About this file

This justification and approval document authorizes a sole source procurement for modular office and shop space leasing services from specific manufacturers and contractors. The Alabama Army National Guard requires leased modular buildings totaling 15,660 square feet for temporary F-35 facilities while existing structures undergo repairs. Monaco fire alert and Stanley Best access control lock systems must be used for compatibility with existing basewide infrastructure. Electrical work will be coordinated with KWest Enterprises, the sole contractor constructing a new base electrical distribution system. The total estimated value is $223,000. Approvals were granted under the authority of the United States Code and FAR, citing only one responsible source. Solicitation W50S6N-21-Q-0002 was subsequently issued by the 187th Fighter Wing Contracting Office as a request for quote for the modular buildings and work space lease in accordance with the authorized sole source procurement.

Justification and Approval for Other Than Full and Open Competition

Sole Source Items within a Services Project AFARS 5153.303-5

Name and describe the required supplies/services

FAKZ212035 – F-35 Temporary Office Facilities FAKZ212135 – F-35 Temporary Shop Facilities

- The scope of work with relation to the limited sources includes the following:

- Leasing of 7,200 square foot of office space and 8,460 square foot of shop space while existing facilities are under repair for F-35 conversion.

- Connecting utilities to existing infrastructure.

United States Code 3304(a)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(ii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.

The 187th currently uses the Monaco fire alarm system base wide. We currently have a Monaco system installed at the Fire Department and in order for the alarm system at the temporary facilities to be compatible and be able to communicate with the existing system at the Fire Department, the system installed must be Monaco. No other fire alarm transceiver will integrate with the Monaco system.

Stanley Best Access Systems-Locks: The keying system for all facilities at the 187FW is managed by the Civil Engineer Squadron. The keying system is a Stanley Best Access System which allows CE to cut keys base on a secure coding system. CE is the gatekeeper of the key coding system. No other personnel are privy to the coding system or key cutting device. If Stanley Best Access System is not used, an outside contractor would need to key the locks. This would present an unnecessary security risk to the F-35 Simulator and/or the Base Supply Facility, and this would dismantle the gatekeeper ability which CE now solely holds. Additionally, CE would have to keep track of two or more separate key systems and multiple master keys, which is counterproductive to the long standing system currently in place.

The base electrical distribution system is currently under construction in project FAKZ162003, by awardee KWEST. To mitigate duplication of effort to connect electricity, the Government is asking potential offerors to coordinate with KWEST with their electrical requirements. Electrical requirements are not specified in the documents because loads are not known due to the different manufacturer processes for trailers and would be more advantageous to allow the contractors to coordinate under the proposed contract action instead of modifying the Electrical Distribution contract.

I certify that the supporting data under my cognizance, which are included in the justification are accurate and complete to the best of my knowledge and belief.

Date:

A pre-solicitation notice is placed in beta.sam.gov in order to give contractors an early notification of this project. However, due to the proprietary nature of the Monaco Fire alert system and Stanley Best Access Systems-Locks, and the ongoing electrical distribution systems construction being performed by KWest Enterprises LLC, no effort to compete these brand name requirements will be made.

Monaco Fire alert and Stanley Best Access-Locks are the only manufacturers that are utilized in their respective performance aspect installation-wide. Total replacement cost of these systems do not present an effective use of government resources at this time.

KWest Enterprises LLC is the sole contractor responsible for constructing the new electrical distribution system installation-wide. Introducing another electrical distribution contractor could cause disruption to electrical infrastructure that would result in safety hazards, contract delays, unnecessary contract modifications, and increased costs.

Monaco Fire alert and Stanley Best Access-Locks are the only manufacturers that are utilized in their respective performance aspect installation-wide.

KWest Enterprises LLC is the sole contractor responsible for constructing the new electrical distribution system installation-wide.
