About this file

This is a Labor and Material Payment Bond document required by the City of Beaverton, Oregon for the SW Juniper Terrace Waterline Improvements project. The bond guarantees payment to all claimants, including laborers, material suppliers, and subcontractors, who provide work or materials for the construction contract. The bond amount equals the contract value plus any extra orders issued by the City. The project involves replacing approximately 3,500 feet of aging water infrastructure, including 8-, 6-, and 4-inch water mains, residential service lines, and hydrants throughout the Juniper Terrace neighborhood. This replacement is necessary because the current infrastructure dates to the 1960s and has reached the end of its reliable lifespan.

The bond protects claimants by establishing their right to pursue payment through the bond if not paid within 90 days of completing their work or furnishing materials. Claimants must provide written notice to the Principal and City Finance Director within 180 days (or 200 days for employee benefit plan contributions) of last providing labor or materials, and any legal action must be filed within two years. Suit may only be brought in the Circuit Court of Washington County, Oregon or the United States District Court for the District of Oregon. The bond is subject to Oregon Revised Statutes Chapter 279C for public contracts. The surety waives notice of any changes, extensions, alterations, or additions to the contract terms or specifications, and the bond amount is reduced by any payments made in good faith, including payments for mechanics' liens.

b. Later than two years after the claimant last provided labor or materials.

c. Other than in the Circuit Court of Washington County, Oregon or in the United States District Court for the District of Oregon and not elsewhere.

The surety, for value received, hereby agrees that no change, extension of time, alteration, or addition to the terms of the contract or to the work performed thereunder or the specifications accompanying the same shall in any way affect its obligations on this bond, and it hereby waives notice of any change, extension of time, alteration, or addition to the terms of the contract or to the work or to the specifications.
