MQS Acquisition RFP HT0050‐16‐R‐0001 Consolidated Questions and Answers
Number
Topic Question/Comment RFP Reference Response
3021 Letter of Credit Please confirm that the letter of credit must be from the prime; if offeror is a joint venture, please confirm that the letter of credit must be from the JV itself or the Small Business managing member of the JV.

Line of Credit
See Amendment 0002 ‐ changes to Provision 52.212‐1 & 52.212‐2. It will not be a letter of credit but a Line of Credit (LOC). And the LOC must be from the Prime contractor.
For the purposes of this acquisition the Government does not acknowledge a "managing" member of a Joint Venture but rather views the Joint Venture as a whole (as registered in SAM.gov). Regardless of an SBA recognized managing member, the LOC would have to be submitted in the name of the Joint Venture.
3027 Letter of Credit The referenced solicitation states that it is mandatory for us to have a $6M Line of Credit. This number is way too steep for a small business. We are a $28M company and yet only have $1M Credit Line. Banks simply don’t give that large credit lines unless you are a $50M company. We strongly ask you to reduce the mandate on this steep requirement. If not, it would be impossible for the DHA to get many credible offers on this. This requirement is unreasonable and anti‐small business – ironically on a SB set‐aside opportunity.

See Amendment 0002 ‐ changes to Provision 52.212‐1 and 52.212‐2.
The Government has reduced the amount of the line of credit to, at least $1M and it will be contingent upon award (not a responsive deliverable). An Offeror who would otherwise be an apparent awardee on the contract outside of providing the line of credit, the Government would follow procedures found in FAR Part 19‐6.
3093 Letter of Credit For the Letters of Credit, is it possible to have multiple letters to reach the required 6M?
Page 167; Addendum 52.212‐1, Section 6, Volume 1‐Administration, Bullet 5 Line or Letter of Credit (Tab 5)
See Amendment 0002 ‐ changes to Provision 52.212‐1 and 52.212‐2.
There is no prohibition on the number of Lines of Credit.
3094 Letter of Credit Will a Factoring Letter of Credit meet the required 6M? Page 167; Addendum 52.212‐1, Section 6, Volume 1‐Administration, Bullet 5 Line or Letter of Credit (Tab 5)
See Amendment 0002 ‐ changes to Provision 52.212‐1 and 52.212‐2.
The Government requires evidence of the line of credit from a financial institution.
3095 Letter of Credit Would a Commercial Financial Lender be considered as “other financial institution”?

3099 Letter of Credit "Tribal Company Name" is a Tribally‐owned enterprise that has the full financial backing of the "Tribal Nation" . Per a letter signed by the Chief of the "Tribal Nation Name" : “"Tribal Company Name" was created by and for the "Tribal Nation" to further the tribe’s interests and increase its economic development. As such, "Tribal Nation " has the full financial backing and support of the "Tribal Nation Name" in its endeavors.” Is this statement sufficient to demonstrate financial capacity, in place of a line or letter of credit for at least $6M?

3100 Letter of Credit "Tribal Company Name" is a Tribally‐owned enterprise that has the full financial backing of the "Tribal Nation" . Will a line or letter of credit from the "Tribal Nation" be sufficient to demonstrate financial capability, in place of one from a bank or other financial institution?

3101 Letter of Credit "Tribal Company Name" is a subsidiary of the "Tribal Nation" through a holding company. Will a line or letter of credit from the holding company be sufficient to demonstrate financial capability, in place of one from a bank or other financial institution?

3137 Letter of Credit We are requesting that the amount of the credit that is required is reduced. As a small cash positive business, the lending rules will not allow this amount to given in a letter of credit unless there is an equal amount in the account. Can DHA please re‐consider this requirement?

3145 Letter of Credit One of the requirements for submission is a $6M line of credit. If we are submitting as a JV, would we need to submit a $6M credit line from each JV Member, or would a combined credit line from both members equaling $6M be sufficient? (example: Managing Member has a $3M credit line and Partner Member has a $3M credit line, for a total of $6M).

3112 Supporting Documentation
Can a contract‐level CPARS be submitted to demonstrate magnitude, performance on an IDIQ or FFP contract and performance as a prime contractor, if the contract‐level CPARS displays the required information?
Pages 129‐130; Addendum to 52.212‐1, Section 7, Volume II ‐ Technical, Technical Capability Supporting Documentation
A contract‐level CPARS may be submitted to demonstrate performance when claiming points for the IDIQ, FFP and Prime contractor sections of Self Scoring Technical Capability Worksheet.
For magnitude, where pointing amounts vary, the supporting documentation must address the specific service provided (the magnitude of the task). A contractor will provide either a task order CPARS or a signed Technical Capability Validation Worksheet (Attachment 3) if the magnitude task’s CPARs was consolidated under a contract level CPARS or if there was no CPARS available.
