Labor and Material Payment Bond Summary

This is a Labor and Material Payment Bond template issued by the City of Beaverton, Oregon, for the Wilson Drive & Wilson Avenue Waterline Replacement project. The bond serves as a financial guarantee for a water infrastructure construction project involving the installation of approximately 3,400 linear feet of new water main, comprising 2,700 feet of 8-inch pipe, 500 feet of 6-inch pipe, and 200 feet of 4-inch pipe, along with associated hydrant and service line replacements in a residential neighborhood located along SW Wilson Drive, SW Wilson Avenue (from SW Wilson Court to SW Hart Road), and a section of SW 139th Avenue. The bond protects the City and all claimants—including laborers, material suppliers, and subcontractors—by guaranteeing payment for work performed and materials supplied under the construction contract.

The bond amount is subject to completion of the contract work plus any extra orders issued by the City. Claimants have 90 days following completion of their work or material delivery to pursue payment, and must file written notice within 180 days (or 200 days for employee benefit plan contributions) to preserve their claim rights. Any lawsuit must be filed within two years of the claimant's last provision of labor or materials and can only be brought in the Circuit Court of Washington County, Oregon or the United States District Court for the District of Oregon. The surety waives notice of any contract modifications, time extensions, or specification changes and agrees that such changes do not affect its obligations under the bond. The bond amount is reduced by any payments made in good faith, including payments for any recorded mechanics' liens.
