About this file

This is an Indian Economic Enterprise Representation Form issued by the Indian Health Service (IHS) under the Buy Indian Act authority.

The form serves as a self-certification document for offerors responding to IHS solicitations, Sources Sought Notices, or Requests for Information (RFI). Offerors must certify whether they meet the definition of an "Indian Economic Enterprise" with Indian Ownership as defined in HHSAR 326.601. The certification requirement applies at three critical junctures: at the time of offer submission, at contract award, and throughout the entire contract performance period. Contractors must immediately notify the Contracting Officer in writing if they cease to meet eligibility requirements at any point during these periods. The form requires completion with the federally recognized tribal entity name, 51% owner name, business name, DUNS number, certifying signature, and printed name. Individual Contracting Officers may demand supporting documentation of eligibility before awarding set-aside or sole source contracts under the Buy Indian Act authority, and awards are subject to protest if the successful offeror's eligibility is questioned. The form explicitly warns that false or misleading information constitutes a violation of 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Successful offerors must also maintain registration with the System of Award Management (SAM).
