The presentation provides detailed information for potential bidders, featuring presenters from the Strategic Sourcing Manager, Systems and Policy Trainer, and the Supplier Diversity Office, and is designed to guide vendors through the bidding process for a comprehensive IT services contract.

The ITS81 statewide contract will replace the existing ITS74 contract, effective July 1, 2024, with an initial 10-year term ending July 1, 2034. The contract encompasses four primary categories: Enterprise Data Management, Data Analytics, User Centered Design and Development, and Geographic Information Systems. It will provide IT professionals for fixed-price, deliverables-based services including software development, systems planning, database services, project management, and system integration. Commonwealth of Massachusetts Supplier Diversity Office (SDO)

SDO Mission: To promote diversity, equity and inclusion in state contracting by:

Certifying small Massachusetts-based businesses and certain diverse businesses Connecting these companies with business opportunities and resources

Collaborating with Executive Agencies and public organizations to increase supplier diversity spending

Key Points Bidders must complete SDP Plan Form and propose a % of their contract sales to be spent with certified diverse companies (SDP Partners).

Mandatory to have Certified or recognized SDP Partner(s) Minimum commitment = 1% of sales under the contract SDP Plan form is worth one fourth (25%) of your bid’s total evaluation points No Exceptions to policy

Bidders must complete SDP Plan Form and propose a % of their contract sales to be spent with certified diverse companies (SDP Partners).

Mandatory to have Certified or recognized SDP Partner(s)

Minimum commitment = 1% of sales under the contract

SDP Plan form is worth one fourth (25%) of your bid’s total evaluation points

No Exceptions to policy

Key Contract Requirements Bidders - if chosen the SDP commitment is a contractual agreement.

Prime Contractors - must report spending with SDP Partner(s) for the duration of the contract.

SDP Partners utilized by prime contractors must be listed in one of the two directories identified in this presentation.

The SDP requirements applies:

Regardless of sales from the contract If no SDP partners are currently used If your company is a certified diverse business.

What are the key requirements of the SDP? CLICK There are three main points – and they apply to all bidders and contractors without exception.

All bidders must propose a % of their contract sales to be spent with certified diverse companies (we refer to them as SDP Partners) if chosen the SDP commitment is a contractual agreement . CLICK

After award, all contractors must report spending with SDP Partner(s) on a quarterly basis for the duration of the contract. CLICK

All SDP Partners utilized by prime Contractors must be listed in one of the two approved directories. These are the SDO and the US Department of Veterans Affairs databases. You can learn more about these databases in the webcast entitled Finding SDP Partners CLICK

The SDP requirements applies to all bidders and contractors without exception:

Even if your company, individually, does not expect to make a significant amount of money from the contract, Even if your company does not currently have SDP Partners, and Even if your company is a certified diverse business

In all these cases, your proposal is expected to contain a % of sales that your company commits spending with diverse businesses if awarded a contract.

NEXT SLIDE

SDP Plan Form Part I: Bidder and Contact Information (Required)

Part II: SDP Spending Commitment (Required)

Part III: Proposed SDP Partners (Required)

Part IV: Business Practices (Optional)

Part V: Additional Supplier Diversity Initiatives (Optional)

Part VI: Certification (Required)

Let’s take a closer look at the SDP plan form, so that you will have a better understanding what is required. CLICK This form will represent 25% of the total evaluation points so it is important you think about what to enter You can find more detailed instructions for completing this section by referring to the Supplier Diversity Program in the Request for Response

Fields in yellow are required, CLICK green is optional, CLICK and important messages are highlighted in red. CLICK While the green sections are not required generally, please note that additional evaluation points may be given for completing these optional or desirable sections. Bidders are reminded that reading the entire bid posting and all associated documents is essential, and responding as directed by the purchasing entity is required. SDO assumes no liability for bidders who do not respond to an opportunity as directed, and this webcast is not legal advice.

SDP Plan Form What percentage of your company’s contract sales do you propose to spend with certified diverse businesses (SDP Partners)? After contract award (if any), the Total SDP Commitment will become a contract requirement to be met annually on a Massachusetts fiscal year basis (July 1 – June 30) for the duration of the contract. See the RFR for any additional commitment specifications.

Contract Requirement

So the most important section of the form is in the middle of the and is the SDP spending commitment. As a Bidder for this contract you are required to list a commitment .The commitment represents a percentage of your contract sales you will spend with SDP partners. If you know you can breakdown your commitment spent between subcontractors and “ancillary . However, at least a minimum totatal SDP commitment percentage must be entered. CLICK It is also important to note that the minimum total SDP commitment is 1%. Something to keep in mind the higher percentage commitment you enter the more evaluation points you will receive

If awarded the contract the Total SDP Commitment will become a contract requirement to be met annually on a fiscal year basis (July 1 – June 30) for the duration of the contract..

SDP Plan Form

The next section of the SDP Plan form requires you to propose one or more SDP partners. For each partner, list:

The company name The business-to-business relationship type – subcontracting or ancillary The partner’s certification category The organization that certified the partner, for example the Supplier Diversity Office The product or service you expect to be purchasing The form also allows you to provide up to 3 years of previous spending with SDP Partners . Past spending with diverse companies may be a consideration of a prime contractor’s ability to meet its SDP commitment, and bidders may receive additional evaluation points for such prior spending Bidders may list proposed SDP Partners, however in order for any spending with partners to count after contract award, partners must be certified or approved by the SDO. It will be up to the prime contractor to ensure there SDP partners are certified or recognized. SDP Partners can be changed at any time

SDP Partnerships

Subcontracting
Provides goods or services directly related to the contract
Supplying a product for resale
Supplying a process/component
Consulting services
Ancillary
Provides goods or services for general business needs
Office Supplies
Cleaning Service
Catering/Event Planning

There are two types of partnerships:

Sub contracting -Provides goods or services directly related to the contract

Most SDP partnerships fall into another, much broader, group called Ancillary Products and Services. These are partnerships in which the certified business provides the prime contractor products and services for general business operation, usually unrelated to the contractor’s business with the Commonwealth.

For example, that same firm contracted to provide uniforms could chose to use a certified janitorial service to clean office space. Or perhaps hire a certified catering company to provide lunch during monthly staff meetings. Payments made to that cleaning service or that catering firm would count toward the prime contractor’s SDP commitment. It counts because the spending is part of the prime contractor’s regular operating costs.

Program Flexibility Your SDP Partner… Does not have to be a subcontractor May be located outside of Massachusetts May be changed at any time One-time and occasional purchases also qualify (e.g. business cards, office equipment, fire extinguisher testing, etc.)

it is very flexible as to how you engage them: CLICK your SDP partner does not need to be a subcontractor. You may work with diverse businesses to meet your general business needs.

Your SDP partners do not have to be located in Massachusetts. When searching the SDO certification directory, you will see that businesses are certified nationwide. CLICK Your relationship with your SDP partner does not need to be long-term. Even One-time purchases, such as business cards, office equipment or fire extinguisher testing, also qualify.

Whichever SDP partners you choose keep in mind:

Your partners must be SDO-certified or recognized, and Your spending with all these partners must be equal to or more than your SDP commitment bythe end of the fiscal year
