About this file

This document is a Brand Name Justification and Approval (J&A) for Other Than Full and Open Competition for a Design-Build construction project at the G.V. (Sonny) Montgomery VA Medical Center in Jackson, Mississippi. The Department of Veterans Affairs, through the Network Contracting Office (NCO-16), is justifying the use of seven specific brand-name components for the Radiation Oncology Department Reconstruction project rather than accepting competitive alternatives. The contracting authority cited is 41 USC §3304(a)(1) (Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements), as implemented by FAR 6.302-1. The total project construction magnitude is estimated at $13,426,120.00, with branded components valued at approximately $200,675.00.

The seven brand-name items required for standardization and system integration throughout the facility are: Johnson Controls HVAC Controls/BAS Monitoring ($80,000), Siemens Fire Alarm System ($25,500), Vicon Valerus Security Cameras ($8,000), Software House Physical Access Controls System/PACS ($19,750), Guldmann GH3+ Patient Lift System ($30,000), Liebert HVAC System for specialized radiology equipment ($35,000), and Amico Ohmeda Medical Gas Outlets ($2,425). The justification emphasizes that these systems are already standardized throughout the facility and must integrate with existing infrastructure; using alternative manufacturers would create significant duplication costs, maintenance complications, and operational disruptions. The overall procurement will be competed as a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside, with this J&A to be posted with the solicitation. The document was prepared by Jeffery Knight, PE (Healthcare Engineer) and certified by Herbst Jennings (Contracting Officer, NCO-16) on May 12, 2026.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

These items have been standardized throughout the G.V. (Sonny) Montgomery (VAMC),.

Installing different manufacturers’ systems will create significant duplication in costs for the facility, and in most cases the equipment will not function properly. The specific impact for not using the brand name items is listed below:

a. HVAC Controls/BAS Monitoring

i. Johnson Controls

ii. Impact: An incompatible system may require installation of new “front-end” and remote workstations as well as new software and programming.

Additionally, installation of components that match the existing building automation system minimizes maintenance costs and bench stock requirements.

b. Fire alarm system

i. Siemens

ii. Impact: Installation of a system that interfaces properly with the existing system will ensure patient safety is maintained at the highest level.

Additionally, installation of components that match the existing fire alarm system minimizes maintenance costs and bench stock requirements.

c. Security cameras

i. Vicon Valerus

ii. Impact: The security cameras manufactured by Vicon are currently the hospital’s standard. Only Vicon Technicians can provide programing, service, and maintenance for Vicon camera equipment. Should another camera provider be utilized for the renovation work, there would be the need to hire a integrator to facilitate the integration of the new cameras with the existing Vicon Control Center.

d. Physical Access Controls System

i. Software House

ii. The PACS control panels to be installed as part of this project represent an extension of the existing PACS at our facility. As such, each new PACS Panel must tie into, and communicate with, the existing Facility PACS, which is manufactured by Software House. Each panel constantly communicates with

VHAPG Part 806.3 OFOC Revision: 03 Effective Date: 4/15/24 the front end of the PACS and the field devices. This allows the system to monitor each and every panel and field device, so that it cannot only receive alarms, but also can detect failures of the device as well.

e. Patient Lift System

i. Guldmann GH3+

ii. A patient lift and rail system to move disabled patients from bed/chair to the radiology equipment to allow the procedure to be completed. This is equipment we have standardized throughout the hospital for operation and maintenance reasons.

f. HVAC system for specialized radiology equipment

i. Liebert HVAC System

ii. Description: Single room HVAC to meet the requirements of the radiology equipment. This is the brand used in all the various locations for individual room environment control. This is required due to the heat generated by the radiological equipment during operation.

g. Medical Gas Outlets

i. Amico Ohmeda

ii. Description: This is the outlet fitting on the end of medical supply lines mounted into the wall. The connection must be universal throughout the Hospital to allow the use of same equipment in different locations based on patient needs.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small-Business (SDVOSB) set-aside. This Justification for Other Than Full and Open Competition will be posted to Contract Opportunities with the solicitation.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The Government estimate was prepared by the VA team and confirmed by the Contracting Officer’s Representative (COR). The anticipated price to the Government for the items requested to be brand name is approximately $200,675.00.

The items for which brand name approval is being requested are subsequent components to the overall construction project. This procurement will be competed and based on competition; the CO will make a determination of fair and reasonable pricing prior to award.

8. Description of the Market Research Conducted and the Results, or a Statement of the

Reasons Market Research Was Not Conducted:

The market research for the equipment was conducted and prepared by the COR and shared with the CO for further review. Competing firms will deliver fair market prices for systems and items listed as all systems are common and use standard off the shelf components. The CO was in concurrence with information provided in the estimate that supported the brand

VHAPG Part 806.3 OFOC Revision: 03 Effective Date: 4/15/24 name items. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the entire G.V. (Sonny) Montgomery VAMC.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

The Request for Proposal for this construction project will be 100% SDVOSB set aside competitive requirement and only the brand name items identified are to be from a proprietary source.

Offerors are also responsible for obtaining authorized personnel with the brand name suppliers for installation /work performance as needed. New components must be able to tie into an existing and operational system including use of software. Converting the software system tie-ins to another manufacturer’s system to accommodate portions of the facility complex would be extremely disruptive to medical center operations and prohibitively expensive.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

Not applicable. It is the responsibility of the offerors and the general contractor awarded the project to locate suppliers and obtain pricing for all materials and components, including the items listed in this justification.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

There will be competition for the overall procurement. It will be the responsibility of the offerors to obtain pricing from the suppliers of the items and to submit a competitive proposal for the project.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
