About this file
This is Amendment Six to Invitation to Bid (ITB) 26MUL0808B issued by the State of Alaska Department of Public Safety Division of Administrative Services for the construction of an addition to the Fairbanks Post facility. The amendment addresses vendor-submitted questions regarding project requirements and clarifies insurance and indemnification obligations. Bids must be submitted electronically to dps.das.solicitations@alaska.gov by January 6, 2026, at 2:00 p.m. Alaska Time. Amendments 1 through 6 are mandatory returns with each bid submission. The procurement officer is Kelly Pahlau, contactable at (907) 269-8493 or kelly.pahlau@alaska.gov. A virtual public bid opening will be conducted, with login credentials available upon request from the procurement officer.
The amendment clarifies three critical contract provisions. Flood and earthquake insurance coverage are not required despite initial General Conditions language. The State of Alaska maintains non-reciprocal indemnification terms requiring contractors to accept the indemnification language as written without modification to indemnify the state for damages caused by the Department's negligence or willful misconduct. When discrepancies exist between Appendix B insurance limits and Article 5.4 of the sample contract, the higher insurance limits in the contract apply to ensure adequate coverage. Bidders must sign and return the amendment signature page with their bids; failure to do so may result in bid rejection.

Question 1: General Conditions 5.4.d builder's risk: Can the requirement for "quake and flood" insurance be removed, or, negotiate about adding that after contract award? This is difficult coverage to obtain for projects in Fairbanks and several large insurers have already declined being able to offer quake and/or flood insurance for this project.
Answer: Flood and Earthquake Coverage are not required.
Question 2: Section 5.5 – Indemnification: Reciprocal indemnification is a common balance of terms, but it appears that the sample agreement doesn't provide reciprocal indemnification. May the General Conditions be modified to narrow the Contractor’s indemnification obligation and to provide for reciprocal indemnification for damage caused by the Department’s negligence or willful misconduct
Answer: The State of Alaska cannot agree to reciprocal indemnification. Contractors must accept the indemnification language as written in the General Conditions. We cannot modify this provision to indemnify the contractor.
Question 3: Appendix B lists insurance limits which are lower than insurance limits required in sample contract, Article 5.4. Which apply to this project?
Answer: When there is a discrepancy between Appendix B and the sample contract, the higher insurance limits in the contract (Article 5.4) apply. This ensures adequate coverage for larger or higher-risk projects.
