52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
52.212-2 is replaced in its entirety.
(a) The Government intends to award a single indefinite delivery, indefinite quality (IDIQ) contract as a result of this solicitation after conducting discussions with Offerors whose proposals have been determined to be within the competitive range. If the Contracting Officer determines the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals. Therefore, the Offeror’s initial proposal should contain the
Offeror’s best terms from a price and technical standpoint. Subjective tradeoff procedures will be utilized in accordance with FAR 15.101-1 and DoD Source Selection Procedures. To receive award, the Offeror must (1) be deemed responsible IAW FAR Part 9, (2) conform to all required terms and conditions, and (3) represent a best value to the Government, price and other factors considered. This may result in an award to a higher rated, higher priced Offeror, where the decision is consistent with the evaluation factors and the Source Selection Authority
(SSA) reasonably determines that the superior technical capability of the higher priced Offeror outweighs the cost difference. However, the Government will not pay a price premium that it considers to be disproportionate to the benefits associated with the proposed margin of service superiority.
(1) Each Offeror’s proposal will be evaluated against the following factors:
a. Factor 1 - Business Proposal
b. Factor 2 - Technical Capability (All Technical Capability sub-factors are of equal importance)
i. Sub-factor 1 - Operational Approach
ii. Sub-factor 2 - Capacity and Subcontractor Management
iii. Sub-factor 3 - Transition/Volume Phase-In
iv. Sub-Factor 4 – IT Services
c. Factor 3 - Past Performance
d. Factor 4 - Price
(2) Relative order of importance: Offeror’s Technical Capability will be evaluated on a basis approximately equal to price. Price will be evaluated but not rated. The Business Proposal and Past Performance subfactors will be rated on an Acceptable/Unacceptable basis.
(b) The above factors shall be evaluated in the following manner:
Factor 1 - Business Proposal. The Offeror’s Business Proposal will be evaluated on an Acceptable/Unacceptable basis. The Government will not award to an Offeror that has an Unacceptable rating for this factor.
General Compliance Acceptable/Unacceptable Ratings
Rating Description
Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
In order to be rated Acceptable, the Offeror’s proposal shall conform to all requirements of the solicitation, including the Proposal Preparation Instructions under Addendum to FAR 52.212-1. The Offeror must be registered in System for Award Management (SAM) at the time of proposal submission.
Factor 2 - Technical Capability. Offerors will be given a technical rating for each of the Technical Capability sub-factors taking into consideration the Offeror’s approach and understanding of the requirements and an assessment of the strengths, weaknesses, significant weaknesses, and deficiencies of the proposal. The Technical
Capability sub-factors are listed in no specific order and are considered equally important. Following assignment of the Technical Rating, a Risk Rating will be assigned for each of the Technical Capability sub-factors.
Assessment of technical risk, which is manifested by the identification of weakness(es) and significant weaknesses, considers potential for disruption of schedule, degradation of performance, the need for increased
Government oversight, or the likelihood of unsuccessful contract performance. The Technical Capability ratings are described as:
Technical Ratings
COLOR RATING DESCRIPTION
Blue Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths.
Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength.
Green Acceptable Proposal indicates an adequate approach and understanding of the requirements.
Yellow Marginal Proposal has not demonstrated an adequate approach and understanding of the requirements.
Red Unacceptable Proposal does not meet requirements of the solicitation and, thus, contains one or more deficiencies and is unawardable.
Strength is defined as an aspect of an Offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance. Any strengths identified by the Government during source selection that exceed Attachment 1 – Performance Work
Statement requirements will be incorporated into the resultant contract at time of award.
Weakness is defined as a flaw in the proposal that increases the risk of unsuccessful contract performance.
Significant Weakness is defined as a flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.
Deficiency is defined as a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
Technical Risk Ratings
RATING DESCRIPTION
Low
Proposal may contain weakness (es) which have little potential to cause disruption of schedule, increased cost or degradation of performance. Normal Contractor effort and normal Government monitoring will likely be able to overcome any difficulties.
Moderate
Proposal contains a significant weakness or combination of weaknesses which may potentially cause disruption of schedule, increased cost or degradation of performance. Special Contractor emphasis and close Government monitoring will likely be able to overcome difficulties.
High
Proposal contains a significant weakness or combination of weaknesses which is likely to cause significant disruption of schedule, increased cost or degradation of performance. Is unlikely to overcome any difficulties, even with special Contractor emphasis and close Government monitoring.
Unacceptable Proposal contains a material failure or a combination of significant weaknesses that increases the risk of unsuccessful performance to an unacceptable level.
(A) Sub-Factor 1 – Operational Approach. The Offeror’s technical approach demonstrated how the
Offeror will meet the PWS requirements cited in Volume II, Paragraph A of the Addendum to FAR 52.212-1.
(B) Sub-Factor 2 – Capacity and Subcontractor Management. The Offeror’s Capacity and
Subcontractor Management Plan demonstrated how the Offeror will manage capacity and subcontractors throughout contract performance according to the elements required by Volume II, Paragraph B of the Addendum to FAR
52.212-1.
(C) Sub-Factor 3 – Transition/Volume Phase-In. The Offeror’s Transition/Volume Phase-In Plan demonstrated how the Offeror will accomplish transition requirements according to the elements required by
Volume II, Paragraph C of the Addendum to FAR 52.212-1.
(D) Sub-Factor 4 – IT Services. The Offeror’s IT Services plan demonstrated how the Offeror will meet the web-based, mobile access requirements according to the elements required by Volume II, Paragraph D of the
Addendum to FAR 52.212-1.
Factor 3 - Past Performance. The Government will evaluate each Offeror’s past performance information using questionnaires and performance information independently obtained from Government or commercial sources.
1. The evaluation team will first determine the recency of each past performance reference which is defined as ongoing or performed within three calendar years of proposal submission.
2. The evaluation team will then determine the relevancy of the Offeror’s past performance proposal taking into consideration the aggregate of all references IAW the criteria outlined below. Only one relevancy rating will be provided for the past performance proposal.
Very Relevant Past performance proposal involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Past performance proposal involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant Past performance proposal involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Past performance proposal involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
For the purpose of this acquisition, scope, magnitude of effort, and complexity are defined as follows:
ELEMENT DESCRIPTION
Scope HHG relocation services on a global basis.
Magnitude HHG relocation services for 50,000 or more household shipments per month year domestically and 35,000 or more household shipments per month year internationally.
Complexity
Global HHG transportation relocation services to include (1) providing move counseling for personal property (household goods, unaccompanied baggage and personally procured moves, as defined in the Joint Travel Regulation (JTR)); (2) household goods transportation (3) traffic management and administration, including customs clearance; (4) shipment packing and unpacking, loading and unloading; (5) in-transit visibility (ITV); (6) secure Storage in Transit (SIT) facilities; (7) pickup and delivery of shipments from origin to destination to include Non-Temporary Storage
(NTS) facilities; (8) claims processing and resolution; (9) invoicing; (10) reporting.
3. The evaluation team will also evaluate the Offeror’s ability to attain the applicable goals for small business participation under contracts that required subcontracting plans within three years of proposal submission.
The evaluation team will not consider any reference as acceptable if an explanation for remedy is not provided.
4. After recency and relevancy ratings have been assigned, one of the following overall Past Performance ratings will be assigned to each Offeror. Assignment of a rating will also take into consideration the quality of performance under the collective references submitted for evaluation and any other information identified by the
Government.
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the
Offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
5. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the
Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “acceptable.”
a. In evaluating past performance, the Government will give greater consideration to information on those contracts deemed most relevant to the effort described in this RFP.
b. 6. Offerors are cautioned to submit sufficient information and in the format specified in FAR 52.212-
1. Offerors may be asked to clarify certain aspects of their proposal (for example, the relevance of past performance information) or respond to adverse past performance information to which the Offeror has not previously had an opportunity to respond. Adverse past performance is defined as past performance information that supports an unacceptable rating on any evaluation element or any unfavorable comments received from sources without a formal rating system.
c. 7. Past performance regarding predecessor companies or subcontractors that will perform major or critical aspects of this requirement will be weighted the same (equally as important) as the past performance information for the Offeror.
Factor 4 - Price. Price will be considered in determining the best value Offeror. Price will be evaluated for completeness; however, price will not be rated. In order to be considered for award, the TEP must be determined fair and reasonable. Prices not included in the TEP, as identified in Attachment 2, Pricing Rate Table, will be evaluated for fair and reasonableness. The Offeror’s proposed pricing will be evaluated using one or more of the techniques set forth in FAR 15.404-1(b)(2) to determine prices fair and reasonable. Proposed pricing will also be evaluated to determine that all prices are complete (a proposed price has been entered in all cells with a light blue background in Attachment 2, Pricing Rate Table). The Government may determine a price proposal is unacceptable if the prices proposed are materially unbalanced. Unbalanced pricing exists when, despite a fair and reasonable TEP, the price of one or more line items is significantly overstated or understated and poses an unacceptable risk to the Government.
1. EPA. For purposes of evaluating proposals, the Government will utilize IHS Markit Pricing and
Purchasing Industry Forecasting Adjustments as detailed on the 1c) Price Escalations sheet of Attachment 2 Pricing
Rate Table for prices beyond Base Year Period 1. However, prices are only projected for purposes of evaluating proposals and the actual economic price adjustment will be calculated and applied to the rates on day one of each performance period IAW, PWS, Appendix G.
2. Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options shall not obligate the Government to exercise the option(s). If the Government extends the contract pursuant to FAR 52.217-8, Option to Extend
Services, such extension will be at the rates in effect under the contract when the option is exercised. For the TEP calculation, pricing for a 6-month extension of services period will be based on the prices of the final Option Period.
3. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful
Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
4. Use of Non-Government Advisors. Boston Consulting Group, 4800 Hampden Ln # 400, Bethesda, MD
20814 (BCG) will provide advisory assistance to the evaluation team. BCG personnel will have access only to
Offerors’ price proposals. Submission of a proposal is considered to be Offeror’s written consent to release of proprietary, confidential or privileged commercial or financial data included in Offeror’s proposal to BCG personnel. All BCG personnel providing advisory assistance to the evaluation team will sign a non-disclosure certificate prohibiting them from releasing proprietary information.
