About this file
This is a Certification Regarding Lobbying document required for the City of New Smyrna Beach's Hazard Mitigation Grant Program (HMGP) project to elevate six flood-prone homes in Volusia County, Florida. The certification applies because the contract value exceeds $100,000, pursuant to 2 C.F.R. Part 200, Appendix 11(1); 31 U.S.C. 1352; and 44 C.F.R. Part 18. The project involves comprehensive turnkey services to elevate six single-family homes located in Special Flood Hazard Areas to 10 feet above existing ground level, including structural assessments, boundary surveys, geotechnical assessments, construction plans, permitting, and utility disconnection and reconnection. The six properties are located at 455 DeSoto Drive, 645 Goodwin Avenue, 647 Goodwin Avenue, 508 South Indian River Road, 529 South Peninsula Avenue, and 640 South Pine Street. A non-mandatory pre-bid meeting is scheduled for December 9, 2025, at 2:00 PM via Microsoft Teams, with written questions due by December 18, 2025, at 5:00 PM. Bids are due electronically by January 8, 2026, at 2:00 PM, with bid opening at 3:00 PM the same day. Work must be completed by October 31, 2026, in compliance with FEMA grant requirements.
The project is 75% federally funded through FEMA's Hazard Mitigation Grant Program, with the remaining 25% provided by the City of New Smyrna Beach and homeowners. Contractors must provide bid security of 10% of the total bid amount and maintain specific insurance coverage including Workers' Compensation, Commercial General Liability ($1,000,000 per occurrence), Automobile Liability ($1,000,000 combined single limit), and Professional Liability ($1,000,000). Liquidated damages are assessed at $1,694 per calendar day for work not completed by the deadline. Contractors must be registered with the Florida Department of State, licensed in Volusia County, maintain active Sam.Gov registration, and comply with E-Verify requirements. The certification document requires that the contractor certify no Federal appropriated funds have been or will be paid to influence any officer or employee of a Federal agency or Congress in connection with this contract, and any non-Federal lobbying activities must be disclosed on Standard Form-LLL. Violation of lobbying certification requirements subjects contractors to civil penalties between $10,000 and $100,000 per failure.
