About this file

This file contains Questions and Answers related to solicitation HT942627QE003, a 100% Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside Blanket Purchase Agreement (BPA) issued by the Defense Health Agency for consumable supplies supporting Terumo Trima Accel Blood Collection Systems at the U.S. Army Institute of Surgical Research (USAISR). The BPA is valued at $350,000 with a 60-month term and will be reviewed annually for potential pricing adjustments based on shipping, freight, and manufacturing cost changes, subject to government determination of fairness and reasonableness. The solicitation requires original manufacturer-supplied Terumo BCT consumables with no generic substitutes available; six specific consumable items are required for pricing on the updated Exhibit A Pricing Sheet included with Amendment 0003, which provides estimated annual quantities for each 12-month period.

Key procedural clarifications address the nonmanufacturer rule (13 CFR 121.406) applicability to the SDVOSB set-aside, with the government having requested an individual waiver from the SBA that remains pending; absent waiver approval, the solicitation will likely be canceled and reseller quotes will not be accepted. The solicitation incorporates FAR 52.219-27 SDVOSB clause and requires submission of commercial published price lists with applicable discounts; manufacturers' published price lists with offeror discounts are acceptable for resellers. Reference to prior contract W81XWH-21-A-0007 is available for historical usage data. Electronic quotations should be submitted to tara.j.borntreger.civ@health.mil and jeremy.l.mcmurry.civ@health.mil using the updated pricing sheet format from Amendment 0003.

Questions/Answers
1Are we to simply quote the quantity of one item for the three collection systems from page six? Or, three of each part number?
Attached to Amendment 0003 is an updated Pricing Sheet with Estimated Quantities.
2I understand this BPA is to be good for 60 months or to the total of $350,000.00 whichever comes first and will be reviewed prior to renewal each year, does this review period allow us (the Offerror) to adjust the cost according to shipping and freight charges? or Manufacturing costs?
Yes, pricing may change during the life of the BPA, but a determination of fairness and reasonableness of pricing will be conducted for changes.
3Is there a prior contract number you can reference to see what previous usage could possibly be expected?
W81XWH-21-A-0007
4The solicitation requires original manufacturer-supplied Terumo BCT consumables, and Terumo BCT is a large business. Does the nonmanufacturer rule (13 CFR 121.406) apply to this 100% SDVOSB set-aside?
Yes. An individual waiver has been requested from the SBA and remains pending. An additional amendment will include the waiver (if approved) and likely further extend the proposal due date/time.
5If the rule applies, has the Government requested or obtained a contract-specific nonmanufacturer rule waiver from SBA for these items? If not, does the Government intend to request one?
Yes, the Government has requested the waiver from the SBA and it is pending at this time.
6Absent a waiver, will the Government accept a quote from an SDVOSB reseller offering original Terumo BCT product?
No. However, the waiver has been requested and is pending at this time. If a waiver is not received, the solicitation will likely be canceled.
7The solicitation is identified as a 100% SDVOSB set-aside, but Section I incorporates FAR 52.219-6, Notice of Total Small Business Set-Aside (Deviation 2026-O0038), and does not include an SDVOSB set-aside clause such as FAR 52.219-27. Please confirm whether this requirement is restricted to SDVOSBs or open to all small businesses, and which clause governs.
This clause has been added. See soliciation Amendment 0003.
8Section L requests the offeror's commercial published price list with discounts. For a reseller supplying the OEM's products, is the manufacturer's published price list (with the offeror's discount off that list) acceptable?
Yes.
9Please confirm that Exhibit A – Pricing Sheet is the only required price format, and whether estimated annual quantities for each item are available to support pricing for each 12-month period.
Attached to Amendment 0003 is an updated Pricing Sheet with Estimated Quantities. Please provide your pricing on this document.
10Section L, paragraph 6, refers to "small laboratory research animals identified in the SOW." We believe this may be carryover text, as the SOW covers Trima Accel consumables. Please confirm that pricing should cover only the six consumable items listed in Section C.
This has been removed via Amendment 0003.
11The solicitation requires Exhibit A – Pricing Sheet. Could you please confirm where this spreadsheet is available?
Attached to Amendment 0003 is an updated Pricing Sheet with Estimated Quantities.
12Could you confirm the designated electronic quotation submission email address and whether there are estimated ordering quantities for the six required items?
tara.j.borntreger.civ@health.mil; jeremy.l.mcmurry.civ@health.mil; A pricing sheet with updated Estimated Quantities is included with Amendment 0003
