vessels traveling in both directions.

3.2.1 Restoration of Damaged Trees

Any existing tree designated to be protected that is damaged by the Contractor's operations must be replaced. Trees will be considered damaged if the critical root zone in cohesive soils is compacted, if there are significant wounds that could contribute to rot, or if distress (evident by reduced growth or other observations of distress documented by a forester) is observed prior to closing the contract. Trees must be replaced in kind on a caliper inch per caliper inch basis (DBH) (e.g. one 6-inch red oak must be replaced with two 3-inch red oaks, three 2-inch red oaks, or six 1-inch red oaks). Replacement tree size and location will be determined and staked by the Contracting Officer. Repair by pruning, aeration, soil conditioning, or other recommendation from a qualified forester will be considered by the Contracting Officer for substitution for replacement.

3.3 CONTRACTOR PROPOSED BORROW AND DISPOSAL AREAS

Any borrow and/or disposal sites proposed by the Contractor that are not already identified by the Government as approved for this project are subject to approval by the Contracting Officer. This approval process may require the Government to prepare an environmental assessment at no cost to the Contractor. This may require additional review time and may result in additional requirements to offset environmental effects associated with the use of the site. Proposed sites which involve the excavation or placement of material within a cultural site, wetland, wooded area, floodplain, or other environmentally sensitive area will not be approved.

3.4 EAGLE NEST EXCLUSION ZONE RESTRICTIONS

Active eagle nests may be present in the project area. 1.2 COMPENSATION

The payment provided for in the contract must constitute full compensation for furnishing all materials and for performing all work under the contract in a complete and acceptable manner. The contract work must include providing bonds (performance and payment), plant, equipment, tools, supplies, labor, supervision, incidental materials, quality control, environmental protection, meeting safety requirements, and performing all work required for which separate payment is not otherwise provided. Compensation for all work shown, specified, or essential to completion of the project (whether or not the specific material or operation is indicated) must be included in the bid price. The payment provided for in the contract includes compensation for all risk, loss, damage, and expense arising out of the nature of the work or its prosecution, subject to conditions of the contract. Payment for each contract line item will constitute full compensation for furnishing the materials and constructing the work complete in place as specified.

All costs for items of work, which are not specifically mentioned to be included in a particular job or unit price payment item, must be included in the item most closely associated with the work involved. It is the responsibility of the Contractor to conform bid pricing in accordance with FAR 52.214-19(d) and 52.232-5, ensuring pricing is not materially unbalanced and that the prices presented for each line item or subline item accurately reflects the work effort associated with those items, inclusive of overhead costs.

1.3 APPROVAL OF MATERIALS OR ALTERNATES

Requests for approval of materials and products, or substitutes thereof, will not be considered prior to award of the contract.

1.4 QUANTITY SURVEYS

Provide quantity surveys for bulk materials measured by volume or weight, unless an alternate method of measurement is specified. Quantity surveys

04/30/25 SECTION 01 22 00.00 10 Page 2 are specified in Section 01 71 23.05 13 CONTRACTOR SURVEYS.

1.5 MEASUREMENT BY WEIGHT

Stone will be measured for payment by the ton as determined by barge displacement, certified railroad weights, where direct placement into structure(s) is practicable, or by weighing by the truckload on approved scales meeting the truckload requirements.

1.5.1 Truckload or Railcar

Bulk materials paid for by weight will be measured by weighing each truck load or rail car on an approved scale before being placed in the work.

Scales must be of sufficient length to permit simultaneous weighing of all axle loads and must be sensitive to a change in load of 0.2 percent throughout the range of the scale. The scale's accuracy must conform to the applicable requirements of NIST HB 44 and must be certified by a scale servicing company or by an inspector of the State Inspection Bureau. Each load must be accompanied by a delivery ticket certified by the weighmaster. Delivery tickets must be collected by the Contractor, and copies thereof must be furnished to the Contracting Officer. As a minimum, each ticket must contain the following information:

(1) Date and time.

(2) Vehicle or car number.

(3) Gross weight.

(4) Vehicle or car tare weight.

(5) Net weight.

(6) Job total for material weighed.

(7) Signature of weighmaster.

(8) Signature of Contractor's receiver.

1.5.2 Barge Load

Measurement by barge may be acceptable only if the rock is loaded onto barges at any location other than the Lock and Dam No. 7 (LD7) loading dock.

If material is delivered by barge, stone will be measured for payment by weight determined by barge displacement. Furnish the Contracting Officer a barge displacement table not less than 10 work days prior to unloading the stone from any barge. Submit each table showing the name and/or number of the barge owner, the name of the fabricator, and the certification and date of certification of the person or firm preparing the table. Furnish with the barge displacement tables a drawing or sketch of each barge, dimensioned in sufficient detail to permit checking of the tables. Show, as a minimum, the length, width, depth of the barge, and dimensions of the rake or rakes. A person or firm customarily performing this function other than the Contractor must certify the accuracy of each such table. Submit each table containing, in parallel columns, the freeboard of the barge in feet and tenths from zero to the full depth of the barge and the corresponding gross displacement to the nearest ton. Mark each barge suitably with three displacement gaging locations on each side near each end of the barge and two amidships on opposite sides. Mark each gaging location by a line perpendicular to the edge of the barge, 4 inches wide and 1 foot long, on both the deck and side of the barge and two amid ship on opposite sides. Provide barges with rakes that have the displacement gaging lines placed at each corner of the box section between the rakes.

If a barge has a box end or ends, place the gaging locations approximately

04/30/25 SECTION 01 22 00.00 10 Page 3

4 feet from the box end(s). The freeboard will be measured at the six gaging locations and the displacement determined by the use of "STANDARD BARGE TABLES" from the average of these measurements. The displacement will be determined before and after being unloaded and the difference between these values is the quantity delivered.

Load barges so that the readings taken at the gaging locations do not vary more than 1.5 feet fore and aft and do not vary more than 0.5 feet port to starboard. If such is not the case, trim the carrier by shifting the stone until this limit is reached, before the measurement will be accepted.

Determine the draft from the average of all six readings weighting the readings of the middle gage at double those of the end gages. (G1 + G2 + 2xG3 + 2xG4 + G5 + G6) divided by 8 = average draft. Ensure all carriers used in transporting stone are free of leaks such as would render accurate gauging difficult. Provide facilities for inspecting the hold of each carrier to determine whether leakage is occurring. Provide each carrier with adequate pumping facilities, and if water is found to be accumulating in the hold, pump the carrier dry before each gaging, both before and after unloading. Lightening by pumping or by transfer of crew or supplies will not be permitted while stone is being transferred. Leave rejected stone and unacceptable material aboard the barge until after the final readings are taken.

1.5.2.1 Barge Data, Sketch, and Calculations

Submit the gaging table data, stone hauling vessel information, gaging tables, and a copy of the barge data and table calculations used for the preparation of the tables in accordance with the barge load paragraphs above.

1.6 REMEASUREMENT

Where a loss of material due to stockpiling, rehandling, or hauling is possible, the Contracting Officer will have the discretion to require remeasurement prior to placement at no additional cost to the Government.

1.7 MEASUREMENT UNITS

When materials are measured in units other than the measurement units specified as the basis of payment, the measured quantities must be converted to the specified unit of measure. Factors for conversions from one basis or unit of measurement to another must be approved by the Contracting Officer.

1.8 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. The following must be submitted in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:
