Acquisition
1. Identification of the agency and contracting activity:
This justification is executed by the Defense Health Agency Contracting Activity (DHACA), Healthcare Contracting Division - West, San Diego, CA, on behalf of Robert E. Bush Naval Hospital, Surgical Suite, 1145 Sturgis Rd MCAGCC, Twentynine Palms, CA 92278.
2. Nature and/or Description of Action being approved:
This procurement is for a new requirement for a Brand Name or equal: SLX Surgical Lights utilized by the Surgical Suite, Robert E. Bush Naval Hospital, Twentynine Palms, CA. The Government intends to award a onetime firm-fixed-price supply purchase order.

4. Statutory Authority Cited permitting other than full and open competition:
This acquisition of commercial items is conducted pursuant to FAR Subpart 13.5 in accordance with 41 U.S.C. 1901 Simplified Acquisition Procedures.
5. Rationale Justifying Use of the Statutory Authority Cited:
This brand name or equal justification is prepared using the format at FAR 6.303-2, modified to reflect the procedures in FAR Subpart 13.5 in accordance with 41 U.S.C. 1901. The Surgical Suite is in need of new surgical lights and integrated endoscopy monitors to replace the Steris Harmony lights and monitors currently in use. The Surgical Suite performs 900 surgical procedures per year. Adequate lighting is necessary for visualization during surgery. Inadequate lighting presents a significant patient safety issue. Additionally, the Surgical Suite cannot use an operating room without new surgical lights, reducing mission capability by 25%. Additionally, the integrated monitors with this legacy system do not work with the new Stryker 4K visualization system. The Surgical Suite is requesting SLX Surgical Light equipment as a replacement for the Steris Harmony system in order to facilitate integration with existing Stryker 4K endoscopy equipment.
6. Efforts to Obtain Competition:
Market research was conducted by technical experts in June 2024. This research consisted of a variety of market research methods were used to include the review of mandatory sources, reviews of similar previous procurements, online search engines of other potential resources that could provide the Brand Name or equal: SLX Surgical Lights as requested. Market research revealed that the SLX Surgical Lights is not available from mandatory sources ECAT, MMC, SBA Dynamic, GSA Advantage, AbilityOne, Unicor, and GSAXcess. In accordance with (IAW) FAR 12.207(b)(2)(i) and DFARS 216.601(d)(i)(B)(1), market research was conducted by reviewing mandatory sources at FAR Part 8, Mandatory Sources, searching through historical data for this acquisition. Market research has determined there are two Service Disabled Veteran Owned Small Businesses (SDVOSB) who can provide this requirement. Based on the results of the market research, this requirement shall be solicited as a Brand Name or equal: SLX Surgical Lights as a SDVOSB set aside.

7. Determination that Anticipated Cost to the Government will be Fair and Reasonable:
In accordance with the basis for award procedures at FAR 13.106-3, the Contracting Officer will utilize a comparison of the proposed prices with prices found reasonable on previous purchases and a comparison of the price to the independent Government estimate provided by the requiring activity to determine the vendor's quoted price fair and reasonable.
8. Market Research:
Market research was conducted by technical experts in June 2024. TrillaMed LLC, and L1 Enterprises, Inc.
11. Actions to overcome barriers:
The Robert E. Bush Naval Hospital, Surgical Suite and the DHA Healthcare Contracting Division - West will continue to survey and engage the market of any potential vendors that can provide SLX Surgical Lights and will consider competing future requirements if there are other vendors capable of meeting the Government’s requirements.

13. Contracting Officer Fair and Reasonable Cost Determination and Approval:
This procurement will utilize simplified acquisition procedures under FAR Subpart 13.5.
SLX Surgical Lights are commercially available by multiple contractors, which establishes current information that will be used as a basis for fair and reasonableness. Certified cost or pricing data will not be required in accordance with FAR 15.403-1(b)(3). I have determined that the anticipated cost to the Government for this contract action is fair and reasonable, and I certify that this justification is accurate and complete to the best of my knowledge and belief.
