About this file

This is a Certification Regarding Lobbying form applicable to the City of New Smyrna Beach's Hazard Mitigation Grant Program project to elevate six flood-prone homes in Volusia County, Florida. The certification applies because the contract exceeds the $100,000 threshold mandated by 2 C.F.R. Part 200, Appendix 11(1), 31 U.S.C. 1352, and 44 C.F.R. Part 18. The form requires the contractor's authorized official to certify that no federal appropriated funds have been or will be paid to influence federal officials, members of Congress, or congressional staff in connection with the awarding of this federal contract. The certification must be signed and dated by the contractor or subcontractor's authorized representative prior to contract execution.

The contractor must certify the truthfulness and accuracy of all statements and understand that the provisions of 31 U.S.C. Chapter 38, relating to administrative remedies for false claims and statements, apply to this certification. Failure to submit the required certification subjects the responsible party to civil penalties ranging from $10,000 to $100,000 per failure. Additionally, the contractor is required to include identical certification language in all subaward documents at every tier, including subcontracts and subgrants, ensuring that all subrecipients certify and disclose accordingly. This certification constitutes a material representation of fact upon which the government relied when entering into the transaction and is a prerequisite for contract execution under federal law.
