About this file
This is a federal form (HUD-50070) that certifies an applicant's commitment to maintaining a drug-free workplace as a requirement for receiving HUD grant funding. The form must be completed and signed by an authorized official of the applicant organization.
The certification requires applicants to implement seven key components: publish a workplace statement prohibiting controlled substances and specifying consequences; establish an ongoing drug-free awareness program informing employees of abuse dangers, organizational policy, available assistance programs, and penalties; distribute the workplace statement to all employees engaged in grant-funded work; require employee notification of drug-free workplace conditions and mandate written reporting of any workplace-related criminal drug convictions within five calendar days; notify HUD in writing within ten calendar days upon receiving notice of employee convictions, including position title and affected grant identification numbers; take appropriate personnel action against convicted employees within 30 days, either through disciplinary measures up to termination (consistent with Rehabilitation Act requirements) or by requiring participation in a federally-approved drug abuse assistance or rehabilitation program; and make good faith efforts to maintain ongoing compliance. Applicants must also list all work performance sites on separate pages, including complete address information. The form includes a penalty statement warning that false certifications are subject to criminal and civil penalties, including confinement for up to five years and fines under specified U.S. Code sections.
