About this file

This is a Labor and Material Payment Bond document required by the County of Orange, California for contractors awarded work on public improvement projects. The bond is mandated under California Civil Code Sections 9550 et seq. and must be furnished by the contractor in connection with the awarded contract for Sidewalk, Curb & Gutter and Spandrel Grinding services. The bond amount must equal not less than the estimated amount payable by the County under the contract terms. The bond protects the County and all persons, companies, and corporations entitled to file claims under California Civil Code Section 9100, ensuring payment for materials, labor, supplies, equipment, and machinery used in contract performance, as well as amounts due under the Unemployment Insurance Code.

The penal sum of the bond and specific contract details are to be completed at the time of award. The surety company must be duly authorized to conduct business in California. The bond obligates the contractor and surety to pay claimants for unpaid labor and materials, with the surety waiving notice of any changes, extensions, or alterations to the contract terms or specifications. If suit is brought against the bond, the surety is liable for the face amount plus costs, reasonable expenses, and attorneys' fees incurred by the County in enforcement. The document requires execution by authorized corporate officers per California Corporations Code Section 313, with signatures from specified company representatives and approval by the County's Risk Management and Office of County Counsel.
