About this file

This document is a Justification and Approval (J&A) for limited use of other than full and open competition for a contract extension with BAHFED CORP for the Naval Facilities Engineering and Expeditionary Warfare Center (NAVFAC EWC). The J&A seeks to extend Task Order N39430-22-F-9978 for the eCMS Operation and Maintenance system for a six-month base period from September 30, 2025 to March 29, 2026, with an additional six-month option period from March 30, 2026 to September 29, 2026.

The extension is critical to maintain uninterrupted services and enable a seamless data migration to a new vendor environment. The services include Tier III support, maintenance, updates, and cloud data migration services essential for NAVFAC's construction project documentation, planning, and management. The follow-on contract will be set aside for a Small Business Innovative Research (SBIR) Phase III project, awarded as a firm fixed-price contract. The contract will be funded through Operations & Maintenance, Navy appropriations, with a fiscal year range of FY 2025-2026. The justification emphasizes that BAHFED CORP is the only current provider capable of maintaining the system and facilitating a smooth transition.

4. Statutory Authority Permitting Other Than Full and Open Competition.

Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

The statutory authority for contracting with other than full and open competition is applicable in this procurement because BAHFED CORP is the only contract holder and provider of the services until award of the follow-on contract. The contractor is uniquely qualified to provide the necessary extension of services for the CMiC products, licenses, and associated database support. This includes the ability to provide timely updates and critical hot fixes against vulnerabilities within the system. As the period of performance under the incumbent contract N3943022F9978 comes to a close on 29 September 2025, it is essential to establish a seamless transition period for data migration to a new vendor's environment. The uninterrupted continuation of BAHFED's services is vital to sustain NAVFAC’s mission-critical construction project execution. Any gap during this transition will cause deactivation and removal from the current cloud database on September 30, 2025, which would adversely impact the entire NAVFAC enterprise with negative impacts to construction scheduling and management activities critical to the Planning, Design, and Construction (PDC) Directorate. This exception to full and open competition under 10 U.S.C. 3204(a)(1) satisfies the agency’s need as no other source is able to meet these requirements within the stipulated timeframe.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

No other offers were solicited because BAHFED is the incumbent contractor and the only source available to continue the services as discussed above. In addition, data migration from the existing system maintained by BAHFED is necessary for continued services until a follow-one contract is awarded. It is anticipated the new contract will be solicited utilizing the Small Business Innovative Research (SBIR) program.

7. Determination of Fair and Reasonable Cost.

To ascertain that the costs are fair and reasonable, the contracting officer will use price analysis methodologies outlined in FAR 15.404, Proposal Analysis. Price analysis will compare proposed prices to historical prices paid by the Government for the same or similar services from the previously awarded contract, ensuring fair and reasonable pricing.

8. Actions to Remove Barriers to Future Competition.

In accordance with the Small Business Innovation Research (SBIR) program and the unique capabilities required for the NAVFAC Information Technology Center (NITC) eCMS project, the follow-on contract will be set aside for an SBIR Phase III project, awarded as a firm fixed price contract, which was previously competed under the SBIR Phase I and Phase II competition requirements.
