The limits of construction of the Copper/Flower Bicycle Boulevard extend from Fairview Avenue to Swan Road, a distance of approximately 5.9 miles. The project consists of furnishing all labor, materials, equipment and supervision necessary for the roadway improvements.
The work also includes, but is not limited to, construction of speed humps, traffic circles, chicanes, concrete curb, concrete sidewalk, curb access ramps, concrete driveway aprons, traffic signals and traffic signal modifications, pavement markings and signing, landscaping and other related incidental work as shown on City of Tucson Plan Nos. U-2025-048.
GENERAL PROVISIONS
For the purpose of these Special Provisions, the terms Agency, Department, City, City of Tucson, and Engineer are synonymous.
1. Project Objectives
The objective of this contract is to complete construction as quickly as possible while minimizing the impact to the Stakeholders. The Stakeholders include, but are not limited to, the adjacent businesses, commuters, buses, emergency services, pedestrians, bicyclists, and adjoining neighborhoods. As such, this work will be accomplished in an orderly manner as defined herein.
Driver and pedestrian access shall be maintained during the construction of improvements.
Temporary paved access shall be provided at all times to meet the Americans with Disabilities Act (ADA) requirements. The contractor is advised that an approved construction sequencing scheme meeting the intent of the project objectives will need to be followed. The contractor shall propose a construction phasing plan for the Engineer’s approval prior to beginning work. Once approved, the contractor shall follow the phasing plan unless modified by the Engineer in writing.
SP-9 of 161
2. Project Limits and Restrictions
The contractor shall perform all work within the public right-of-way, legally obtained easements including temporary construction easements (TCEs), legally obtained rights-of-entry (ROE), and legally acquired property by the City of Tucson. The contractor shall assume all responsibility and liability for any encroachment upon private property. The use of private property for construction yards will be allowed only if zoning requirements allows its use for this purpose – see Section 106-9 of the Standard Specifications for further details regarding temporary construction yards. The cost of the construction yard is considered incidental to the project.
Under no circumstances shall any equipment, vehicles or other construction items that are not specifically required or needed for the immediate construction at hand be stored or left on private property without the express written permission of the property owner.
The contractor shall field verify all existing conditions shown on plans and specified herein prior to beginning construction. Any significant deviations to the conditions that may affect the timely construction of improvements shall be brought to the attention of the Engineer within 24 hours of discovery. Prior to delivery of any equipment, materials or supplies to the site of any work, or the beginning of any construction work, it is strongly recommended that the contractor take pre-construction photos or videos as deemed appropriate for establishing the conditions existing in all the areas that may be affected by the construction.
A. Construction Scheduling
Various activities within the community must be considered in the project scheduling to provide the most effective and least impacting effort. The following dates are provided for information and shall be referred to when planning work and lane restrictions:
Christmas Retail Season .......................................................... Thanksgiving Day to Jan. 1st Gem and Mineral Show ...................................................................... Late Jan. to Mid Feb.
Pima County Fair .............................................................................. April 16th to April 26th Tucson Water Department Restrictions ............................................... April 1st to Sept. 30th SWG Construction Restrictions .................................................... October 1st to March 30th TEP Construction Restrictions ........................................................... May 1st to August 30th School Session ................................................................................... Late July to Late May
The contractor shall factor these events into the construction schedule. The contractor may do incidental work during these restrictions to complete areas that are not specifically described herein if no additional impacts to commuters, businesses, and residents are imposed and the work is previously approved by the Engineer.
Note that there is a Tucson Water project in the Del Valle Avenue and 21st Street currently under construction. No work on Del Valle Avenue or 21st Street shall be completed prior to
March 1, 2027 or as approved by the Engineer.
SP-10 of 161
It is also important that construction activities should be coordinated with the U.S. Post Office (access for mail delivery services), the City of Tucson Environmental Services Department (access for trash pickup services), and Fire Department and Police Department (access for emergency services). There will be no separate measurement and payment to the contractor in assisting these agencies with the service they provide to the affected parcels along all streets, as shown on the plans, during construction. Such cost will be included in the overall cost of the project.
Access into and out of driveways shall always be maintained during construction. If these conditions cannot be met due to actual work occurring at the driveway, the contractor shall provide a means of pedestrian ingress and egress at no cost to the City; driveway closure shall not exceed thirty-six (36) hours at any one time. The contractor is required to give notice to the affected parcel regarding the status of the driveway prior to the work commencing and provide a written schedule as to when the work is scheduled to be completed.
Work requiring lane restrictions beyond the minimum stated herein shall be done at night unless approved by the Engineer.
The intent of this project is to complete the work as quickly as possible to minimize any inconvenience to the traveling public, or adjacent stakeholders. To that end, the contractor is strongly encouraged to consider working weekends, double shifts, or as often as necessary to complete the work by the specific milestones. Lost time due to little or no work being performed shall not be considered when applying for a contract time extension.
B. Construction Sequencing
The contractor’s attention is drawn to Subsection 108-4 of these Special Provisions. The contractor shall be responsible for preparing their own construction sequencing plans that will be submitted to the City of Tucson Department of Transportation and Mobility (TDTM) for approval.
The contractor shall account for construction sequencing and work hour restrictions when scheduling and prosecuting the work as described in Subsection 108-4 of these Special Provisions. All decisions regarding construction sequencing and work hour restrictions shall be made upon meeting the project objectives. Any construction sequencing plan proposed by the contractor must meet the requirements specified in the PAG Standard Specifications for Public Improvements (latest edition), and these Special Provisions. Sequencing plans will need to be approved by the Engineer.
3. Contract Time
Once the contract has been awarded and signed, the contractor shall be issued a Notice to Proceed (NTP). This will begin Phase 1 of the project, the construction phase, and the contractor
SP-11 of 161 shall have 180 calendar days to complete this work as shown on the project plans and specified herein.
Phase 2 of the contract shall encompass the 24-month Landscape Establishment period as detailed in Section 807. All other items of work shall be completed and accepted (via acceptance of the roadway and/or drainage phase of the work) by the Engineering Representative prior to the commencement of Phase 2. The contractor shall obtain the acceptance of the previous phase(s) following a Final Inspection of that phase.
If the Final Inspection should reveal work that is not completed or is unacceptable to the Engineer for any reason, a "punch list" of these items shall be generated and provided to the contractor. Substantial completion (for the purpose of stopping the contract time) will be granted in accordance with Section 105-21 of the Standard Specifications.
Once substantial completion is granted, the contractor shall actively work to achieve final acceptance of the construction phase of the contract within 15-calendar days from the substantial completion date of that phase. Failure to prosecute the remaining work within this time period will result in the resumption of time charges and the application of liquidated damages from the date scheduled for final acceptance. The Landscape is to be watered/maintained during substantial completion; no additional payment will be made for landscape watering/maintenance until the initiation of Landscape Establishment.
When the work on this list has been satisfactorily completed, final acceptance of the phase(s) shall be given for all items of work other than Landscape Establishment. At this time the Landscape Establishment period shall begin with the written acknowledgement of Landscape Establishment Initiation from the City Landscape Architect, and the monies retained for all items of work other than Landscape Establishment (ITEM 8070001) shall be released.
Through the duration of the Landscape Establishment period, the Agency shall retain 10% of the cost of the aforementioned items of work or a minimum of $2,000.00, whichever is greater. (The amount retained for ITEM 8070001 shall not exceed 5% of the total contract bid amount).
Upon completion of the Landscape Establishment period, a final inspection will be held with Engineering and Streets Division staff to ensure that all plants are healthy and acceptable.
Prior to delivery of any equipment, materials or supplies to the site of any work, or the beginning of any construction work, it is strongly recommended that the Contractor take pre-construction photos or videos as deemed appropriate for the purpose of establishing the conditions existing in all the areas that may be affected by the construction.
SP-12 of 161
4. Maintenance & Protection of Traffic
The contractor shall be responsible for all construction zone traffic control and shall provide a traffic control plan in accordance with Section 701 of the Standard Specifications and these Special Provisions and shall be approved by the Engineer prior to construction.
The traffic control plans shall meet the conditions and requirements described in Subsection 104- 5 of these Special Provisions.
The contractor shall not allow any work to commence unless the conditions and requirements of Subsection 104-5 Maintenance of Traffic are adhered to. If the contractor fails to abide by the conditions and requirements of this specification section, it shall be considered sufficient grounds for the City to suspend the contractor’s work.
5. Disposal of Materials
All construction debris, rubble, excess, surplus and unsuitable materials structures and obstructions, except as hereafter specified, shall be removed from the job site and disposed of by the contractor at a site previously secured by the contractor, and done in a manner approved by the Engineer.
Disposal shall be the responsibility of the contractor. However, the contractor shall, with each and every disposal site arranged for (other than commercial waste sites), provide the Engineer with a copy of the written approval of the property owner indicating that the property owner is fully aware of what the material consists. The contractor shall also provide a letter to the Engineer from the City or County (whichever has jurisdiction), giving site approval for materials disposal at each site to be used. The approval letter shall be received and approved by the Engineer prior to the disposal of any materials at any site.
Costs associated with the disposal of these materials shall be incidental to the related items of work. Fees associated with the disposal of these materials shall be paid by the contractor.
All material removals shall be transported and legally disposed of from the project site the same day they are removed. Stockpiling of removed materials within the public rights-of-way shall not be allowed unless previously approved and directed by the Engineer. The location of the disposal site shall be the responsibility of the contractor and the contractor shall identify in writing the quantity of materials removed and disposed of to that location.
Upon removal, existing material, including existing guardrail, anchors, breakaway cable terminals, posts, and hardware, shall become the property of the contractor unless otherwise specified in the project plans, or in these Special Provisions, or by the Engineer.
Upon removal, disposal of the existing asphaltic concrete shall be the responsibility of the contractor. When approved by the Engineer, the contractor may stockpile and use it as recycled
SP-13 of 161 asphaltic concrete or dispose of it at an approved site. No measurement or direct payment will be made for disposal. The cost of disposing the removed AC pavement shall be incidental and considered as included in the cost of contract items.
If in good condition as determined and approved by the Engineer, removal of existing fence and gate material along the project limits may be salvaged and used for reconstruction of fence and gates at necessary locations.
6. Permits

The costs associated with obtaining permits shall be considered incidental and inclusive with the associated items of work. No additional compensation will be provided.
Excavation permits for excavation/construction in the public rights-of-way will not be required when the work is administered by the Agency.
No separate payment shall be made for preparation of the traffic control plans, and the costs shall be included in the overall cost of the project. The overall cost shall also include applicable plan review and permit fees.
Prior to any ground disturbing activity, the contractor shall obtain an Activity Permit from the Pima County Department of Environmental Quality. The contractor shall implement the standard specifications for dust suppression.
The contractor will be required to relocate certain water distribution facilities owned by Tucson Water and modify certain sanitary sewer system facilities owned by Pima County Regional Wastewater Reclamation Department (PCRWRD) as shown on the plans and hereinafter specified. The contractor shall obtain all construction permits required for this work. During construction operations, all contact between the contractor and Tucson Water or PCRWRD personnel will be through the Engineer. The contractor shall give all notices to the Engineer two (2) working days in advance of the notice periods required by Tucson Water and
PCRWRD.
SP-14 of 161

The contractor shall provide variable message boards at each entrance of the project work zone a minimum of seven (7) working days prior to starting work indicating the start of a different construction phase where travel times are affected or as directed by the Engineer.
The contractor shall, no later than seven (7) days prior to start of construction, distribute to all residents and businesses abutting the project rights-of-way notices informing them of the intent by the City of Tucson to begin construction of this project. Such notices shall be furnished to the contractor by the office of the City Engineer. Notices are not to be placed in mailboxes. Where there is no response or there is no answer at the door, the notice is to be left in the door/screen door. There shall be no separate pay item for the cost of the construction public meeting or notification letters. Cost shall be included as part of the overall job.
9. Construction Survey and Layout
Construction survey and layout, with the exception of pavement marking layout, will be provided by the City of Tucson.
10. Record Drawings
The contractor is responsible for keeping a set of record project pans on site for the annotation of changes that are made in detail, location, and depth of all items constructed which vary from the contract documents. UTILITY POTHOLING (BID ITEM 5150005 and 5150007) SHALL BE IDENTIFIED ON THE RECORD DRAWINGS. The record project plans shall include any
SP-15 of 161 revised or added plan sheets. The cost of furnishing record drawings shall be considered as included in the overall cost of the project.
Upon completion of the work, the contractor shall transfer the annotated information to a clean set of the project plans. The dimensions and notations provided on the record project plans shall be complete, clear, and legible. No later than 60 calendar days after acceptance of the project or as directed by the Engineer, the contractor shall submit the dated record set of project plans along with a transmittal letter to the Engineer for review and acceptance. Final retention shall not be released until the record project plans are accepted by the Engineer. The contractor’s failure to furnish this item may delay the contract close-out.
11. Saw Cutting
The contractor’s work shall consist of saw cutting and/or wheel cutting the existing pavement where new asphaltic concrete (AC) and Portland cement concrete pavement (PCCP) is to match existing pavement surfaces. The contractor’s work shall also include saw cutting and/or wheel cutting existing Portland cement driveways, sidewalks, and curbs where new construction shall match the grade of these existing surfaces. Saw cuts shall be made to a minimum depth of 1½ inches and in all cases, deep enough to insure a neat vertical joint. Portland cement concrete that is damaged by the contractor’s saw cutting shall be replaced in kind at the contractor’s expense.
No measurement or direct payment will be made for saw cutting and/or wheel cutting, the cost being considered as included in the price of other contract items.
12. Existing Vegetation
Clearing limits must be approved in advance by the Engineer. Grading and construction near and around vegetation that is to be preserved-in-place may be required. The Engineer may require that specific vegetation remain within the construction limits in addition to what is shown in the project plans. The contractor and the Engineer shall tour the project site prior to any construction beginning and together verify what specific vegetation shall be preserved in place.
The contractor shall preserve in place some existing plant material in the Right-of-Way as shown on the project plans. The contractor shall prune exiting trees to remain in place as directed by the City Landscape Architect and provide fencing as described in Sections 201 and 806 of these Special Provisions.
Existing project vegetation on this project shall not be disturbed by the contractor beyond those limits actually needed for the contractor’s construction purposes. Those items unnecessarily damaged by the contractor shall be repaired or replaced at the contractor’s expense.
13. Contractor’s Environmental Requirements and Mitigation Measures
The contractor’s attention is directed to Section 107-14 of the Standard Specifications that requires conformance to all State and local air quality requirements.
SP-16 of 161
In compliance with Executive Order 13112 regarding invasive species, all earth-moving and hauling equipment shall be washed at the contractor’s storage facility prior to arriving on site to prevent the introduction of invasive species seed.
If any Sonoran Desert tortoises are encountered within the project area, the contractor shall contact the Engineer and adhere to the attached Arizona Game and Fish Department “Guidelines for Handling Sonoran Desert Tortoises Encountered on Development Projects” revised September 22, 2014.
In compliance with Executive Order 13112 regarding invasive species, all disturbed soils that will not be landscaped or otherwise permanently stabilized by construction will be seeded using species native to the project vicinity.
In compliance with Executive Order 13112 regarding invasive species, all earth-moving and hauling equipment shall be washed prior to leaving the construction site to prevent invasive species seeds from leaving the site.
The contractor shall prepare and implement a Stormwater Pollution Prevention Plan that meets the requirements of the construction general permit, including sampling and analysis plan, as necessary.
14. Archeological Features
If human remains, including human skeletal remains, cremations, and/or ceremonial objects and funerary objects are found during excavation or any activity related to construction in any part of the project area, ground disturbing activities must cease in the immediate vicinity of the discovery. Should artifacts or human remains be uncovered, the area will be taped off and the City of Tucson Engineer notified. The City of Tucson Engineer will immediately contact the City of Tucson Historic Preservation Department (520.837.6968) and arrange for the proper treatment of those resources. State laws ARS 41-865 and ARS 41-844 require that the Arizona State Museum (520-621-4795) be notified of the discovery by the contractor so that cultural groups who claim cultural or religious affinity to them can make appropriate arrangements for the repatriation and reburial of the remains. The human remains will be removed from the site by a professional archaeologist pending consultation and review by the Arizona State Museum and the concerned cultural groups.
The work is subject to delay in that location pursuant to ARS 41-844 while an examination takes place.
SP-17 of 161
15. Hazardous Materials
If suspected hazardous materials are encountered during construction, work shall cease at the location and the Engineer shall be notified immediately to arrange for proper assessment, treatment, or disposal of those materials. The area will be taped off, and further investigation and clean up by the City of Tucson will follow. No adjustments will made due to work shut down. If potentially hazardous or contaminated materials are encountered, the contractor shall stop work and remove all workers within the contaminated area. For life threatening situations, follow the procedures in the Safety Plan, as specified in Subsection 107-7.02.
16. Utilities
Utility relocation work both shown and not shown on the project plans or noted in these Special Provisions will be the responsibility of the appropriate utility. All efforts have been made to avoid utility conflicts and assure as much of the utility work as possible was completed prior to the start of this project. If any relocation work is necessary due to additional conflicts, the utility companies will perform the relocation work during the project construction phases unless otherwise noted on the project plans. The contractor is hereby notified that the utility companies, in conjunction with the contract work, will perform their own utility relocation work. The contractor shall make every effort to cooperate fully with each utility company and acknowledges and agrees that delays to his operations may necessarily occur. Due to these delays that are anticipated by the utility companies, the Engineer will consider requests by the contractor for contract time extensions if necessary. The contractor will also acknowledge and agree that no monetary compensation will be given to the contractor by the Agency as a result of the impacts on the construction operations that are caused by the utility companies due to their anticipated work or delay. The contractor is also referred to Section 105-6 of the Standard Specifications, Cooperation With Utility Companies.
The contractor shall consider the extent of utility work in preparing the contract bid and project schedule. It will be the contractor’s responsibility, prior to bidding, to contact the appropriate utilities to obtain additional information such as relocation record drawings and/or as-builts, relocation sequencing, utility windows, construction time frames, and identification of areas requiring subgrade preparation by the contractor prior to the start of utility work.
At least two (2) working days prior to commencing excavation, the contractor shall call the Blue Stake Center, between the hours of 7:00 a.m. and 4:30 p.m., Monday through Friday for information relative to the location of buried utilities. The number to call is: Tucson and Pima County 1-800-STAKE-IT.
It shall be the responsibility of the contractor to contact the utility companies in order for them to determine if there is a need for any overhead protection, bracing or shoring necessary during the construction of this project. If overhead protection, bracing or shoring is necessary, the contractor shall conduct this work to the satisfaction of the utility. No measurement or direct
SP-18 of 161 payment will be made for overhead protection, bracing or shoring, the cost being considered as incidental.
It shall be the responsibility of the contractor to verify and locate all existing overhead and underground utilities whether shown on the plans or not. The contractor is advised that the placement of a utility on the project plans is in no way meant to indicate its exact location.
