About this file

This is a Questions and Answers document addressing clarifications for the WRSU - Cibecue Tree Trimming solicitation (IHS1529682) issued by the Indian Health Service.

The Q&A document clarifies eight key aspects of the tree trimming services contract. The evaluation methodology is confirmed as Lowest Price Technically Acceptable (LPTA). Performance is anticipated to begin no later than 60 days after contract award, with the possibility of acceleration to 10 days post-award if feasible; the 10-day timeframe is not an evaluation criterion but reflects the requesting office's anticipated need. Site work hours are confirmed as 8:00 AM to 12:00 PM (noon) on Fridays, with deviations permissible if discussed and approved. White Mountain Apache Tribe Tribal Employment Rights Office (TERO) fees apply and are the contractor's responsibility; the TERO office contact is (928) 338-1012. For debris disposal, contractors may utilize the Tribe-operated Geronimo Pass Landfill near Ceder Creek, Arizona (contact WMAT Public Works at 928-338-1504), which accepts outside contractors for a fee, as an alternative to off-reservation facilities. Contractors may stage roll-off debris containers in a designated parking lot area. Site access requires check-in with the Facility Manager and Cibecue Security; contractors must provide advance notice of any areas requiring blockage for safety and equipment staging. Regarding Service Contract Act labor classifications, the Government states that offerors are responsible for determining appropriate labor classifications for the work performed and complying with the applicable wage determination (Wage Determination 2015-5477, Revision 30), which includes classifications for gardeners, grounds maintenance laborers, and pruners.

1. EVALUATION METHODOLOGY. Section 5 of the Combined Synopsis/Solicitation states that award will be made on a Lowest Price Technically Acceptable basis. The attachment titled "Clauses, Provisions, Additional Terms and Conditions," page 15, under "Addenda – Evaluation," states that determination for award will be made on a Best Value basis in accordance with FAR 13.106, price and other factors considered. Please confirm which evaluation methodology governs this acquisition.

Updated the clauses and provisions. This acquisition will be conducted using the LPTA.

2. PERIOD OF PERFORMANCE. The Synopsis states delivery within 60 days after receipt of order. The Statement of Work, under "Quote Technical Evaluation," lists the Capacity factor as "capacity to accomplish the delivery of the supplies and services within 10 days of the award." Please confirm which timeframe applies, and whether the 10-day reference is an evaluation criterion or a performance requirement The anticipated period of performance is expected to begin no later than 60 days after contract award. However, due to the time that has elapsed since the solicitation was issued, the requesting office may require performance to begin within 10 days after award ,if feasible. The 10-day timeframe is not an evaluation criterion; rather, it reflects the requesting office's anticipated need for contract performance to begin as soon as possible after award.

3. WORK HOURS. The Statement of Work, under "Work Hours," states that site work shall be performed "between Fridays, 8:00 AM – 12:00 AM." Given that clinic operating hours on Friday are stated as 1:00 PM to 5:00 PM, please confirm that the intended Friday work window is 8:00 AM to 12:00 PM (noon).

Confirmed intended work hours can be 8:00 AM to 12:00 PM (noon). Deviation from these hours can be submitted, discussed, and approved.

4. TRIBAL EMPLOYMENT RIGHTS OFFICE (TERO). The Statement of Work identifies tribal fees among the contractor's responsibilities. Please confirm whether White Mountain Apache Tribe TERO fees or compliance requirements apply to this contract, whether such fees are to be included in the quoted firm-fixed price, and provide a point of contact for TERO coordination if available.

Yes. TERO fees apply. TERO office contact is (928) 338-1012.

5. DEBRIS DISPOSAL LOCATION. Deliverables 1(d), 1(e), and 1(g) require that all trimmings, debris, and removed material be taken offsite and disposed of by the contractor. Please confirm whether disposal at a tribal facility is permitted, or whether all material must be transported to a state-regulated facility off the reservation. The nearest off-reservation facility we have identified is the transfer station in Show Low, Arizona, and the applicable haul distance materially affects disposal cost.

The Tribe operates the Geronimo Pass Landfill. It's located near Ceder Creek, Arizona. WMAT Public Works (928-338-1504) operates it. They say there is a fee for dumping, and outside contractors can dump.

6. ROLL-OFF CONTAINER STAGING. May the contractor stage a roll-off debris container on clinic property for the duration of the work period? If so, please identify an acceptable placement location.

Yes. An area can be block off an area in a parking lot to perform the work.

7. SITE ACCESS. Please describe any check-in procedures, credentialing, or badging required for contractor personnel, and identify acceptable staging and parking areas for equipment and trailers.

Check in with Facility Manager prior to coming out. If you need areas blocked off for safety and equipment during the work, we will need to have the information in hand. Our staff need to be notified, so we can block off areas, and allow for certain access during the tree jobs. Check in with Cibecue Security in front when your staff are on site.

8. SERVICE CONTRACT ACT CLASSIFICATION. Wage Determination 2015-5477, Revision 30, provided as Attachment 3, includes the grounds-maintenance classifications 11090 Gardener, 11210 Laborer, Grounds Maintenance, and 11260 Pruner. It does not include a classification specific to tree work performed from an aerial lift. Please advise which classification the Government considers appropriate for the work described in the Statement of Work, or whether a conformance action under FAR 52.222-41(c) will be required following award.

For purposes of the applicable Wage Determination, offerors are responsible for determining the appropriate labor classifications for the work being performed and for complying with the requirements of the Service Contract Labor Standards statute. The Government's responsibility is to ensure compliance with the applicable wage determination and that contractor employees are compensated in accordance with its requirements.
