QUESTIONTECH/KTRQUESTIONANSWER
1TECHIn the Port of Rotterdam, sea going vessels are required to pay port dues (Net Port Dues = GT+Cargo) on cargo that is loaded or discharged. How is the Government planning to pay the port dues?4.1.2.1 The Government will compensate the port for all tariff charges or port fees generated throughout the course of the contract. The Vessel is responsible for paying Wharfage fees, any Tarriff fees are normally billed to SDDC (598th).
2TECHWill the U.S. Government (USG) provide copies of the 1951 NATO Status of Forces Agreement (SOFA), Supplementary Defense Cooperation Agreement (SDCA) or any other agreement with the Norwegian Government that exempts the the USG from taxes?If an agreement is in place and shareable the USG will provide a copy of this agreement.
3TECHIf tax relief is not granted by the local Government and/or port authority, how does the USG expect to pay for all of the required taxes?The USG fully expects any fees associated to port handling and deemed appropriate and allowable by the CO will be paid through by the government via OOP.
4TECHIf taxes relief is not granted, and the Government requires or is required to pre-pay or pay taxes, is the USG going to pay the a contractor's surcharge in order to pay for the additional transaction(s)/action(s)?No, the USG will not pay a surcharge. Any fees paid on behalf of the USG by the contractor shall be reimbursed at actual cost.
5TECHWill all of the previous contract's final packing lists be provided by the USG during the solicitation period so competing contractors have the same knowledge as the incumbent in order to submit accurate pricing?No, The SOR list estimated quantities based on historical data and all offerors will have the same data.
6TECHIs the USG willing to change vehicle category definitions to match commercial industry? Currently, the USG weight breakdown does not match the standard commercial industry and creates pricing disadvantages to both the USG and the contractor.No, the USG has commodity catigories of 60, 61, and 67 60 = vehicles weighing 25,000lbs or less 61 = Vehicles from 25,001 to 60,000lbs 67 = Vehicles weighing 60,001lbs of more
7TECHIs the USG willing to change rate schedules to meet commercial industry standards by pricing everything based on MTON?No, pricing on vehicle, trailers and containers will be prices by the piece or each. Breakbulk cargo, will be priced by MTON.
8TECHWhat type of vessels (RO/RO or LO/LO) were used in the Port of Rotterdam over the last five years/during execution of the existing contract?Your attention is directed to the performance work statement 6.15.1, TABLE 3, which table provides:

Anticipated vessel types that may call on the port.

9TECHWill the USG add schedule rates for LO/LO Loading and discharging trucks? Current schedule rates only provide for RO/RO rates. a.LOADING AND DISCHARGING TRUCKS: 1B3 COM. 44C AND 1B4 COM. 44C; both are missing LOLO schedule rate for “CONTAINERS LESS THAN TEU - SINGLE - Conex, Quadcons, Tricons, Bicons, W/ISO | LOLO - Loaded /Discharged by truck/trailer, forklift, by ramp.”
b.LOADING AND DISCHARGING TRUCKS: 1B3 COM. 60C/61C/67C AND 1B4 COM. 60C/61C/67C; both are missing LOLO schedule rate for “LIGHT/MEDIUM/HEAVY VEHICLES | LOLO - Vehicle rolling under Own Power, by forklift.”The SOR has a schedule for loading and discharging Vessel (1A1, 1A2), trucks (1B3 & 1B4), and railcars (1B1 & 1B2), and other commodity rates have muliple methods to move which include LOLO, RORO, and TOTO.
10TECHReferencing 4.5.4 Exceptions to Commodity Rates. Paragraph states "If the COR determines it is necessary to establish additional commodity rates, the COR will advise the CO for a SOR modification for the remaining period of the contract." Does this mean the COR, not the CO, ultimately decides whether or not a commodity rate would be added to the contract and resulting task orders? Meaning, once advised by the COR to add, the USG CO shall/will add the commodity rate(s)?No, the COR advises the Contract Officer and the Contracting Officer ultimately decides whether to issue a SOR modification.
11TECHReferencing 4.13. Will the USG establish overtime equipment rates if the port increases it's rates for equipment used outside (2nd, 3rd, and/or 4th shifts) of normal working hours?No, 4.13 Equipment Rental rate applies to equipment owned or rented by the Contractor and used during man-hour operations. For commodity operations, Contractor equipment used is inclusive of the commodity activity rate (i.e. vessel, truck and rail (load or

unload)). Daily equipment rates shall imply 24 hours of use with appropriate operators changed as needed. 4.13.1 For equipment used for both Commodity and Extra Labor on the same day/time, the Government will compensate the Contractor for the actual time the equipment was used in an Extra Labor situation, which shall be verified by the COR and the Contractor.

12TECHReferencing 5.15.2 and 5.16. How does the USG plan to pay or how does the contractor bill for the weight of the nested/de-nested cargo during loading or offloading operations? Is the weight billed by break bulk/MTONs?5.15.2 When requested by the COR, the Contractor shall provide labor and equipment to either nest or de-nest cargo. Compensation for nesting and de-nesting cargo shall be paid at applicable man-hour and equipment rates (schedules 2 and 4 of the SOR).
13TECHReferencing 5.15.2 and 5.16. Is the contractor to bill using the extra labor (XL) rate when nested/de-nested cargo is loaded or offloaded?Yes, [5.15.2] when requested by the COR, the Contractor shall provide labor and equipment to either nest or de-nest cargo. Compensation for nesting and de-nesting cargo shall be paid at applicable man-hour and equipment rates (schedules 2 and 4 of the SOR).
14TECHReferencing 6.4.7. Will a labor rate be added to pay for washing services? If not, what specific labor rate in the SOR Schedule 2 shall a contractor use to bill?General Labor (man-hour) shall be used for this service [6.4.7].
