About this file
This is a Questions and Answers document and permit fee schedule from the City of New Smyrna Beach, Florida, regarding a FEMA-funded elevation project for six flood-prone single-family homes located in Special Flood Hazard Areas (SFHA) classified as Zone "AE." The project, funded through FEMA's Hazard Mitigation Grant Program (HMGP Contract No. 4337-373-R-b), requires the elevation of homes to 10 feet above existing ground to protect them from the 100-year storm event. The City will award the entire project to a single contractor selected as the lowest responsive and responsible bidder, with no price advantage provided for Florida Certified Business Enterprise (CBE) qualification. All work must be substantially completed by October 31, 2026, to meet the federal grant deadline, with homeowners expected to be displaced for a maximum of six months. The contractor must provide turnkey services including engineering design, permitting, and construction, with a one-year warranty following written final acceptance covering landscaping, pavers, and pool decks impacted by elevation work.
The contractor's responsibilities include securing a Florida-licensed professional engineer to prepare signed and sealed construction plans, conducting a site-specific drainage analysis, and submitting an on-site drainage plan during the permit process. Key technical requirements include elevating air conditioning units to 10 feet, maintaining open foundations with approved piling or pier-and-column systems, providing minimum 5-foot by 5-foot landings and stairs at front entrances, and treating concrete slab undersides with bonding agents or closed-cell foam. The City discourages change orders due to the fixed FEMA grant budget; however, they will be considered under special circumstances with full written justification submitted to FEMA for approval. Permit fees are assessed based on the City of New Smyrna Beach's fee schedule, with elevations classified as "Additions" under Group II, which charges fees based on valuation ranging from $100.85 for projects under $2,500 to $1,008.44 for projects exceeding $100,000, plus applicable state surcharges. Temporary living expenses for homeowners are covered through FEMA and are not the contractor's responsibility; however, the contractor bears responsibility for any damages to pre-existing conditions worsened by the elevation work, damaged sidewalks, sewer or water lines, and mitigation of impacts to irrigation systems and landscaping.

Elevation of 6 Flood-Prone Homes
Questions & Answers
1. Will the homeowners have a part in the selection process?
No. The City will award the entire project to one contractor. The City will select the contractor and award the project to the lowest and most responsive and responsible bidder.
2. Is there a percentage of advantage for being a Florida Certified Business Enterprise (CBE)?
No, CBE qualified contractors do not have any percentage advantage over non-CBE firms.
3. Since these project costs will likely be considered substantial improvement, are there any specific City regulations that will need to be included with the project? For example, will a chain wall need to be constructed to properly direct drainage?
The project will not trigger special City regulations beyond what has been disclosed in the Invitation to Bid. Proper drainage will need to be provided to ensure no impacts to neighboring properties. Means and methods will be determined by each bidder. who are also required to submit an onsite drainage plan during the permit process.
4. Have any of the properties received a substantial damage determination that would trigger an Increase Cost of Compliance (ICC) determination?
None of the homes have received a substantial damage determination. ICC may be requested by the homeowner through their flood insurance agent to assist their local match requirement. This effort by the homeowner may be completed after their home elevation is completed and will not have any bearing on the bid requirements.
8. Stucco work to match old houses?
There is no local code that requires stucco walls. They are not permissible by the FEMA grant for purely aesthetic reasons. The only exterior treatment will be to apply the cementitious material, skim coat, or similar to the exterior perimeter of the existing concrete slab. Also, exterior cracks that appear, are increased, or widened during the lifting process will need to be sealed and painted to match the color of the house, as best as possible.
9. Irrigation systems? Landscaping?
Contractor must use due diligence to minimize impacts to existing irrigation systems. Contractors must take all necessary precautions to avoid damaging existing irrigation systems and should restore them to the best of their abilities.
Impacted landscaping shall be restored to pre-construction conditions. Additional landscaping for ornamentation beyond what existed on the site prior to construction is not allowed.
10. Install all windows and doors in new foundation and who provides type of windows and doors?
For homes with garages, the only expected new window will be located on the exterior wall to replace the garage door opening. Per local code, the requirement will be to meet the 140 mph wind impact threshold. Refer to FBC R 609.2, 301.2.1.2. No other new windows or doors are required to be replaced.
11. AC stand mounted on house?
Air conditioning units must remain above the base flood elevation and be protected against sea level rise (this means elevating the ac units 10 ft). The ac units will be required to be elevated and placed on decks with pilings/pedestals or mounted on the house (in accordance with the City-approved engineering drawings. Florida Code is not specific on means and methods. Both methods (mount to building or standalone pedestal) will be acceptable.
12. Can all foundations be open? Do they have to be closed in?
All foundation shall have approved engineering and meet the provisions of FBC R 322.2.3, and chapter 4. While stem wall is not an acceptable option due to the associated higher costs, pile and pier and column are all acceptable choices. City Code does not dictate type of foundation used. For the piling option, the foundations shall remain open.
13. Do we have to show all lights and outlets in the plans for permit in the new garage areas and old garage areas?
Yes, all required lights, switches, and electrical receptacle outlets shall be depicted on the engineering drawings. For required receptacle locations see FBC R 3901.9. For required light locations see FBC R 3903.3 & 3901.4. Include lights and receptacles for the non-air conditioned elevated garage area and the new first level parking area.
14. If there is any damage realized as a result of preexisting conditions (i.e. the current foundation is not level), then is the contractor responsible for these damages?
Yes. If the structure has pre-existing conditions that are worsen by the elevation project, the contractor will be responsible for the additional damages caused by the elevation work. To avoid additional expenses by the contractor, it will be the contractor’s responsibility to secure the services of a structural engineer to confirm that the homes can be safely elevated. If during the elevation process it is confirmed that the foundation of the home is not leveled, it will be the responsibility of the contractor to provide and implement all necessary additional structural support to the existing concrete slab to ensure that the elevation process can be sustained. If it is determined that the home is not safe for elevation, the City will need to be informed immediately.
15. Are there relocation monies set aside for the owners during the project? Considering these projects are high lifts, does the City have an expectation for how long the owners will be out of the structure and will the monies be able to cover this cost?
An allowance for temporary living expenses has been approved by FEMA and will not be the responsibility of the contractor to include those costs in the bids. The homeowners are expecting to be out of their homes for a maximum of 6 months and the project must be completed by October 31, 2026 to meet the federal grant deadline.
16. If a structure needs to be slab-separated, then will change orders be allowed?
It is envisioned that the concrete slabs will be able to be successfully elevated intact as originally constructed. Since the FEMA grant has a fixed budget, the City discourages unnecessary change orders. In the unlikely event that the structure needs to be separated from the slab, the contractor will be required to provide a full written justification for the requested change order, which will need to be submitted to FEMA for consideration.
17. According to the ITB documentation, a period of one (1) year from written final acceptance is the expected warranty timeframe. Does this warranty include landscaping (plants survival), pavers (levelness potentially subjected to shrink and swell), and pool decks?
Yes, the warranty timeframe will include the landscaping, pavers, and existing pool decks to the extent impacted by the elevation work.
18. Some concrete slabs may be 4” or less. Due to the low bid approach, the final cost will not be known until the engineer specifies what needs to be done. Will change orders be allowable in these types of instances?
Since the FEMA grant has a fixed budget, the City discourages unnecessary change orders.
However, they will be allowed by the City under special circumstances. The selected contractor will be encouraged to communicate with the City as soon as such a special circumstance arises.
In the specific case of the concrete slabs, the need for concrete slab reinforcement will be accounted for in the bid alternate.
19. If a home is part slab and part pier and beam, is it expected that this home be slab-separated so that the new sub-floor is built at the same height as the pier and beam section? Or is it expected to elevate the home as is maintain the dual floor levels so that the pier and beam section finished floor elevation (FFE) is higher than the proposed FFE requirement?
The minimum finish floor elevation (FFE) for both sections shall be elevated 10 feet above grade.
The home can be elevated to maintain the dual floor levels.
20. Will the program pay for their pool pumps to run during the project? And is it expected that the temporary power pole will supply the electricity?
It is anticipated that each home will have a temporary power pole in order to supply limited electricity to operate a dehumidifier. For the home with a swimming pool (508 S. Indian River Road), the temporary pole will also provide minimum electricity to the pool pump.
21. In our experience, the homeowner is typically responsible to pay for any code upgrades since this condition is preexisting and not caused by the elevation work. Who is responsible for code upgrades?
The local building code will not require utility code upgrades due to the elevation work. Therefore, no additional code upgrades are expected. However, if code upgrades are eminent due to deteriorated pre-existing conditions exposed due to the elevation work, the contractor will not be responsible for the cost of upgrades. Instead, the homeowner will bear the cost of necessary upgrades.
22. As these homes move from overhead electric to underground, should the contractor include patching, painting, and fixing the roof as part of retrofitting the electric and making the meter accessible to the power company?
Yes. Contractor work shall include proper repairs to disconnect the existing electrical service line and to relocate the meter for access by the power company. New conduit cable will need to be installed underground and the meter can will need to be relocated for access by the utility company.
23. Is termite treatment an eligible item?
Termite treatment of the soil around the perimeter of the home is an eligible cost item to be included in the bid tabulation under bid line item “H” that pertains to the elevation of the structure.
25. Have you been able to list the various permit costs?
The elevation project will require a temporary electrical permit and a building permit for each home. A current building permit fee schedule has been attached.
26. Are concrete slabs required under the newly elevated structures?
No. Concrete slabs will not be required under the newly elevated structures. However, level stabilized material/structural reinforcement of the elevated slabs will be required in cases where additional structural support may be needed (to be confirmed by the Contractor’s structural engineer). Gravel/stones with a weed barrier will need to cover the exposed ground under the elevated structure.
27. Who specifies which two (2) entrances receive landings and stairs (there would likely be different sized landings depending on the door type door (sliding glass doors vs. single doors)?
The front door will receive a 5’ x 5’ landing, 5’x5’ deck (minimum) and stairs. The location of the platform lift for access will be coordinated with the homeowner. Regarding the rear of the homes:
a) if the rear has a single door or a sliding glass door/French door, it will serve as a second entrance point with a deck, landing and stairs; b) if the rear has a single door and a sliding glass door/French door, the single door will serve as the second entrance point with a deck, landing and stairs; c) for homes with doors on the sides of the home, these entrances will not be provided decks or stairs, unless they will serve for access to the platform lift. For the existing openings of each home, refer to the photographs provided as part of the ITB.
28. Is blocking off the doors to be included in the bid? Do they need to be closed in (framed, sheetrock, and exterior finish)? Or just bolted shut? What happens if the door that’s abandoned is constructed of glass and cannot be securely bolted shut (handrails)?
Blocking of the doors will be the responsibility of the contractor. For this bid, doors or sliding glass doors/French doors that will not have a deck and stairwell, shall be securely bolted shut in compliance with the Florida Building Code. In the case of glass doors, the contractor shall secure the door by low-cost means and methods to ensure that the door is no longer operational.
29. Is there a proposed schedule for milestones? Or is the general period of performance timeline including monthly percentage complete estimates the only payment driver?
All work must be substantially completed by October 31, 2026. The contractor may submit monthly pay requests to the City for payment processing.
30. Is pool equipment eligible to be elevated?
The pump and heater are key items to elevate above the FEMA-established base flood elevation, while the filter, pipes, and valves can be left at ground level.
31. Do you anticipate the replacement of sidewalks?
If the sidewalk is damaged during construction operations, the contractor shall bear the cost of replacing damaged sidewalks. This cost should be accounted for in the construction bis as part of their contract.
32. Do you anticipate the replacement of sewer lines all the way to the street?
The City does not anticipate the replacement of sewer laterals; however, if a sewer lateral is damaged during tunneling or excavation work, the contractor shall bear the cost of replacement in kind, including clean-outs.
33. Do you anticipate the replacement of water lines all the way to the street?
The City does not anticipate the replacement of water service lines; however, if a water line is damaged during tunneling or excavation work, the contractor shall bear the cost of replacement in kind.
34. Is there any concern regarding low bid law since there are no approved engineering design plans available to review (there are different legitimate approaches to foundation design)?
Since the City is requesting turnkey services for this contract, engineering design services will be included in the bid. It is understood that the contractor will need to make certain assumptions to submit a bid. The City envisions elevation on concrete piers/pilings.
35. Is the contractor or homeowner responsible for tree-trimming? Is there any City ordinances protecting certain tree types?
If the structure to be elevated is expected to come in contact with an existing tree, trimming and removal services will be the responsibility of the Contractor. There is no local code addressing tree trimming.
36. Are there any current setback concerns where a variance would need to be requested in order to elevate the structure?
It is expected that the existing setbacks will largely be maintained. The homes will be elevated at their current locations and corresponding setback distances will be maintained. Thus, the pre-existing structures shall be allowed to remain at their current setback locations and not require variances.
37. Does the engineer who will prepare design drawings have to be a professional engineer registered in Florida?
Yes, the engineering drawings will need to be produced by a Florida-licensed professional engineer. Signed and sealed construction plans will need to be submitted to the City to secure a building permit for the elevation work.
38. Does the bottom portion of the elevated concrete slab require any treatment?
Yes, once the structure is elevated, the underside of the slab will need to be treated with concrete bonding agents, closed-cell foam, or similar materials to protect the underside of the exposed reinforcement (wire mesh) from corrosion. High pressure washing prior to the concrete slab treatment will be required.
