About this file

This is a Labor and Material Payment Bond document required by the City of Beaverton, Oregon for the Parkview Loop Waterline Replacement project. The bond secures payment obligations for all labor and materials used in the construction contract, which involves installing approximately 3,000 linear feet of new 8-inch water main and 1,500 linear feet of new 6-inch water main, along with associated hydrant and service line replacements in a residential neighborhood along SW Parkview Loop. The principal contractor and surety jointly and severally bind themselves to ensure prompt payment to all claimants, including subcontractors and material suppliers, for work performed and materials furnished under the contract terms.

The bond amount, which is subject to reduction based on payments made in good faith, covers all costs for labor, materials, and any extra orders issued by the City. Claimants have a 90-day period following completion of their work to be paid in full or they may initiate legal action on the bond. All claims must be filed within two years of the last labor or material provision, preceded by written notice sent to the principal and City's Finance Director within 180 days (or 200 days for employee benefit plan contributions). Legal action is restricted to the Circuit Court of Washington County, Oregon or the United States District Court for the District of Oregon. The bond is governed by Oregon Revised Statutes Chapter 279C and represents a public contract requirement, with the surety waiving notice of any changes, extensions, or alterations to the contract terms.

b. Later than two years after the claimant last provided labor or materials.

c. Other than in the Circuit Court of Washington County, Oregon or in the United States District Court for the District of Oregon and not elsewhere.

The surety, for value received, hereby agrees that no change, extension of time, alteration, or addition to the terms of the contract or to the work performed thereunder or the specifications accompanying the same shall in any way affect its obligations on this bond, and it hereby waives notice of any change, extension of time, alteration, or addition to the terms of the contract or to the work or to the specifications.
